事件の表示 特願2010-513257号「補強された医療機器を形成する、複数壁の寸法回復可能なチューブ」拒絶査定不服審判事件〔平成20年12月24日国際公開、WO2008/156841、平成22年 9月 9日国内公表、特表2010-530278号〕について、次のとおり審決する。 
結論 本件審判の請求は、成り立たない。 
理由 I.手続の経緯
本願は、平成20年6月19日(パリ条約による優先権主張 2007年6月19日 米国)を国際出願日とする出願であって、平成25年11月21日付けの拒絶理由通知に対し、平成26年5月26日付けで手続補正がされたが、同年10月16日付けで拒絶査定がされ、その後、平成27年2月20日付けで拒絶査定不服審判の請求がされたものである。


II.本願発明
本願の請求項1?11に係る発明は、平成26年5月26日付け手続補正書により補正された特許請求の範囲の請求項1?11に記載された事項によって特定されるとおりのものであるところ、その請求項10に係る発明(以下「本願発明」という。)は次のとおりのものである。
「【請求項10】
チューブ状の外側層であり、架橋して寸法が回復したポリマーである少なくとも1つの第1層;
当該第1層の隣に内側層として配置された少なくとも1つの非架橋ポリマーである第2層;および
当該第2層の内側に組み込まれた補強構造体;
を有する複数層機器
を有して成る補強された医療機器。」


III.引用例の記載事項

原査定の拒絶の理由に引用され、本願優先権主張日前に電気通信回線を通じて公衆に利用可能となった発明が記載された文献である国際公開第2006/094135号(以下「引用例1」という。)には、次の事項が図面とともに記載されている(付記した邦訳は、対応する日本語公報である特表2008-531213号公報の記載を援用した。)。
1a:「[0001] Technical Field. This invention relates to the field of medical devices and, more particularly, to sheaths and catheters for use in introducing interventional devices and/or medicaments into the vascular system of a patient.」

1c:「[0026] Polymeric intermediate layer 35, 55, 75 comprises a polymer that is positioned over and in contact with inner liner 31, 51, 71 and reinforcement 34,54. The filaments of braid 34 in the embodiments of Figs. 2 and 5, and the wire turns of coil 54 in the embodiments of Figs. 4 and 5, are preferably spaced a sufficient distance from each other such that when the intermediate polymeric layer 35, 55, 75 is melted as described hereinafter, it flows between the braid filaments and/or the wire turns to bond to the roughened outer surface of the inner liner. In a preferred embodiment, polymeric intermediate layer 35, 55, 75 comprises a nylon (polyamide) or polyurethane, although other conventional medical grade materials known to be suitable for such use, such as PEBA and PET, may be substituted.
[0027] Outer layer 38, 58, 78 is formed of a heat shrinkable material that is capable of forming a secure bond with polymeric intermediate layer 35, 55, 75. The heat shrinkable material of the outer layer typically has a higher melting point than that of the material of the intermediate layer. In this manner, upon exposure to a controlled amount of heat, the intermediate layer melts and flows between the interstices of the braid and is fused to the roughened outer surface of the inner liner. The outer layer compresses the intermediate layer and the inner liner in well-known manner when heat shrink operations are utilized. Those skilled in the art will appreciate that the outer layer and the polymeric intermediate layer may be formed from a variety of medical grade materials suitable for such purposes, so long as the layers are capable of being fused or otherwise bonded or securely attached to each other upon the application of heat, as described. Unlike many prior art sheaths, the heat shrinkable outer layer is not skived off from the remainder of the sheath following the heat shrink, but rather, remains an integral part of the sheath.

