事件の表示 平成10年特許願第512566号「レーザ」拒絶査定不服審判事件〔平成10年 3月12日国際公開、WO98/10497、平成12年12月26日国内公表、特表2000-517481〕について、次のとおり審決する。 
結論 本件審判の請求は、成り立たない。 
理由 1.本願発明
本願は、1997年9月2日(パリ条約による優先権主張外国庁受理1996年9月5日 スウェーデン国)を国際出願日とする特許出願であって、その請求項に係る発明は、平成13年3月7日付け、及び平成15年9月25日付け手続補正書により補正された明細書および図面の記載からみて、その特許請求の範囲の請求項1〜24に記載された事項により特定されるとおりのものであるところ、その請求項1に記載された発明は次のとおりのものである。
「1.レーザ・マイクロチップ(1,1a)をダイオード・レーザ(7)からの放射でポンピングすることにより、レーザ空洞内のレーザ・マイクロチップから基本波長のレーザ放射を発生する工程を含むレーザ放射を発生する方法であって、前記基本波長のレーザ放射を、レーザ空洞内の準位相整合格子で構成される光学的非線形素子により基本波長の半分の波長を持つ周波数倍化放射に変換する工程を特徴とする方法。」

2.刊行物記載の発明
これに対し、原審の拒絶理由に引用された、この出願前公知の刊行物である国際公開第95/06345号パンフレット(以下、「引用例1」という。)には、下記の記載が認められる。
(1)「BEST MODES FOR CARRYING OUT THE INVENTION
While this invention is susceptible of having many different forms, described herein are specific exemplary embodiments of the invention.
Referring now to the drawing, and more particularly to Fig. 1 thereof, laser 11 comprises gain medium 12 in the form of a thin etalon which is made from a rare earth doped crystal material. The etalon is bonded, such as by epoxy 19, to nonlinear crystal 16 to form a composite cavity. That cavity is optically pumped by source 13.
A highly suitable optical pumping source consists of at least one gallium aluminum arsenide, GaAlAs, laser diode which emits light having a wavelength of about 800nm, preferably about 809nm, and which is attached to a heat sink.」(6頁15行〜25行)
(2)「The embodiments of Figs. 1 and 2 employ lasers 11,21 having separate gain elements (12,22) and frequency doubling media (16,26) bonded by materials 19, 29 to form monolithic structures.
The Fig. 3 embodiment is structurally and functionally similar to those of Figs. 1 and 2. Laser 31 includes the addition of dielectric spacer 37 between lasing medium crystal 32 and doubling crystal 36. As shown here, the spacer is annular in shape and creates a small air gap between the crystals. That air gap would normally be between 25 and 500μm wide, and preferably would be 50-100μm wide. Pumping source 33 and exterior end faces 34 and 35 operate the same as described for the other embodiments. Faces 41 and 42 are also coated and their functions are substantially the same as the interior faces described above with respect to the embodiments of Figs. 1 and 2.」(9頁5行〜16行)
(3)「From these values, and from Figs. 1-3, the Conceptual Representation of Fig. 4 can be easily understood. The pumping diode light at 809nm enters at face 14, causes lasing at 〜914 nm within the composite cavity between faces 14 and 15. The intracavity nonlinear crystal gives rise to frequency doubling to 〜457 nm which, because of the low reflectivity of face 15 for the blue light, which can be as low as 1% to as high as 20%, is transmitted from the composite cavity as useful blue laser light.」(10頁24行〜11頁4行)
(4)「 CLAIMS
1.A laser comprising:
an active gain medium comprising a rare earth doped microlaser crystal (12, 22, 32, 52, 62) which has two opposite faces, (14, 17), said gain medium having a polarized emission at about 900nm when optically pumped;
a nonlinear frequency doubling crystal (16, 26, 36, 56, 66) oriented to phase match at about 900nm, said crystal having two opposite faces (15, 18), said gain medium and doubling crystal being bonded together to form a composite cavity; and
optical pumping means (13, 23, 33, 53, 63) in operative relationship with said composite cavity for pumping said composite cavity in which frequencydoubling to the blue of its fundamental frequency occurs, the output of said composite cavity being polarized.」(14頁1行〜13行)
同じく、国際公開第96/18132号パンフレット(以下、「引用例2」という。)には、下記の記載が認められる。
(5)「Field of Invention
The present invention refers to a device for generating frequency doubled laser light by quasi-phase matching, comprising a laser diode, the active region of which emits coherent radiation at a fundamental wavelength; a frequency doubling waveguide, receiving said fundamental wavelength radiation and providing frequency doubled radiation, the wavelength of which being half the fundamental wavelength, said waveguide being formed in a non-linear optical element with a quasi-phase matching grating that satisfies the quasi-phase matching condition for frequency doubling with respect to the fundamental wavelength from the laser; and a stabilizing grating which provides frequency stabilizing feedback to the laser diode.」(1頁2行〜15行)
(6)「A further aspect of quasi-phase matching is that even if the properties of the non-linear material and the dimensions of the quasi-phase matching grating can be controlled with high accuracy, currently available lasers cannot be constructed with corresponding predetermined wavelengths with the same accuracy. Hence, the frequency of the fundamental wave in many cases is not exactly known when the laser is manufactured or bought. To make sure that the above mentioned phase matching condition will be fulfilled, several waveguides are often manufactured in the non-linear material, wherein the grating periods Λof the quasi-phase matching gratings are arranged to be slightly different in the different waveguides.The light from the laser is then coupled to one waveguide at a time, and the frequency doubled signal is registered, whereby the waveguide, i.e. the quasi-phase matching grating, providing the largest generation of frequency doubled light can be determined. Thereby, it can be ensured that the fundamental wavelength and the grating period Λaccommodates the quasi-phase matching condition.」(5頁31行〜6頁13行)
(7)「Detailed description of embodiments
Fig. 1A shows a waveguide being arranged at the surface of a non-linear material, wherein a quasi-phase matching grating has been formed by ferroelectric domain inversion.
Fig. 1B shows, for purpose of comparison, the generation of the frequency doubled wave as function of the length of the material with and without quasi-phase matching.
Fig. 2A and 2B schematically show cross sections through a DFB and DBR laser.
Fig. 3 shows a device for the generation of frequency doubled laser light by means of quasi-phase matching according to an embodiment of the present invention. In Fig. 3 a frequency doubling laser unit comprises a laser diode 1 having an active region emitting coherent radiation at a fundamental wavelength. The diode laser shall be of a transverse single mode type and shall preferably be of a longitudinally single mode type or have a narrow spectrum (multi-mode) being matched to the phase matching bandwidth for frequency doubling (typically 0.1 nm). In this embodiment, the laser diode 1 is a DFB or a DBR laser providing frequency stabilization of the laser spectrum.
Light from the active region 1 of the diode laser is transferred to a waveguide 3 in a non-linear element 4 through an optical fiber 2. Both the fiber 2 and the waveguide 3 is of a single mode type. Furthermore, the optical fiber 2 is connected to the waveguide 3 by means of a glue joint 5.
The non-linear element is preferably formed by LiNbO3, LiTaO3 or KTiOPO4. Furthermore, the non-linear element 4 comprises a domain inverted grating arranged in the waveguide 3 providing quasi-phase matching of light from the laser diode 1, whereby a substantial part of the fundamental wave from the laser diode 1 is converted into a wave having the doubled frequena.
As mentioned, the non-linear element may comprise several waveguides having quasi-phase matching gratings with somewhat different grating periods, wherein the laser diode is connected to the waveguide providing the highest output power at the frequency doubled wave.」(13頁21行〜14頁25行)

