理由 1 手続の経緯
本願は,2008年(平成20年)8月27日(パリ条約による優先権主張 外国庁受理2007年8月28日,米国)を出願日とする特願2008-218759号(以下,「原出願」という。)の一部を平成25年4月3日に新たな出願としたものである。
そして,その手続の経緯は以下のとおりである。

2 本願発明について
(1)本願発明
平成27年7月2日付けの手続補正(以下「本件補正」という。)は,本件補正前の請求項7,8,14及び16を削除し,本件補正前の請求項9及び17において前記削除した請求項の引用を削除するものであるから,請求項の削除を目的とするものであって,特許法第17条の2第3項ないし第5項に規定された要件を満たす。
そして,本願の請求項1に係る発明(以下,「本願発明」という。)は,本件補正後の請求項1に記載された次のとおりのものと認める。
「バリア層およびチャンネル層を含むIII族窒化物ヘテロ構造と,
バリア層の上にあるスペーサ層と,
スペーサ層の上にある第1の不動態化構造であって,寄生キャパシタンスを低減し,デバイストラッピングを最小にするための第1の不動態化構造と,
前記第1の不動態化構造の上にある第2の不動態化構造であって,前記III族窒化物ヘテロ構造をカプセル化し,環境バリアを提供するための第2の不動態化構造と,

Silicon nitride also provides an environmental barrier that the oxide fails to provide, or without which, would allow the environment to degrade the structure and operation of the device, regardless of whether the device includes an oxide layer. As an environmental barrier, silicon nitride is preferred over silicon dioxide because it forms a better seal over the device, preventing contaminants such as water from reaching the epitaxial layers of the device and from causing degradation. Silicon nitride may also be used to form layers that transmit light generated within an LED.
[0008] The dense structure of silicon nitride does not provide the open channels found in oxide structures; thus, nitride is widely employed in electronics as a barrier material. In particular, hydrogen diffuses slowly in a densified nitride film, and other small positive ions (Na^(+) or K^(+) ) are effectively blocked by thin nitride layers. Because oxygen diffuses very slowly through nitride, deposited nitride can prevent oxidation of underlying silicon.
[0009] Nevertheless, nitrides deposited using chemical vapor deposition (often plasma enhanced chemical vapor deposition, "PECVD") almost always contain hydrogen, typically much more than in the comparable oxide films. The source of the hydrogen is the silane precursor and also the ammonia employed in many CVD schemes. An amorphous, but constrained, film such as silicon nitride can discourage the atoms from occupying positions that fill the valences of each silicon and nitrogen atom. Thus, many broken bonds tend to be present. These bonds are readily occupied by hydrogen atoms. Thus, conventional plasma nitrides can have as much as 20 atomic percent hydrogen, bonded both to the Si and N atoms; thermal nitrides still have several percent hydrogen even after high-temperature anneals.
[0010] Additionally, hydrogen can passivate Mg-acceptors in a GaN-based semiconductor. Although the precise mechanism is not completely understood, when silicon nitride is deposited by means of PECVD at a deposition temperature in excess of 200゜C, hydrogen in the film can diffuse through thin ohmic contacts or other layers and into nearby Group III nitride layers, causing them to become passivated in a region close to their surface. That is, in a region near the surface, a substantial number of acceptor ions are rendered neutral by the introduction of hydrogen in the film. Accordingly, an interface between an ohmic contact and a nitride material is degraded, and the contact metal does not exhibit ideal ohmic characteristics. This can result in an increase in forward voltage (V_(f) degradation) in the device. Essentially, the device will behave as though the interface between a metal and a Group III nitride contact layer forms a Schottky contact instead of an ohmic contact.
[0011] Because nitride passivation layers are often used in conjunction with oxide layers, the hydrogen can migrate to the oxide layers. In turn, hydrogen in oxide films on SiC has been shown to alter the interface Fermi level and encourage a state of surface accumulation. Any resulting accumulation layer produces a charge layer that alters the device capacitance and exhibits a drift with a long time constant caused by the mobility of the hydrogen in the film.
[0012] Accordingly, although oxide and nitride layers offer certain advantages, they also raise certain problems that can limit or degrade device performance.」

The barrier layer 22 may be a Group Ill-nitride and has a bandgap larger than that of the channel layer 20 and a smaller electron affinity than the channel layer 20. Accordingly, in certain embodiments of the present invention, the barrier layer 22 is AlGaN, AlInGaN and/or AlN or combinations of layers thereof.

