事件の表示 特願2015-527410「多孔性シリコン系負極活物質、この製造方法、及びこれを含むリチウム二次電池」拒絶査定不服審判事件〔平成26年12月 4日国際公開、WO2014/193124、平成27年 8月27日国内公表、特表2015-524993、請求項の数(9)〕について、次のとおり審決する。 
結論 原査定を取り消す。 本願の発明は、特許すべきものとする。 
理由 1 手続の経緯
本願は、2014年(平成26年)5月23日(パリ条約による優先権主張外国庁受理 2013年5月30日 大韓民国(KR))を国際出願日とする出願であって、平成28年1月28日付けで拒絶の理由が通知され、これ対して、同年5月2日に意見書及び手続補正書が提出され、その後、同年10月18日付けで拒絶の理由が通知され、これ対して、平成29年1月23日に意見書及び手続補正書が提出されたが、同年6月26日付けで拒絶査定がなされたものである。
本件は、これを不服として、同年11月2日に請求された拒絶査定不服審判であって、請求と同時に手続補正書が提出されたものである。

2 本願発明
本件出願の請求項1?9に係る発明(以下、それぞれ「本願発明1」?「本願発明9」という。)は、平成29年11月2日付けの手続補正書により補正された特許請求の範囲の請求項1?9に記載された事項により特定される、次のとおりの発明である。

「【請求項1】
(i)シリコンウェハの表面に銀(Ag)粒子を蒸着させる段階;
(ii)前記銀(Ag)粒子が蒸着されたシリコンウェハの表面をエッチング溶液に担持させてシリコンウェハをエッチングし、シリコンウェハの表面、または表面及び内部に空隙を形成する段階;
(iii)前記空隙が形成されたシリコンウェハを金属除去溶液と接触させて前記銀(Ag)粒子を除去した後、得られたシリコンウェハを粉砕して多数の空隙を含む結晶性シリコン粒子を得る段階;及び
(iv)前記結晶性シリコン粒子を炭素前駆体と混合した後、熱処理して結晶性シリコン粒子の表面を炭素でコーティングする段階を含み、
前記エッチング溶液は、フルオロ化水素(HF)溶液と過酸化水素(H_(2)O_(2))溶液の混合溶液であり、前記フルオロ化水素(HF)溶液と過酸化水素(H_(2)O_(2))溶液は、10から90:90から10の重量比で混合され、
前記シリコンウェハは、軸方向が<110>方向のものであり、
前記多数の空隙のうち少なくとも一部の空隙の結晶面は、2つの面が<110>面を含むことを特徴とする多孔性シリコン系負極活物質の製造方法。
【請求項2】
前記蒸着は、フッ素系溶液と銀(Ag)前駆体溶液を混合した後、シリコンウェハと接触させることでなされることを特徴とする請求項1に記載の多孔性シリコン系負極活物質の製造方法。
【請求項3】
前記フッ素系溶液は、フルオロ化水素(HF)、フルオロ化珪素(H_(2)SiF_(6))及びフルオロ化アンモニウム(NH_(4)F)からなる群より選択される1種以上であることを特徴とする請求項2に記載の多孔性シリコン系負極活物質の製造方法。
【請求項4】
前記フッ素系溶液と銀(Ag)前駆体溶液は、10から90:90から10の重量比で混合されることを特徴とする請求項2に記載の多孔性シリコン系負極活物質の製造方法。
【請求項5】
前記シリコンウェハは、前記フッ素系溶液と銀(Ag)前駆体溶液の混合溶液100重量部に対して0.001重量部から50重量部で接触されることを特徴とする請求項2に記載の多孔性シリコン系負極活物質の製造方法。
【請求項6】
前記エッチングは、10分から5時間の間行われることを特徴とする請求項1に記載の多孔性シリコン系負極活物質の製造方法。
【請求項7】
前記金属除去溶液は、硝酸、硫酸及び塩酸からなる群より選択される1種以上であることを特徴とする請求項1に記載の多孔性シリコン系負極活物質の製造方法。
【請求項8】
前記炭素前駆体は、ピッチ(pitch)または炭化水素系物質であることを特徴とする請求項1に記載の多孔性シリコン系負極活物質の製造方法。
【請求項9】
前記熱処理は、300℃から1400℃の温度範囲で行われることを特徴とする請求項1に記載の多孔性シリコン系負極活物質の製造方法。」

(ウ)「Detailed Description of the Invention
The process of etching silicon with copper involves a deposition stage in which elemental copper is deposited on a surface of the silicon to cover some but not all of the surface to be etched, and an etching stage in which silicon underlying the deposited copper is etched.