3.対比
本願の請求項1に係る発明(以下、「本願発明」という。)と引用例1記載のものとを対比する。
(1)引用例1記載の発明において、「a rare earth doped microlaser crystal (12, 22, 32, 52, 62)」、「optical pumping means (13, 23, 33, 53, 63)」、「composite cavity between faces 14 and 15」、「lasing at 〜914 nm」、「a nonlinear frequency doubling crystal (16, 26, 36, 56, 66)」、「frequency doubling to〜457 nm」は、それぞれ本願発明の「レーザ・マイクロチップ(1,1a)」、「ダイオード・レーザ(7)」、「レーザ空洞」、「基本波長のレーザ放射」、「光学的非線形素子」、「基本波長の半分の波長を持つ周波数倍化放射」に相当し、
(2)引用例1記載の発明において、a rare earth doped microlaser crystal (12, 22, 32, 52, 62)をoptical pumping means(13, 23, 33, 53, 63)からの放射でポンピングすることにより、composite cavity 内の上記a rare earth doped microlaser crystalから 〜914 nmのレーザ放射を発生する工程を含むことは明らかであるので、両者は、
「レーザ・マイクロチップ(1,1a)をダイオード・レーザ(7)からの放射でポンピングすることにより、レーザ空洞内のレーザ・マイクロチップから基本波長のレーザ放射を発生する工程を含むレーザ放射を発生する方法であって、前記基本波長のレーザ放射を、レーザ空洞内の光学的非線形素子により基本波長の半分の波長を持つ周波数倍化放射に変換する工程を有する方法」の点で一致し、下記の点で相違する。
(相違点)
本願発明のものは、光学的非線形素子を準位相整合格子で構成されているのに対して、引用例1に記載のものは、光学的非線形素子を位相整合部材
(oriented to phase match)としている点

4.判断
上記相違点に付き検討する。
上記引用例2には、ダイオードレーザからのレーザ放射を光学的非線形材料の表面に設けた光導波層に導き、a quasi-phase matching grating(本願発明の「準位相整合格子」に相当)によりfundamental wavelength(基本波長)のレーザ放射をfrequency doubled laser light(周波数2倍化)のものに変換(当然波長は半分になる)する工程が記載され、また引用例2に記載された光学的非線形材料は、本願発明と同様にLiNbO3、KTPで構成されている。してみると、上記引用例1及び引用例2に記載された、基本波長のレーザ放射を半分の波長を持つ放射に変換するという波長変換技術の共通性から見て、上記引用例1記載の位相整合部材に代えて、引用例2に記載のa quasi-phase matching gratingを適用して本願発明とすることは格別困難とはいえない。
そして、本願発明によってもたらされる効果は、引用例1〜2に記載の技術から、当業者が予測し得る程度のものであり、格別とはいえない。

5.むすび
以上のとおり、本願発明は、引用例1、2に記載された発明の技術に基づいて当業者が容易に発明をすることができたものであるから、特許法第29条第2項の規定により特許を受けることができない。
よって、結論のとおり審決する。
