理由 第1 手続の経緯
本件に係る出願(以下,「本願」という。)は,平成24年12月7日(パリ条約による優先権主張2011年12月8日,韓国,2012年6月25日,韓国)の出願であって,平成26年1月21日付けで拒絶理由が通知され,同年6月27日に意見書及び手続補正書が提出されたが,同年10月21日付けで拒絶査定がなされたところ,平成27年2月26日に本件拒絶査定不服審判が請求されると同時に手続補正書が提出されたものである。


第2 補正却下の決定
〔補正却下の決定の結論〕
平成27年2月26日提出の手続補正書による手続補正を却下する。

〔理由〕
1 補正の内容
(1)請求項1に係る補正
平成27年2月26日提出の手続補正書による手続補正(以下「本件補正」という。)は,平成26年6月27日提出の手続補正書による手続補正後(以下「本件補正前」という。)の特許請求の範囲について補正しようとするものであって,そのうち請求項1に係る補正(以下,「請求項1に係る本件補正」という。)は次のとおりである。(下線は補正箇所を示す。)

ア 本件補正前の請求項1
「上側に突出した第1構造化パターンを有する上部光学シートと,
前記上部光学シートの下方に積層形態で設けられ,前記上部光学シート側に突出した第2構造化パターンを有する下部光学シートと,
前記上部光学シートと前記下部光学シートの間に設けられた接着層と
を含み,
前記第2構造化パターンは,
上方に行くほど横断面積が小さくなる光伝達部と,前記光伝達部の上部に連設されて前記接着層に少なくとも一部が埋められる埋め部とを有し,
前記埋め部が前記接着層と接する断面の面積は,前記光伝達部が連続的な勾配で上方に延長して形成する仮想断面軌跡の面積より大きく形成されており,
前記埋め部は,前記光伝達部から上方へ上向傾斜して延びる一対の延長面を有し,前記延長面の上端部が互いに接することを特徴とする多層光学シートモジュール。」

イ 本件補正後の請求項1
「上側に突出した第1構造化パターンを有する上部光学シートと,
前記上部光学シートの下方に積層形態で設けられ,前記上部光学シート側に突出した第2構造化パターンを有する下部光学シートと,
前記上部光学シートと前記下部光学シートの間に設けられた接着層と
を含み,
前記第2構造化パターンは,
上方に行くほど横断面積が小さくなる光伝達部と,前記光伝達部の上部に連設されて前記接着層に少なくとも一部が埋められる埋め部とを有し,
前記埋め部が前記接着層と接する断面の面積は,前記光伝達部が連続的な勾配で上方に延長して形成する仮想断面軌跡の面積より大きく形成されており,
前記埋め部は,前記光伝達部から上方へ上向傾斜して延びると共に断面軌跡が直線である一対の延長面を有し,前記延長面の上端部が互いに接して三角形の断面軌跡を形成することを特徴とする多層光学シートモジュール。」

(2)補正事項
請求項1に係る本件補正は,本件補正前の請求項1に係る発明の発明特定事項である「一対の延長面」について,「断面軌跡が直線である」との特定を付加するとともに,それらの上端部が「三角形の断面軌跡を形成する」との特定を付加するものである。

2 新規事項の追加の有無について
請求項1に係る本件補正により付加される,一対の延長面の断面軌跡が直線であり,それらの上端部が三角形の断面軌跡を形成する点は,願書に最初に添付した(以下,「出願当初の」という。)明細書の【0065】や図3ないし図9等に記載されているから,請求項1に係る本件補正は,出願当初の明細書,特許請求の範囲または図面に記載された事項の範囲内においてなされた補正である。
よって,請求項1に係る本件補正は,特許法17条の2第3項の規定に適合する。

3 補正の目的について
請求項1に係る本件補正は,本件補正前の請求項1に係る発明の発明特定事項である「一対の延長面」について,本件補正前にはその断面軌跡の形状は任意であり,かつ,一対の延長面の各上端部が接すること以外は上端部の断面軌跡の形状については任意であったものを,「断面軌跡が直線である」こと,かつ,一対の延長面の各上端部が「三角形の断面軌跡を形成する」ような形状に限定するものであって,本件補正の前後で当該請求項1に係る発明の産業上の利用分野及び解決しようとする課題は同一であると認められるから,特許法17条の2第5項2号に掲げる特許請求の範囲の減縮を目的とするものに該当する。
したがって,補正後の請求項1に係る本件補正は,特許法17条の2第5項の規定に適合する。