Figure ID illustrates the formation of the etch stop layer 26 and the dielectric layer 28. The etch stop layer 26 may be formed on the barrier layer 22 and ohmic contacts 30 and may be epitaxially grown and/or formed by deposition. The etch stop layer 26 may be sputtered AlN. In other embodiments, the etch stop layer 24 may be SiO_(2) formed by ex-situ plasma-enhanced chemical vapor deposition (PECVD) of SiO_(2) . Typically, the etch stop layer 26 may have a thickness of from about 50A - 300A. The dielectric layer 28 may be formed on the etch stop layer 26 and may be formed by deposition. The dielectric layer 28 material may include SiN, SiO_(2), or SiON formed by ex-situ PECVD on top of etch stop layer 26. 図1Dは,エッチストップ層26および誘電体層28の形成を示す。エッチストップ層26は,バリア層22およびオーム接点30上に形成することができ,エピタキシアル成長させ,かつ/または堆積によって形成することができる。エッチストップ層26は,スパッタAlNでよい。他の諸実施形態では,エッチストップ層26は,SiO2のex-situプラズマ化学気相成長(PECVD)によって形成されたSiO2でよい。一般に,エッチストップ層26は,約50Å?300Åの厚さを有することができる。誘電体層28は,エッチストップ層26上に形成することができ,堆積によって形成することができる。誘電体層28の材料は,ex-situのPECVDによってエッチストップ層26上に形成したSiN,SiO2,またはSiONを含むことができる。誘電体層28は,エッチストップ層26とは組成が異なる。一般に,誘電体層28は,約500Å?2000Åの厚さを有することができる。)
(ウ)「As seen in Figure IH, the gate contact 32 is formed in the recess and contacts the exposed portion of the barrier layer 22. ...Suitable gate materials may depend on the composition of the barrier layer 22, however, in certain embodiments, conventional materials capable of making a Schottky contact to a nitride based semiconductor material may be used, such as Ni, Pt, NiSi_(x) , Cu, Pd, Cr, W and/or WSiN. ...
As also seen in Figure IH, portions of the etch stop layer 26 and the dielectric layer 28 that were formed on the ohmic contacts 30 are removed to provide access to the ohmic contacts 30. This may occur at any time during or after the formation of the gate recess. The interface between the etch stop layer 26 and barrier layer 22 may have a low surface-state density and provide a high barrier to prevent injection of electrons from the barrier layer 22 to the etch stop layer 26. In other words, the etch stop layer 26 may provide good passivation.
A passivation layer may also be provided on the structure of Figure IH. The passivation layer may be blanket deposited on the structure of Figure IH. In certain embodiments of the present invention, the passivation layer may be silicon nitride, aluminum nitride, silicon dioxide, an ONO structure and/or an oxynitride. Furthermore, the passivation layer may be a single or multiple layers of uniform and/or non-uniform composition.
Figure 2 illustrates formation of transistors according to further embodiments of the present invention. As seen in Figure 2, the structure of Figure IH may have an insulating layer 130 formed on the structure including in the gate recess. The gate contact 32 may then be formed on the insulating layer 130. The insulating layer 130 may be one or more layers and may include, for example, SiN, AlN, SiO_(2) , and/or an ONO structure. Thus, in some embodiments of the present invention, an insulating gate HEMT may be provided」(13頁21行-14頁30行)