[0029] Typically, the outer layer comprises a thermoplastic material that is subjected to at least partial cross-linking. When a thermoplastic material is cross- linked, chemical links are established between the molecular chains of the polymer, thereby resulting in a change of properties in the cross-linked material when compared to the non-cross-linked material. In general, when a thermoplastic material is cross-linked, the properties of the cross-linked material cause it to behave more in the nature of a thermoset material. Thus, the resulting thermoset- like material may have higher dimensional stability (hoop strength), higher tensile strength, higher stiffness and density, higher melting temperature, improved heat memory, improved chemical resistance, and improved physical strength, among other properties, when compared to the non-cross-linked thermoplastic. Similarly, some properties, such as elongation and the ability to flex, are generally lower in the cross-linked material when compared to the non-cross-linked material. Thus, for example, when the cross-linked material is a block copolymer such as PEBA, the properties of the resulting cross-linked material will generally differ from those of the original block copolymer in the manner described above.」

1d:「[0035] In most cases, it is expected that a highly cross-linked copolymer will be desirable for use as an outer jacket in an introducer sheath. A highly cross- linked outer layer has a high hoop strength (dimensional stability), a high hardness level, and an enhanced ability to shrink upon exposure to heat. As a result, the cross-linked heat shrink layer is very effective in compressing the intermediate layer onto the reinforcing layer and the inner liner. The degree of cross-linking may optimally be established by routine experimentation such that it is not so high that it results in a brittle outer layer, nor so low that it does not achieve the desired thermoset-like properties. Those skilled in the art will appreciate that the degree of cross-linking can be varied as desired, to achieve these desired properties, or others, for a particular sheath.

[0038] Although the sheath has been described herein as including a discrete inner liner, the sheath need not necessarily have a liner. Although such liners are often beneficial for a particular use of the sheath, this will not always be the case. In some instances, the layer in which the reinforcement is disposed may contain sufficient lubricity and hoop strength for the intended purpose of the sheath that the inner liner may be omitted. In other instances, the expected use of the sheath does not mandate the specific properties provided by the inner liner. When the inner liner is omitted, the layer referred to hereinabove as the "intermediate" layer will more properly be referred to as the inner layer, and the copolymer will continue to be referred to as the "outer" layer.」

1e:「[0040] Preparation of the introducer sheaths of the present invention may be commenced in a manner similar to the preparation of the sheaths of the '304 patent. However, instead of enveloping the assembly (i.e., the inner liner, reinforcement and nylon layer) in a non-bonding heat shrink material as in the conventional process, the assembly in the inventive method is placed within a heat shrink material that is capable of bonding with the thermoplastic nylon layer via secondary molecular forces. Ideally, the intermediate layer will melt flow somewhere between the shrink temperature and the degradation temperature of the outer cross-linked layer. However, the intermediate layer may melt flow but not degradate at a temperature that is lower than the shrink temperature of the outer layer. Typically, the outer layer comprises a cross-linked block copolymer. Most preferably, the outer layer comprises cross-linked PEBA, as described herein.
[0041] The particular hoop strength of the resulting introducer sheath depends on several variables, such as the wall thickness and the Shore hardness of the sheath, as well as the degree of cross-linking of the material. Hoop strength may also depend on the diameter at which the shrink tube has recovered. Hoop strength tends to be weaker at maximum expansion and at the recovered diameter. It is typically highest at about half way to recovery. Those skilled in the art will appreciate that careful selection and control of these variables allows one to prepare a sheath having a desired hoop strength.」

an inner liner having a passageway extending longitudinally therethrough;
a reinforcing member disposed radially outwardly from said liner;
an intermediate layer positioned longitudinally over said reinforcing member and inner liner, said intermediate layer connected to an outer circumferential surface of the inner liner between spacings of the reinforcing member; and
an outer layer positioned longitudinally over said intermediate layer, said outer layer comprising a polymer, wherein at least a portion of said polymer is cross-linked, and wherein said outer layer is bonded to an outer surface of said intermediate layer.

A method for forming an introducer sheath, comprising: providing an assembly comprising an inner liner, a reinforcement disposed over said inner liner, and a polymeric intermediate layer disposed over said inner liner; positioning the assembly within a heat shrinkable material, said heat shrinkable material comprising a polymeric material capable of bonding with the polymeric intermediate layer; and heating the heat shrinkable material and the assembly positioned therein to a temperature sufficient to shrink the heat shrinkable material, and to melt the polymeric intermediate layer in a manner such that an outer surface of the melted polymeric intermediate material bonds to the heat shrinkable material and an inner surface of the melted polymeric intermediate layer bonds to the inner liner.
12. The method of claim 11, wherein said heat shrinkable material comprises a cross-linked copolymer having active functional groups, said active functional groups capable of bonding with active functional groups of said intermediate layer.