4 独立特許要件について
補正後の請求項1についての本件補正は,特許法17条の2第5項2号に掲げる特許請求の範囲の減縮を目的とする補正事項を含んでいるから,本件補正後の請求項1に係る発明(以下,「本願補正発明」という。)が,特許法17条の2第6項において準用する同法126条7項の規定に適合するのか否か(特許出願の際独立して特許を受けることができるものであるのか否か)について検討する。

(1)本願補正発明
本願補正発明は,本件補正後の特許請求の範囲の請求項1に記載されたとおりのもの(前記1(1)イにて示したとおりのもの)と認める。

(2)引用例
国際公開2011/130151号(以下,「引用文献」という。)は,原査定の拒絶の理由において「引用文献1」として引用された,本願の優先権主張の日(以下,「本願優先日」という。)より前に頒布された刊行物である。

The present invention generally relates to light directing films and displays that incorporate such light directing films. In particular, the invention relates to a light directing film that has a plurality of unitary discrete structures for directing and/or recycling light. The light directing film can bond to a surface, such as a major surface of an optical film or glass, via an optical adhesive layer, where the unitary discrete structures partially penetrate into the optical adhesive layer with no or very little loss in optical properties, such as optical gain or effective optical transmission.
FIG. 1 is a schematic side-view of a light directing film 100 that includes a first structured major surface 110 and an opposing second major surface 120. First structured major surface 110 includes a plurality of unitary discrete structures 150. (カ) 「FIG. 20 is a schematic side-view of an optical stack 2000 that includes an optical film 2090 that is disposed on a light directing film 2010, where light directing film 2010 can be any light directing film disclosed herein. Light directing film 2010 includes a first structured major surface 2020 and an opposing second major surface 2025. First structured major surface 2020 includes a plurality of unitary discrete structures 2030 that are disposed on a substrate 2005. Each of at least some unitary discrete structures include a light directing portion 2040 primarily for directing light and a bonding portion 2050 primarily for bonding the light directing film to optical film 2090. In some cases, such as in the case of the exemplary optical stack 2000, at least portions of at least some bonding portions 2050 of light directing film 2010 penetrate into optical film 2090 and at least portions of at least some light directing portions 2040 of light directing film 2010 do not penetrate into optical film 2090. In such cases, optical stack 2000 includes a plurality of unfilled voids 2015 between light directing film 2010 and optical film 2090, where the unfilled voids can contain air and/or a gas. In some cases, each of at least some of the plurality of unfilled voids 2015 substantially covers a region that is defined by optical film 2090 and portions of two or more adjacent unitary discrete structures 2030 that do not penetrate into the optical film and immediately surround the region. For example, in such cases, an unfilled void covers at least 50%, or at least 60%, or at least 70%>, or at least 80%), or at least 90%>, of a region that is defined by optical film 2090 and portions of two or more adjacent unitary discrete structures 2030 that do not penetrate into the optical film. For example, in the case of linear unitary discrete structures 2030, unfilled void 2015 substantially covers the region that is defined on the top by optical film 2090, on the right side by portion 2021 of linear unitary discrete structure 203 OA that has not penetrated into the optical film, and on the left side by portion 2022 of linear unitary discrete structure 2030B that has not penetrated into the optical film.
Optical film 2090 includes an optical layer 2070 that is disposed on an optical adhesive layer 2060. The portions of bonding portions 2050 of light directing film 2010 that penetrate into the optical film penetrate into the optical adhesive layer. Optical adhesive layer 2060 attaches or bonds light directing film 2010 to optical layer 2070 or major surface 2071 of optical layer 2070 while substantially maintaining an air environment or surrounding for light directing portions 2040. In some cases, bonding portions 2050 have high aspect ratios which can result in strong bonding between optical film 2090 and light directing film 2010.
Bonding portions 2050 that penetrate into optical adhesive layer have an average maximum height h_(2,avg) which is the average of the maximum heights h_(2) of the individual bonding portions that have penetrated into the optical adhesive layer. In some cases, h_(2, avg) is greater than the average thickness h_(3) of optical adhesive layer 2060. For example, in such cases, h_(2,avg) is greater than h_(3) by at least 0.2 microns, or at least 0.3 microns, or at least 0.4 microns, or at least 0.5 microns, or at least 0.7 microns, or at least 1 micron, or at least 1.2 microns, or at least 1.5 microns, or at least 1.7 microns, or at least 2 microns.
In general, optical film 2090 can include any optical layer 2070 that may be desirable in an applications. For example, in some cases, optical layer 2070 can be or include an absorbing polarizer. As another example, in some cases, optical film 2090 or optical layer 2070 can include a reflective polarizer.・・・(中略)・・・
As yet another example, in some cases, optical layer 2070 can be or include a second light directing film that includes a plurality of linear prismatic structures. For example, FIG. 21 is a schematic three dimensional view of a light directing film 2100 that includes a plurality of linear prismatic structures 2110 that are disposed on a substrate 2120 and extend linearly along the y-direction. In some cases, optical layer 2070 can be or include light directing film 2100. In such cases, unitary discrete structures 2030 of light directing film 2010 can also be linear structures that extend in a direction that is perpendicular to the linear direction of linear prismatic structures 2110. In some cases, substrate 2120 can be similar to optical layer 2070 and may include any optical layer and provide any function that may be desirable in an application.