また,図1Hから分かるように,オーム接点30上に形成されたエッチストップ層26および誘電体層28の一部分を除去して,オーム接点30へのアクセスを可能にする。これは,ゲートリセスの形成中またはその後に,いつでも行うことができる。エッチストップ層26とバリア層22の間の境界面は,低表面準位密度を有し,バリア層22からエッチストップ層26への電子の注入を防止する高い障壁をもたらすことができる。換言すれば,エッチストップ層26は,良好なパッシベーションをもたらすことができる。
パッシベーション層を,図1Hの構造上に形成することもできる。パッシベーション層は,図1Hの構造上にブランケット堆積することができる。本発明のいくつかの実施形態では,パッシベーション層は,窒化シリコン,窒化アルミニウム,二酸化ケイ素,ONO構造および/または酸窒化物でよい。さらに,パッシベーション層は,組成が一様および/または非一様な,単一の層または複数の層とすることができる。
図2は,本発明の別の諸実施形態によるトランジスタの形成を示す。図2から分かるように,図1Hの構造は,ゲートリセス内を含む構造上に形成された絶縁層130を有することができる。次いで,絶縁層130上にゲート接点32を形成することができる。絶縁層130は,1層または複数層でよく,例えば,SiN,AlN,SiO_(2)および/またはONO構造を含んでよい。したがって,本発明のいくつかの実施形態では,文献に記載されているように絶縁ゲートHEMTを形成することができる。)
(エ)図2には,チャネル層20及びバリア層22の上にエッチストップ層26及び誘電体層28が配置され,エッチストップ層26及び誘電体層26のゲートリセス内を含む上面に絶縁層を形成し,絶縁層状にゲート接点32を形成することが記載されている。
イ 引用発明3
前記アより,引用文献3には次の発明(以下,「引用発明3」という。)が記載されていると認められる。
「III族窒化物のチャネル層及びバリア層の上に良好なパッシベーションをもたらすエッチストップ層及び誘電体層が配置され,エッチストップ層及び誘電体層のゲートリセス内を含む上面に絶縁層を配置し,絶縁層上にゲート接点を形成し,その構造の上にパッシベーション層をブランケット堆積した高電子移動度トランジスタ(HEMT)。」
(5)本願発明と引用発明1との対比
本願発明の「III族窒化物ヘテロ構造」及び「高電子移動度トランジスタ(HEMT)」は,それぞれ「半導体構造」及び「デバイス」ということができる。
引用発明1の「寄生容量を減少し,デバイスのトラッピングを最小化する,第1の不動態化構造」は,本願発明の「第1の不動態化構造であって,寄生キャパシタンスを低減し,デバイストラッピングを最小にするための第1の不動態化構造」に相当すると認められる。
本願発明の「前記第1の不動態化構造の上にある第2の不動態化構造であって,前記III族窒化物ヘテロ構造をカプセル化し,環境バリアを提供するための第2の不動態化構造」は,引用発明1の「半導体構造をカプセル化し,環境障壁を提供する,第1の不動態化層の上の第2の不動態化層」と,「前記第1の不動態化構造の上にある第2の不動態化構造であって,半導体構造をカプセル化し,環境バリアを提供するための第2の不動態化構造」である点で共通する。
引用発明1の「窒化珪素,窒化アルミニウム,珪素の酸窒化物,およびアルミニウムの酸窒化物から選択される非化学量論的な窒化物の少なくとも1つのスパッタされた層」は,本願発明の「窒化ケイ素,窒化アルミニウム,ケイ素の酸窒化物,アルミニウムの酸窒化物から成る群から選択された非化学量論的窒化物の少なくとも1つのスパッタリングされた層」に相当すると認められる。
本願発明の「前記III族窒化物へテロ構造を完全にはカプセル化せずに,後続の不動態化層を前記III族窒化物ヘテロ構造からさらに遠くに位置決めするための窒化ケイ素の少なくとも1つの化学気相堆積層」と,引用発明1の「半導体構造を完全にカプセル化することなく半導体構造からさらに遠くに不動態化層を配置する,窒化珪素の少なくとも1つの化学蒸着された層」とは,「半導体構造を完全にはカプセル化せずに,後続の不動態化層を半導体構造からさらに遠くに位置決めするための窒化ケイ素の少なくとも1つの化学気相堆積層」という点で共通すると認められる。
引用発明1の「第2不動態化層は化学量論的な環境障壁を備えている」は,窒化珪素層からなるもの(前記(2)ア(オ))であり,本願発明の「前記第2の不動態化構造は,化学量論的窒化物の環境バリアを含む」に相当すると認められる。
してみると,本願発明と引用発明1を対比すると,下記アの点で一致し,下記イの点で相違すると認められる。
ア 一致点
「第1の不動態化構造であって,寄生キャパシタンスを低減し,デバイストラッピングを最小にするための第1の不動態化構造と,
前記第1の不動態化構造の上にある第2の不動態化構造であって,半導体構造をカプセル化し,環境バリアを提供するための第2の不動態化構造と,