挿入器シースを形成するための方法において、

続いて、図面を参照しつつ上記の各記載について検討する。
A)摘記事項1dの「シースを、別個の内側ライナーを含んでいるものとして説明してきたが、シースは、必ずしもライナーを有している必要はない。」、摘記事項1fの【請求項1】の各記載を併せみれば、引用例1には、「挿入器シース」として、“補強部材と、前記補強部材を覆って長手方向に配置されている中間層と、前記中間層を覆って長手方向に配置されている外側層であって、前記外側層はポリマーを含んでおり、前記ポリマーの少なくとも一部分は架橋結合されており、前記外側層は前記中間層の外側表面に接合されている、外側層と、を備えている挿入器シース”が実質的に記載されている。

B)摘記事項1dの「多くの場合、高度に架橋結合されたコポリマーは、挿入器シースの外側被覆材として使用するのに望ましいと期待されている。高度に架橋結合された外側層は、フープ強度(寸法の安定性)が高く、硬さレベルが高く、熱に曝されると収縮する能力が高い。」、摘記事項1eの「でき上がった挿入器シースの具体的なフープ強度は、壁の厚さとシースのショア硬さ、並びに材料の架橋結合の程度の様な幾つかの変数で変わる。フープ強度は、収縮管が回復した直径にもよる。」の各記載によれば、上記A)の「外側層」は、「収縮管」であって、該「収縮管」は、「でき上がった挿入器シース」においては、「回復した直径」を有することが分かる。

C)摘記事項1cの「ポリマー中間層35、55、75・・・」の記載から、上記A)の「中間層」は、ポリマー中間層であるといえる。

D)摘記事項1cの「中間ポリマー層35、55、75が、後に述べる様に溶融した際に、ブレードのフィラメント及び/又はワイヤーの巻きの間を流れて、内側ライナーの粗い外側表面に接合する」、摘記事項1dの「補強材が配置される層」、摘記事項1fの「【請求項17】・・・補強材は、前記溶融した中間層内に少なくとも部分的には埋め込まれている」の各記載及びFIG.2?5の図示内容からみて、上記A)の「補強部材」は、中間層内に少なくとも部分的に埋め込まれた補強部材といえる。

よって、以上の記載事項及び図面の図示内容を総合すると、引用例1には、次の発明(以下「引用発明1」という。)が記載されている。
「補強部材と、
前記補強部材を覆って長手方向に配置されている中間層と、
前記中間層を覆って長手方向に配置されている外側層であって、前記外側層はポリマーを含んでおり、前記ポリマーの少なくとも一部分は架橋結合されており、前記外側層は前記中間層の外側表面に接合されている、外側層と、
を備えている挿入器シースであって、
前記外側層は、収縮管であって、回復した直径を有し、
前記中間層は、ポリマー中間層であり、
前記補強部材は、中間層内に少なくとも部分的に埋め込まれた補強部材である、
挿入器シース。」

3. placing an expanded plastic sleeve having an irradiated-crosslinked outer surface and an uncrosslinked inner surface over said one end of said tubing;
4. applying heat to said tubing and said sleeve to cause said tubing to shrink into contact with said mandrel and to cause said sleeve to shrink into contact with said one end of said tubing, said heat being effective to melt said uncrosslinked inner surface to create a bond between said sleeve and said one end; and
5. removing said assembly from said mandrel.」