Copper may be deposited on the surface of the silicon by any process known to the skilled person including thermal evaporation, sputtering, electrodeposition and electroless deposition.

If copper is deposited by thermal evaporation, electrodeposition or sputtering then it may be deposited through or over one or more removable masks or templates to define a regular or irregular copper pattern on the surface of the silicon. Exemplary methods of applying a metal using a template are described in Huang et al, "Metal-Assisted Chemical Etching of Silicon: A Review", Advanced Materials 2010, 1-24. Methods such as these may allow more precise control over the size, spacing and arrangement of the resulting silicon structures formed by etching compared to electroless deposition. A suitable removable template can for example be provided by an arrangement of nanospheres or nanoparticles (e.g. SiO_(2) nanospheres) or by a patterned anodised aluminium film.

Electroless deposition may produce a random, scattered distribution of copper ions on the silicon surface and may be a cheaper deposition step compared to the other methods listed above.

If copper is deposited by an electroless process then in a first stage silicon is treated with an aqueous solution of hydrogen fluoride and a source of Cu^(2+) ions. The HF reacts with the silicon according to the following half-reaction:

Si ^(0) + 6F → SiF_(6) ^(2- )+ 4e^(-)

Electrons generated in etching of silicon cause reduction of aqueous copper ions to elemental copper according to the following half-reaction:

2Cu^(2+) (aq) + 4e^(-) → 2Cu (s)

Elemental copper formed by this process is deposited on the surface of the silicon. The aqueous solution may contain one or more solvents in addition to water, for example water- miscible organic solvents. In a preferred embodiment, the aqueous etching solution is substantially free of other solvents.

Any water-soluble copper salt may be used as the source of copper ions including, without limitation, copper sulphate and copper nitrate. The copper ions may be provided in a concentration range of about ImM - 5 M, optionally in the range of 10 mM - 1 M, 10-200 mM or 0.1 - 1 M.

During electroless elemental copper formation, it is the copper ions that are reduced by electrons generated in the etching process. It will be appreciated that electroless deposition of copper as described herein will result in some degree of etching at the silicon surface, unlike copper deposition by thermal evaporation or sputtering, and so the deposition stage may include some degree of silicon etching.

In the case of thermally evaporated or sputtered copper, the thickness of copper deposited may be controlled by control of the deposition rate and the percentage coverage of the silicon surface may be controlled by the dimensions of the mask or template structure.

In the case of electroless deposition of copper, the extent of copper formation may be controlled by the concentration of copper ions in the solution, and / or the length of time that the silicon remains in the solution.

Once copper has been deposited on the silicon surface, etching (or further etching in the case of electrolessly deposited copper) may take place in an etching stage in the presence of HF and an oxidant.

The oxidant (or oxidising agent) is a material that gains electrons or transfers oxygen atoms in a chemical redox reaction. The oxidant is preferably one that is less reactive (a weaker oxidant) than hydrogen peroxide. Preferably the oxidant has an oxidation potential with respect to hydrogen less than that of hydrogen peroxide, i.e. less than 1.2 V. The oxidant may be selected from the group consisting of O_(2) ; O_(3) ; fluorine; chlorine; iodine; bromine; chlorine trifluoride; dinitrogen trioxide; metal oxides; propyl nitrate; and the acid or a salt of BrO_(3)^(-) NO_(3)^(-) , S_(2)0_(8)^(2-) , NO_(2)^(-) , B_(4)O_(7)^(2-) ClO_(2)^(-) , ClO_(3)^(-) or ClO_(4)^(-) or a mixture thereof. Exemplary salts include ammonium perchlorate, ammonium permanganate, calcium chlorate; calcium hypochlorite; chromium trioxide (chromic anhydride);
potassium bromate; potassium chlorate; sodium chlorate; sodium chlorite; and sodium perchlorate. Exemplary acids include chromic acid and perchloric acid. Alkali metal nitrates and ammonium nitrate are preferred.