前記第1の不動態化構造は,窒化ケイ素,窒化アルミニウム,ケイ素の酸窒化物,アルミニウムの酸窒化物から成る群から選択された非化学量論的窒化物の少なくとも1つのスパッタリングされた層と,半導体構造を完全にはカプセル化せずに,後続の不動態化層を半導体構造からさらに遠くに位置決めするための窒化ケイ素の少なくとも1つの化学気相堆積層とを含み,
前記第2の不動態化構造は,化学量論的窒化物の環境バリアを含む,デバイス。」
イ 相違点
(ア)相違点1
本願発明の「デバイス」は「高電子移動度トランジスタ(HEMT)」であり,「半導体構造」が「III族窒化物ヘテロ構造」であって「バリア層及びチャンネル層」を含むものであり,「バリア層の上にスペーサ層」があり,「第1の不動態構造」は「スペーサ層」の上にあるものであるのに対し,引用発明1の「デバイス」においては,「半導体構造」が「III族の窒化物層」であり,「第1の不動態構造」は「III族の窒化物層」の上にあるものである点。
(イ)相違点2
本願発明は,「第1の不動態化構造と第2の不動態化構造との間にある絶縁層」を含むのに対し,引用発明1は「第1の不動態化構造と第2の不動態化構造との間にある絶縁層」を含まない点。
(6)相違点についての検討
ア 相違点1について
引用発明1は,環境障壁における水素の移動によるデバイスの性能劣化を防止する(前記(2)ア(イ))という本願発明と同様の課題を解決するものである。そして,この課題はデバイスに普遍的な課題であるところ,引用発明1のIII族窒化物デバイスを具体化するにあたり,引用発明2にみられるような周知の高電子移動度トランジスタのキャップ層(スペーサ層)及びIII族窒化物ヘテロ構造を採用して,高電子移動度トランジスタとすることは,当業者が適宜なし得ることである。
イ 相違点2について
引用発明1はデバイスであり,具体的には「窒化珪素または窒化アルミニウム層50」の上にリセスされたゲート接点を設けることが開示されている(前記(2)ア)。そして,ゲート接点を設ける際に,ゲート接点を半導体材料に対してショットキー接点を形成するようにするか,ゲート接点を絶縁層上に形成するかは,引用文献3にみられるように当業者が適宜選択すべき均等手段である(前記(4)ア(ウ))から,引用発明1において引用発明3を採用してリセスされたゲート接点を絶縁層上に形成するように設計変更することは,当業者が容易になし得ることである。すると,引用発明3はパッシベーション(不動態化)をもたらすエッチストップ層とパッシベーション層の間に絶縁層を設けるものであるから,これを引用発明1に採用すれば,「第1の不動態化構造と第2の不動態化構造との間にある絶縁層」は,当業者が普通に導けることである。
(7)本願発明の効果について
本願発明の効果は,引用発明1の構成から当業者が予測できるものであり,格別のものではない。
(8)まとめ
したがって,本願発明は,引用発明1ないし3に基づいて,当業者が容易に発明をすることができたものである。

3 結言
したがって,本願の請求項1に係る発明は,特許法第29条第2項の規定により,特許を受けることができないから,その余の請求項について検討するまでもなく,本願は拒絶されるべきものである。

よって,結論のとおり審決する。