2d:上記摘記事項2cの記載及びFig.12を参照すれば、摘記事項2cの「外面」、「内面」がそれぞれ、「外側層23」、「内側層24」に対応するものといえる。

よって、以上の記載を総合すると、引用例2には、次の発明(以下「引用発明2」という。)が記載されている。
「以下の工程からなる製造方法により製造された、プラスチックカテーテルハブアセンブリ。
1)カテーテル形成部とハブ形成部を有するマンドレルを準備する工程、
2)放射線架橋された1本の膨張プラスチックチューブが前記マンドレル上に配置される工程であって、前記チューブの一端は前記ハブ形成部を覆い、前記チューブの他の部分は前記カテーテル形成部を覆うように配置される工程、
3)放射線架橋された外側層と非架橋の内側層とを有する膨張プラスチックスリーブが、前記チューブの前記一端を覆うように配置される工程、
4)前記チューブと前記スリーブが加熱され、この加熱により、前記チューブは収縮してマンドレルに接触し、前記スリーブは収縮して前記チューブの前記一端に接触し、前記非架橋の内側層が溶融して前記スリーブと前記チューブの前記一端とを結合する工程、及び
5)前記アセンブリを前記マンドレルから外す工程。」


IV.対比
本願発明と引用発明1を対比する。
(ア)引用発明1の「補強部材」は、文言の意味、形状又は機能等からみて本願発明の「補強構造体」に相当し、同様に、「挿入器シース」は「医療機器」に相当する。
(イ)引用発明1の「外側層」は、「中間層を覆って長手方向に配置されている」ことから、「中間層」の外側に配置される層といえるので、本願発明の「外側層であ」る「少なくとも1つの第1層」に相当する。
また、引用発明1の「外側層」は、「収縮管であ」るから、その形状は、“チューブ状”といえる。
さらに、引用発明1の「外側層」は、「ポリマーを含んでおり、前記ポリマーの少なくとも一部分は架橋結合されており、」「回復した直径を有し」ているのであるから、“架橋して寸法が回復したポリマーである層”といえる。
よって、引用発明1は、「チューブ状の外側層であり、架橋して寸法が回復したポリマーである少なくとも1つの第1層」を有する点で、本願発明と一致する。
(ウ)引用発明1では、「外側層は中間層を覆って長手方向に配置され」、「中間層の外側表面に接合されている」ことから、引用発明1の「中間層」は、「外側層」の内側に、「外側層」と隣接して配置される層といえるので、本願発明の「第1層の隣に内側層として配置された少なくとも1つの」「第2層」に相当する。
よって、引用発明1における「中間層」が「ポリマー中間層であ」ることを踏まえれば、引用発明1は、“第1層の隣に内側層として配置された少なくとも1つのポリマーである第2層”を有する点で、本願発明と共通する。
(エ)本願明細書段落【0036】の「アセンブリを十分に加熱し、外側層103を収縮させ、それによって、内側層105に力を与え、それを溶融させる、あるいは補強構造体107の方へ流れることができる状態にする。補強構造体107の内側層105への組み込みが終わったとき(例えば図4参照)、材料を冷却し一体化させて、補強された機器400を形成する。」の記載及び図4の図示内容からみて、本願発明における「第2層の内側に組み込まれた」とは、“第2層の内部に埋め込まれた”ことをも意味するものと解されるので、引用発明1の「中間層内に少なくとも部分的には埋め込まれた」は、本願発明の「第2層の内側に組み込まれた」に相当する。
そうすると、引用発明1は、「第2層の内側に組み込まれた補強構造体」を有する点で、本願発明と一致する。
また、引用発明1の「挿入機シース」が、「補強部材」を備えることで、機械強度的に補強されていることは明らかであるから、引用発明1は、「補強された医療機器」である点でも本願発明と一致する。
(オ)引用発明1は、「補強部材」、「中間層」、「外側層」の3つの部材を備えているところ、この3つの部材は、全体として複数の層を含む壁状部材を成すものである。
そして、この「複数の層を含む壁状部材」は、“複数層機器”といい得るものであるから、引用発明1は、「第1層;」「第2層;および」「補強構造体;を有する複数層機器を有して成る補強された医療機器」である点で、本願発明と一致する。