The oxidant may be provided in a concentration of at least about 0.001 M, optionally at least about 0.01 M, optionally at least about 0.1 M in an aqueous etching solution. The oxidant may be provided in a concentration of up to about 1 M. Preferably, the aqueous etching solution is substantially free of copper ions.

The aqueous etching solution may contain one or more solvents in addition to water, for example water-miscible organic solvents. In a preferred embodiment, the aqueous etching solution is substantially free of other solvents.

HF may be provided in a concentration of at least 0.1 M, optionally about 1-10 M. The same concentration range may be provided for the deposition stage in the case of electroless deposition.

The concentration of HF in the etching stage (and in the deposition stage in the case of electroless deposition), and / or the concentration of the oxidant in the etching stage, may be monitored during the deposition and / or etching process and adjusted as required. 」(第11頁最終行?第14頁第18行)

(オ)「The present inventors have found that etching may be carried out with a relatively small quantity of copper ions as compared to a corresponding process using silver ions. Accordingly, in one embodiment etched bulk silicon, such as a silicon wafer, may be used to form the anode of a metal ion battery without first washing or otherwise treating the bulk silicon to remove residual metal in the wafer. Residual copper present in the wafer may serve to increase conductivity of the anode. Etched silicon containing copper may be annealed to form copper silicide at the copper-silicon interface to improve adhesion of the copper to the silicon.

In the case where the silicon is in particulate forma slurry comprising the particulate silicon and one or more solvents may be deposited over an anode current collector to form an anode layer. The silicon particles may be one or more of etched silicon particles formed by etching a particulate starting material or by fracturing a larger starting material; porous silicon fragments detached from an etched porous silicon surface; and discrete silicon fibres or clumps of silicon fibres formed by detaching silicon pillars from an etched silicon surface. Silicon particles may be provided as a powder of the particles. The slurry may further comprise a binder material, for example polyimide, polyacrylic acid (PAA) and alkali metal salts thereof, polyvinylalchol (PVA) and polyvinylidene fluoride (PVDF), sodium carboxymethylcellulose (Na-CMC) and optionally, non-active conductive additives, for example carbon black, carbon fibres, ketjen black or carbon nanotubes. In addition to providing the silicon particles to act as an active material in the battery, one or more further active materials may also be provided in the slurry.

Exemplary further active materials include active forms of carbon such as graphite or graphene,. Active graphite may provide for a larger number of charge / discharge cycles without significant loss of capacity than active silicon, whereas silicon may provide for a higher capacity than graphite. Accordingly, an electrode composition comprising a silicon-containing active material and a graphite active material may provide a lithium ion battery with the advantages of both high capacity and a large number of charge / discharge cycles. The slurry may be deposited on a current collector, which may be as described above. Further treatments may be done as required, for example to directly bond the silicon particles to each other and/or to the current collector. Binder material or other coatings may also be applied to the surface of the composite electrode layer after initial formation. 」(第23頁第12行?第24頁第15行)

General procedure
In a first stage, a n-doped silicon wafer (about 1 cm^(2) ) having (100) orientation and having a resistivity in the range of about 1-10Ω.cm was placed in 50ml of a first solution of HF and either CuSO_(4) or Cu(NO_(3))_(2). Copper is allowed to form on the surface of the silicon wafer for a first period of time, after which the silicon wafer carrying copper is gently rinsed with deionised water.

In a second stage, the silicon wafer was then placed in a second solution of HF and NH_(4) NO_(3) for at least 30 minutes to form etched silicon.

In an optional third step, the etched silicon wafer was washed with water.