Bonding portions 2050 allow for secure attachment of light directing film 2010 to optical film 2090 or surface 2071 with no or very little loss in optical properties, such as brightness. In particular, the bonding portions have sufficiently large aspect ratios to provide sufficient exterior surface to enhance adhesion between the light directing film and the optical film. The bonding portions are also sufficiently narrow relative to the width of the light directing portions so that there is no or very little loss in the effective transmission of the light directing film and/or the optical stack. As used herein, effective transmission (ET), or optical gain, is the ratio of the luminance of an optical system, such as a display system, with the film in place in the optical system to the luminance of the optical system without the film in place.
Unitary discrete structures 2030 can have any index of refraction that may be desirable in an application. For example, in some cases, the index of refraction of the unitary discrete structures is in a range from about 1.4 to about 1.8, or from about 1.5 to about 1.8, or from about 1.5 to about 1.7. In some cases, the index of refraction of the unitary discrete structures is not less than about 1.5, or not less than about 1.55, or not less than about 1.6, or not less than about 1.65, or not less than about 1.7.
In general, the peel strength of light redirecting film 2010 and optical adhesive layer 2060, surface 2071, or optical film 2090 is sufficiently large to provide secure adhesion between light directing film 2010 and optical film 2090 so that optical stack 2000 can be handled as a single film or unit without bonding portions 2050 delaminating or separating from optical film 2090. In some cases, the peel strength of light redirecting film 2010 and optical adhesive layer 2060 is greater than about 20 grams/inch, or about 25 grams/inch, or about 30 grams/inch, or about 35 grams/inch, or about 40 grams/inch, or about 45 grams/inch, or about 50 grams/inch, or about 60 grams/inch, or about 70 grams/inch, or about 80 grams/inch, or about 90 grams/inch, or about 100 grams/inch, or about 110 grams/inch, or about 120 grams/inch, or about 130 grams/inch, or about 140 grams/inch, or about 150 grams/inch.
Bonding portions 2050 are designed primarily to provide sufficient adhesion between light directing film 2010 and optical film 2090 by sufficiently penetrating into the optical film. While providing sufficient adhesion between the two films, the bonding portions are sufficiently narrow so as to have no, or very little, effect on the effective transmission of light directing film 2010 or optical stack 2000.」(明細書20ページ27行ないし25ページ14行)