以上の(ア)?(オ)によれば、本願発明と引用発明1との一致点及び相違点は次のとおりである。
(一致点)
チューブ状の外側層であり、架橋して寸法が回復したポリマーである少なくとも1つの第1層;
当該第1層の隣に内側層として配置された少なくとも1つのポリマーである第2層;および
当該第2層の内側に組み込まれた補強構造体;
を有する複数層機器
を有して成る補強された医療機器。

(相違点)
第2層のポリマーに関し、本願発明では、ポリマーが「非架橋ポリマー」であるのに対し、引用発明1では、ポリマーが「非架橋ポリマー」であるとまでの特定のない点。


V.判断
(1)引用例1の記載について
引用例1における「熱可塑性材料が架橋結合されるとき、化学結合が、ポリマーの分子鎖の間に確立され、その結果、架橋結合されていない材料と比べて、架橋結合された材料の特性が変化する。一般に、熱可塑性材料が架橋結合されると、架橋結合された材料の特性は、熱可塑性材料を、熱硬化性物質様性質で、より強く挙動させる。」(摘記事項1c)、「高度に架橋結合された外側層は、フープ強度(寸法の安定性)が高く、硬さレベルが高く、熱に曝されると収縮する能力が高い。」(摘記事項1d)等の記載によれば、ポリマーを架橋すると、架橋結合されていない材料と比べて、「熱硬化性物質様性質」となり、また、「熱に曝されると収縮する能力」が高くなることが、理解できる。
他方、引用例1に、「中間層は、外側の架橋結合層の収縮温度と分解温度の間の何処かで溶融して流れるのが理想的である。」(摘記事項1e)と記載されるように、引用発明1の「中間層」には、外側層の収縮温度で「溶融して流れる」特性が求められるものであるところ、加熱時におけるこの「溶融して流れる」特性は、ポリマーを架橋した際に得られる上記の「熱硬化性物質様性質」や「熱に曝されると収縮する能力」とは相反する特性であることは明らかである。
そうすると、引用例1には、「中間層」のポリマーが架橋されていると、「理想的」な特性を得難いことが実質的に示唆されているものといえる。

(2)引用発明2について
引用発明2は、「スリーブが加熱され」、「スリーブは収縮して」、「非架橋の内側層が溶融し」た後、「マンドレルから外」されることにより完成した「アセンブリ」であるから、引用発明2の「プラスチックカテーテルハブアセンブリ」には、「放射線架橋された外側層と非架橋の内側層とを有する膨張プラスチックスリーブ」が収縮した状態で含まれるものといえるところ、この収縮した状態のスリーブは、外側層と内側層という少なくとも2つの層を有することから、“複数層機器”の一種といえるものである。
また、引用発明2の「プラスチックカテーテルハブアセンブリ」が医療機器の一種であることも明らかである。
してみると、引用発明2に接した当業者であれば、医療機器が有する複数層機器の内で、溶融する層は非架橋プラスチック層であるという技術事項を、引用発明2に基づいて把握できるものといえる。

(3)相違点の判断
上記(1)で指摘したように、引用発明1の「中間層」には、加熱時に「溶融して流れる」特性が求められているものである。
そうすると、引用例1における上記(1)の示唆や上記の引用発明2に接した当業者であれば、「中間層」である「第2層」のポリマーに、「溶融して流れる」特性のポリマーとして、「非架橋ポリマー」を採用することは、容易に想到し得たことである。
そして、引用例1における「効率的な方法で製造され、構成要素の材料を無駄にしない挿入器シースを提供する・・・更に、介入処置を行うために脈管系に挿入できるだけの剛性を有し、・・・可撓性と抗よじれ性を有する挿入器シースを提供する」(摘記事項1b)なる記載を特に参照すれば、本願発明の効果も、引用発明1及び引用発明2から当業者が予測し得た程度のものであって格別のものとはいえない。


VI.むすび
以上のとおり、本願発明は、引用発明1及び引用発明2に基づいて当業者が容易に発明をすることができたものであるから、特許法第29条第2項の規定により、特許を受けることができない。
したがって、本願は、他の請求項について検討するまでもなく拒絶すべきものである。
よって、結論のとおり審決する。