The surface of only one side of a silicon wafer is etched in this general procedure, however it will be appreciated that surfaces on both sides of a silicon wafer may be etched by carrying out the general procedure on both sides of the wafer. Each of the copper deposition and etching steps may be carried out on one surface at a time, or on both surfaces simultaneously. 」(第26頁第3?17行)

(ア)引用文献1には、「シリコンをエッチングする方法」が記載されており、上記ア(エ)より、該シリコンは、エッチングの後でシリコンウエハを複数の小さなシリコン構造へと粉砕してよいものである。
また、上記ア(ク)より、該シリコンはアノードを形成するのに使用してよく、上記ア(イ)より、負極はアノードと呼ばれるから、該シリコンは負極として用いられる。
さらに、上記ア(オ)より、シリコン粒子は電池内で活物質として振る舞うものである。
そうすると、引用文献1には、「シリコンをエッチングした後、複数の小さなシリコン粒子へと粉砕することにより、電池内で負極活物質として振る舞うシリコン粒子を得る方法」が記載されているといえる。

(イ)上記ア(キ)の実施例13は、シリコンウエハの配向以外は、上記ア(カ)の全般的手順と同様の手順で処理をしていると解されるから、上記ア(カ)及び(キ)より、上記(ア)のエッチングは、第1段階で、(110)配向を有するシリコンウエハを20mM CuSO_(4)+7M HFの溶液中に20秒置き、シリコンウエハの表面上に銅を形成させ、第2段階で、シリコンウエハを0.2M NH_(4)NO_(3)+7M HFの溶液中に1.5時間置き、エッチングされたシリコンを形成し、第3ステップで、エッチングされたシリコンウエハを水で洗うことを含むものである。

(ウ)上記ア(キ)より、上記(イ)のエッチングにより、シリコン中においてポアが生成された。
また、上記ア(ケ)のFIGURE15A及び15Bによれば、「ポア」はシリコンウエハの少なくとも表面に多数形成されていることが見てとれる。

(エ)上記(ア)から(ウ)より、引用文献1には、次の発明(以下、「引用発明」という。)が記載されていると認められる。
「第1段階で、(110)配向を有するシリコンウエハを20mM CuSO_(4)+7M HFの溶液中に20秒置き、シリコンウエハの表面上に銅を形成させ、
第2段階で、シリコンウエハを0.2M NH_(4)NO_(3)+7M HFの溶液中に1.5時間置き、エッチングされたシリコンを形成することにより、シリコンの少なくとも表面に多数のポアを生成し、
第3段階で、エッチングされたシリコンウエハを水で洗うことを含む、

原査定の拒絶の理由に引用された引用文献2(国際公開第2011/124893号)には、次の事項が記載されている。

The nucleation step requires the use of a solution comprising hydrogen ions and the use of a solution comprising a metal ion capable of being reduced to form a porous metal layer or mat on the silicon surface. An oxidant may be present. The concentration of hydrogen ions in the nucleation solution is not particularly important but must be sufficient to remove all native oxides from the silicon surface to facilitate deposition of the metal species thereon. The solution comprising a metal ion capable of being reduced on the silicon surface may be provided separately to the solution comprising hydrogen ions providing oxide formation on the surface of the silicon can be prevented. Preferably the hydrogen ions and the metal ions are provided in a single solution. 原査定の拒絶の理由に引用された引用文献3(国際公開第2012/126338号)には、次の事項が記載されている。



(当審訳)「本発明は、電池の電極材料およびその製造方法に関し、特別にはリチウムイオン電池のためのケイ素-炭素複合材料の負極材料、および、その製造方法に関する。」



(当審訳)「リチウムイオン電池のためのケイ素-炭素複合材料の負極材料の構造は、多孔性ケイ素基材および炭素コーティング層からなり、炭素コーティング層は、2質量%?70質量%を占めており、無定形炭素からなり、且つ、2nm?30nmの厚さを有する。多孔性ケイ素基材は、多結晶構造を有し、粒度は、50nm?20μmであり、細孔のサイズは、2nm?150nmであり、細孔容積は、0.1cm^(3)/g?1.5cm^(3)/gであり、且つ、比表面積は、30m^(2)/g?300m^(2)/gである。」