引用文献の前記ア(ア)ないし(キ)の記載から,図21に示される「導光フィルム2100」(「導光フィルム2010」との混乱を避けるため,便宜上,「第2導光フィルム2100」という。)を「光学層2070」として用いた,図20に示される「光学積層体2000」に関する発明を把握することができるところ,引用文献の図20(前記ア(キ)を参照。)から,導光部分2040の断面形状が,同じ長さを有する二辺を斜辺とする二等辺三角形から頂角を含む上部の一部を切除した略台形の形状を有していること,及び,接着部分2050の断面形状が,前記導光部分2040の切除した部分に接続され,2つの側面が上面と直交し,前記上面が第2主面と平行な略長方形であることを看取でき,かつ,図20及び図21(前記ア(キ)を参照。)から,「導光フィルム2010」の「単位個別構造2030」の基材2005からの突出方向,及び,「第2導光フィルム2100」の「複数の線形プリズム構造2110」の基材2120からの突出方向が同じ方向(+Z方向)であることを看取できるから,「単位個別構造2030」及び「複数の線形プリズム構造2110」の突出方向(+Z方向)を「上方向」と表現すると,当該「光学積層体2000」に関する発明の構成は次のとおりである。

本願補正発明と引用発明とを対比する。
ア 引用発明の「複数の線形プリズム構造2110」,「第2導光フィルム2100」,「複数の単位個別構造2030」,「導光フィルム2010」,「光学接着層2060」,「導光部分2040」,「接着部分2050」及び「光学積層体2000」は,本願補正発明の「第1構造化パターン」,「上部光学シート」,「第2構造化パターン」,「下部光学シート」,「接着層」,「光伝達部」,「埋め部」及び「多層光学シートモジュール」にそれぞれ相当する。

イ 引用発明の「第2導光フィルム2100」(本願補正発明の上部光学シートに相当。以下,引用発明の構成に付したカッコ書き内の文言は,対応する本願補正発明の発明特定事項を示す。)は,基材2120上に配置され,一方向に沿って線形に延在する「複数の線形プリズム構造2110」(第1構造化パターン)を有するものであり,当該「複数の線形プリズム構造2110」の基材2005からの突出方向は上方向であるから,引用発明の「第2導光フィルム2100」と本願補正発明の「上部光学シート」は,「上側に突出した第1構造化パターンを有する」点で一致する。

ウ 引用発明は,「導光フィルム2010」(下部光学シート)上に配置された光学フィルム2090を含む光学積層体2000であって,前記光学フィルム2090は,「光学接着層2060」(接着層)と,当該光学接着層2060上に配置される光学層2070を含み,前記光学層2070は「第2導光フィルム2100」(上部光学シート)であり,前記「導光フィルム2010」の第1主面2020に設けられた「複数の単位個別構造2030」(第2構造化パターン)の突出方向は上方向,すなわち,「第2導光フィルム2100」側の方向であるから,引用発明の「導光フィルム2010」と本願補正発明の「下部光学シート」は,「上部光学シートの下方に積層形態で設けられ,上部光学シート側に突出した第2構造化パターンを有する」点で一致し,引用発明の「光学接着層2060」と本願補正発明の「接着層」は,「上部光学シートと前記下部光学シートの間に設けられた」点で一致する。

エ 引用発明の「導光部分2040」(光伝達部)は,その断面形状が,同じ長さを有する二辺を斜辺とする二等辺三角形から頂角を含む上部の一部を切除した略台形の形状であるから,「上方に行くほど横断面積が小さくなる」ものであるといえる。
また,引用発明の「接着部分2050」(埋め部)は,前記「導光部分2040」の前記切除した部分に接続され,その一部分が,「光学接着層2060」(接着層)に侵入しているから,「光伝達部の上部に連設されて接着層に少なくとも一部が埋められる」ものであるといえる。
したがって,引用発明の「複数の単位個別構造2030」と本願補正発明の「第2構造化パターン」は,「上方に行くほど横断面積が小さくなる光伝達部と,前記光伝達部の上部に連設されて前記接着層に少なくとも一部が埋められる埋め部とを有」する点で一致する。