5 当審の判断
(1)本願発明1について
ア 対比
本願発明1と引用発明とを対比する。
(ア)引用発明の「(110)配向を有するシリコンウエハ」は、本願発明1の「軸方向が<110>方向のものであ」る「シリコンウェハ」に相当する。
(イ)引用発明において、「(110)配向を有するシリコンウエハを20mM CuSO_(4)+7M HFの溶液中に20秒置き、シリコンウエハの表面上に銅を形成させ」ることは、シリコンウエハの表面に銅を無電解メッキする工程であると認められるところ、本願明細書には、本願発明1の「蒸着」について、「金属粒子を蒸着させる方法は多様な方法があり、例えば真空基板蒸着及び溶液蒸着方法がある。・・・(略)・・・溶液蒸着方法は、電気メッキ(electro deposition)、無電解メッキ(electroless deposition)及び自己組立法(self assembly)など、電気化学的に金属イオンを還元させてシリコン表面上にメッキさせる・・・(略)・・・ことができる」(【0064】)と記載されているから、引用発明の「(110)配向を有するシリコンウエハを20mM CuSO_(4)+7M HFの溶液中に20秒置き、シリコンウエハの表面上に銅を形成させ」る事項は、本願発明1の「蒸着」に相当するものであるといえる。
そうすると、引用発明の「第1段階で、(110)配向を有するシリコンウエハを20mM CuSO_(4)+7M HFの溶液中に20秒置き、シリコンウエハの表面上に銅を形成させ」る事項と、本願発明1の「シリコンウェハの表面に銀(Ag)粒子を蒸着させる段階」「を含」む事項とは、「シリコンウェハの表面に金属を蒸着させる段階」「を含」む事項で共通する。
(ウ)引用発明の「ポア」は、本願発明1の「空隙」に相当する。
また、引用発明は、「シリコンウエハを0.2M NH_(4)NO_(3)+7M HFの溶液中に1.5時間置き、エッチングされたシリコンを形成することにより、シリコンの少なくとも表面に多数のポアを生成し」ているから、技術常識に照らせば、引用発明の「ポア」は、シリコンウエハの表面及び内部に形成されていることは明らかである。
そうすると、引用発明の「第2段階で、シリコンウエハを0.2M NH_(4)NO_(3)+7M HFの溶液中に1.5時間置き、エッチングされたシリコンを形成することにより、シリコンの少なくとも表面に多数のポアを生成」する事項と、本願発明1の「銀(Ag)粒子が蒸着されたシリコンウェハの表面をエッチング溶液に担持させてシリコンウェハをエッチングし、シリコンウェハの表面、または表面及び内部に空隙を形成する段階」「を含み」、「前記エッチング溶液は、フルオロ化水素(HF)溶液と過酸化水素(H_(2)O_(2))溶液の混合溶液であ」る事項とは、「金属が蒸着されたシリコンウェハの表面をエッチング溶液に担持させてシリコンウェハをエッチングし、シリコンウェハの表面、または表面及び内部に空隙を形成する段階」「を含み」、「前記エッチング溶液は、フルオロ化水素(HF)溶液」を含む事項で共通する。
(エ)引用発明の「シリコンウエハ」は、「(110)配向を有」し、少なくともその「表面に多数のポア」が「生成」されたものであるから、これを「粉砕」することによって得られる「シリコン粒子」は、結晶性であり、「少なくとも表面に多数のポア」を有するものであるといえる。
そうすると、引用発明の「第3段階で、エッチングされたシリコンウエハを水で洗うことを含み、シリコンをエッチングした後、複数の小さなシリコン粒子へと粉砕する」事項と、本願発明1の「空隙が形成されたシリコンウェハを金属除去溶液と接触させて前記銀(Ag)粒子を除去した後、得られたシリコンウェハを粉砕して多数の空隙を含む結晶性シリコン粒子を得る段階」「を含」む事項とは、「得られたシリコンウェハを粉砕して多数の空隙を含む結晶性シリコン粒子を得る段階」「を含」む事項で共通する。
(オ)引用発明の「電池内で負極活物質として振る舞うシリコン粒子を得る方法」は、本願発明1の「シリコン系負極活物質の製造方法」に相当する。
(カ)上記(ア)から(オ)より、本願発明1と引用発明とは、
「(i)シリコンウェハの表面に金属を蒸着させる段階;
(ii)前記金属が蒸着されたシリコンウェハの表面をエッチング溶液に担持させてシリコンウェハをエッチングし、シリコンウェハの表面、または表面及び内部に空隙を形成する段階;及び
(iii)得られたシリコンウェハを粉砕して多数の空隙を含む結晶性シリコン粒子を得る段階を含み、
前記エッチング溶液は、フルオロ化水素(HF)溶液を含み、
前記シリコンウェハは、軸方向が<110>方向のものである、
シリコン系負極活物質の製造方法。」で一致し、次の相違点で相違する。