オ 引用発明の「接着部分2050」(埋め部)の断面形状は,2つの側面が上面と直交し,前記上面が第2主面と平行な略長方形の形状を有しているところ,当該「2つの側面」が,本願補正発明の「断面軌跡が直線である一対の延長面」に相当する。
そして,引用発明において,「導光部分2040」(光伝達部)の断面形状は,同じ長さを有する二辺を斜辺とする二等辺三角形から頂角を含む上部の一部を切除した略台形の形状であるから,当該「導光部分2040」の2つの側面と第2主面2025がなす角度は鋭角(引用文献の前記ア(エ)の記載によれば,約30度?約60度)であると認められるところ,前記「接着部分2050」の「2つの側面」と第2主面2025がなす角度は90°であるから,「接着部分2050」の「2つの側面」は,「導光部分2040」から上方向へ傾斜(導光部分2040に対して約30度?60度)して延びているといえる。
したがって,引用発明の「接着部分2050」と本願補正発明の「埋め部」は,「光伝達部から上方へ上向傾斜して延びると共に断面軌跡が直線である一対の延長面を有」する点で一致する。
なお,本願補正発明の「一対の延長面」についての規定である「上向傾斜」なる文言が,「光伝達部」に対して上方向へ傾斜していることを指しているのでなく,「上方向」に対して傾斜していること(すなわち,平行でないこと)を指していると解する余地があるところ,当該解釈を前提とした場合,引用発明の「2つの側面」(一対の延長面)が,上方向に対して,「傾斜」しているのでなく,「平行」である点で,本願補正発明と相違しているということになるが,当該相違点に係る本願補正発明の発明特定事項は,後述する(5)で述べる構成の変更を行った引用発明が具備することとなる構成であるから,結論に変わりはない。

カ 前記アないしオから,本願補正発明と引用発明とは,
「上側に突出した第1構造化パターンを有する上部光学シートと,
前記上部光学シートの下方に積層形態で設けられ,前記上部光学シート側に突出した第2構造化パターンを有する下部光学シートと,
前記上部光学シートと前記下部光学シートの間に設けられた接着層と
を含み,
前記第2構造化パターンは,
上方に行くほど横断面積が小さくなる光伝達部と,前記光伝達部の上部に連設されて前記接着層に少なくとも一部が埋められる埋め部とを有し,
前記埋め部は,前記光伝達部から上方へ上向傾斜して延びると共に断面軌跡が直線である一対の延長面を有する,
多層光学シートモジュール。」
である点で一致し,次の点で相違する。

相違点1:
本願補正発明では,「埋め部」における「接着層」と接する断面の面積が,「光伝達部」が連続的な勾配で上方に延長して形成する仮想断面軌跡の面積より大きいのに対して,
引用発明では,「接着部分2050」における「光学接着層2060」と接する断面の面積と,「導光部分2040」が連続的な勾配で上方に延長して形成する仮想断面軌跡の面積との大小関係は,特定されていない点。

相違点2:
本願補正発明の「埋め部」は,その「延長面」の上端部が互いに接して三角形の断面軌跡を形成しているのに対して,
引用発明の「接着部分2050」は,その「2つの側面」の上端部が第2主面2025と平行な上面に接続されて,略長方形の断面軌跡を形成している点。

(4)相違点1の容易想到性
引用文献の図20には,「接着部分2050」における「光学接着層2060」と接する断面の面積が,「導光部分2040」の2つの側面を延長した仮想線により形成される部分の面積よりも大きいように描かれているところ,当該「導光部分2040」の2つの側面を延長した仮想線により形成される部分の面積は,本願補正発明の「光伝達部が連続的な勾配で上方に延長して形成する仮想断面軌跡の面積」に他ならないから,当該図20に示されたものでは,「接着部分2050」における「光学接着層2060」と接する断面の面積が,「導光部分2040」の2つの側面を「連続的な勾配で上方に延長して形成する仮想断面軌跡」の面積よりも大きいと解される。
また,引用文献の明細書24ページ15ないし21行の記載(前記(2)ア(カ)を参照。)によれば,引用発明において,「接着部分2050」は,「導光フィルム2010を光学フィルム2090又は表面2071にしっかりと取り付ける」ために設けられたものであり,「導光フィルムと光学フィルムとの間の接着を強化するのに十分な外面を提供するために,十分に大きな縦横比を有する」ように配慮されるものである。
そうすると,引用発明において,導光フィルム2010と第2導光フィルム2100とを十分に強力に接着するために,「接着部分2050」の縦横比,「接着部分2050」の「光学接着層2060」への侵入深さ等を調整して,引用文献の図20に示されたもの以上の接着面積となるように構成すること(すなわち,引用発明を,相違点1に係る本願補正発明の発明特定事項に相当する構成を具備したものとすること)は,当業者が適宜なし得た設計上の事項にすぎない。

(5)相違点2の容易想到性
引用文献の明細書12ページ4ないし9行には,引用発明の「導光部分2040」の2つの側面に対応する「第1側面162C,162D」が,引用発明の「第2主面2025」と平行な面に対応する「導光フィルムの平面105」となす角度が,約30°?約60°の範囲であることが記載され(前記(2)ア(エ)を参照。),
引用文献の明細書17ページ1ないし5行には,引用発明の「接着部分2050」の「2つの側面」に対応する「接着部分の各側面372A,372B」が,引用発明の「第2主面2025」と平行な面に対応する「xy平面」となす角度が,約60°を越えることが記載され(前記(2)ア(オ)を参照。),
引用文献の明細書12ページ28ないし末行には,引用発明の「接着部分2050」に対応する「接着部分170」の形状の例として,プリズムが記載されている(前記(2)ア(オ)を参照。)。
引用文献のこれらの記載から,引用発明の「接着部分2050」の形状を,その「2つの側面」が「第2主面2025」となす角度が,「導光部分2040」の2つの側面が「第2主面2025」となす角度よりも大きくなるようなプリズム形状(当然,「接着部分2050」の「2つの側面」の上端部が互いに接して三角形の断面軌跡を形成することとなる。)とすることは,当業者が容易になし得たことである。

(6)効果について
本件補正後の明細書の発明の詳細な説明において本願補正発明が有するとされた効果(発明の詳細な説明の【0045】ないし【0048】を参照。)は,本願補正発明の進歩性の有無の判断を左右するほどの格別のものではない。

(7)独立特許要件についてのまとめ
以上のとおりであって,本願補正発明は,引用発明に基づいて当業者が容易に発明をすることができたものであるから,特許法29条2項の規定により特許出願の際独立して特許を受けることができないものである。
したがって,本件補正は,特許法17条の2第6項において準用する同法126条7項の規定に違反するので,同法159条1項において読み替えて準用する同法53条1項の規定により却下すべきものである。


第3 本願の請求項1に係る発明について
1 本願の請求項1に係る発明
本件補正は前記のとおり却下されたので,本件の請求項1ないし18に係る発明は本件補正前の特許請求の範囲の請求項1ないし18に記載されたとおりのものであるところ,請求項1に係る発明(以下,「本願発明」という。)は,前記第2〔理由〕1(1)アに本件補正前の請求項1として示したとおりのものである。

2 原査定の拒絶の理由の概要
本願発明に対する原査定の拒絶の理由は,概略,本願発明は,引用文献に記載された発明であるから,特許法29条1項3号に該当し,特許を受けることができない,及び,本願発明は,引用文献に記載された発明に基づいて,本願優先日より前に当業者が容易に発明をすることができたものであるから,同法29条2項の規定により特許を受けることができない,というものである。

3 判断
(1)引用例
原査定の拒絶の理由に引用された引用文献の記載及び引用発明については,前記第2〔理由〕4(2)ア及びイのとおりである。

(2)対比・判断
本願補正発明は,上記第2〔理由〕3のとおり,本願発明の発明特定事項を限定したものである。
そうすると,本願発明の発明特定事項をすべて含み,さらに限定を付加したものに相当する本願補正発明が,上記第2〔理由〕4(7)に記載したとおり,引用発明に基づいて当業者が容易に発明をすることができたものであるから,本願発明も同様の理由により,引用発明に基づいて当業者が容易に発明をすることができたものである。

4 むすび
以上のとおり,本願発明は,引用発明に基づいて当業者が容易に発明をすることができたものであるから,他の請求項に係る発明について検討するまでもなく,本願は特許法29条2項の規定により特許を受けることができない。
よって,結論のとおり審決する。