(相違点)
ア 「シリコンウェハの表面に」「蒸着させる」金属が、本願発明1は、「銀(Ag)粒子」であるのに対し、引用発明は、「銅」である点。
イ 「エッチング溶液」が、本願発明1は、「フルオロ化水素(HF)溶液と過酸化水素(H_(2)O_(2))溶液の混合溶液であり、」「前記フルオロ化水素(HF)溶液と過酸化水素(H_(2)O_(2))溶液」が「10から90:90から10の重量比で混合され」たものであるのに対し、引用発明は、「0.2M NH_(4)NO_(3)+7M HFの溶液」である点。
ウ エッチングの後、本願発明1は、「空隙が形成されたシリコンウェハを金属除去溶液と接触させて前記銀(Ag)粒子を除去」するのに対し、引用発明は、「エッチングされたシリコンウエハを水で洗う」ものの、金属を除去しているのか不明である点。
エ 「シリコン系負極活物質」である、「シリコンウェハを粉砕して」「得る」「多数の空隙を含む結晶性シリコン粒子」が、本願発明1は、「多孔性」であって、「多数の空隙のうち少なくとも一部の空隙の結晶面は、2つの面が<110>面を含む」のに対し、引用発明は、多孔性であるか否か、及び、多数の空隙のうち少なくとも一部の空隙の結晶面は、2つの面が<110>面を含むか否かが不明である点。
オ 本願発明は、「結晶性シリコン粒子を炭素前駆体と混合した後、熱処理して結晶性シリコン粒子の表面を炭素でコーティングする」のに対し、引用発明は、そのようなコーティングを行っていない点。

イ 相違点についての判断
まず、上記アの相違点について検討する。
電極の活物質として用いるシリコン粒子を得るために、シリコンウエハをエッチングする方法において、当該エッチングが行われる、シリコンウエハの場所を確定する機能を有する金属層またはマットとして、シリコン基板上に銀を形成する技術が、引用文献2(【0001】、【0030】、【0043】、【0058】)に記載されている。
ここで、引用発明において、上記技術を採用して、蒸着する金属として、銅に代えて、銀を採用しうるか否かについて、検討する。
引用文献1には、「本発明者らは、銀イオンを使用する対応プロセスと比較して、比較的少量の銅イオンでエッチングを行ってよいことを見出した」(上記4(1)ア(オ)参照。)と記載されており、この記載は、引用発明のエッチング方法において、従来使用されていた銀よりも銅が優れた材料であることを意味するものであって、この記載からすると、優れた材料である銅に代えて、それよりも優れているとはいえない銀を敢えて採用する理由はないといえる。
そうすると、引用発明において、蒸着する金属として、銅に代えて、銀を採用することは、当業者にとって容易であるといえないから、引用発明において、上記アの相違点に係る本願発明1の発明特定事項を得ることは、当業者であっても、引用文献1または2の記載事項から、容易になし得るものではない。
また、引用文献3には、上記アの相違点に係る本願発明1の発明特定事項に関することは記載も示唆もされていない。
よって、他の相違点について検討するまでもなく、本願発明1は、当業者であっても、引用発明1および引用文献2、3に記載された事項に基づいて容易に発明できたものとはいえない。

(2)本願発明2?9について
本願発明2?9は、本願発明1の構成を全て含むものであって、少なくとも上記アの相違点において引用発明と相違するものであるから、本願発明1と同様に、上記(1)で検討した理由により、当業者であっても、引用発明1および引用文献2、3に記載された事項に基づいて容易に発明できたものとはいえない。

6 むすび
以上のとおり、本願請求項1?9に係る発明は、引用文献1に記載された発明および引用文献2、3に記載された事項に基づいて、当業者が容易に発明をすることができたものではない。
したがって、原査定の理由によっては、本願を拒絶することはできない。
また、他に本願を拒絶すべき理由を発見しない。
よって、結論のとおり審決する。
