理由 1 手続の経緯
本件拒絶査定不服審判事件に係る出願(外国語書面出願である。以下,「本件出願」という。)は,2007年6月21日(パリ条約による優先権主張外国庁受理2006年6月23日 米国,2007年6月15日 米国)を国際出願日とする特願2009-516712号の一部を平成25年10月11日に新たな特許出願(特願2013-213739号)とし,当該特許出願の一部を平成27年10月9日に新たな特許出願としたものであって,平成27年11月5日に外国語書面の翻訳文が提出されるとともに手続補正書が提出され,平成28年7月20日付けで拒絶理由が通知され,平成29年1月24日に意見書が提出されたが,同年3月13日付けで拒絶査定(以下,「原査定」という。)がなされた。
本件拒絶査定不服審判は,これを不服として,同年7月21日に請求されたものであって,本件審判の請求と同時に手続補正書が提出された。


2 本件出願の請求項1に係る発明
本件出願の請求項1に係る発明は,平成29年7月21日提出の手続補正書による補正(請求項2及び3を削除する補正であって,請求項1自体は補正されていない。)後の請求項1に記載された事項によって特定されるものと認められるところ,請求項1の記載は次のとおりである。

「第1及び第2の光学層の交互層を含む多層光学フィルムであって,
前記第1の光学層は,第1のポリエステルを含み,前記第1のポリエステルは,第1のジカルボキシレートモノマー及び第1のジオールモノマーを含み,前記第1のジカルボキシレートモノマーの0.25モル%以上10モル%未満は,ペンダントイオン基を有し,
前記第2の光学層は,第2のポリエステルを含み,
前記第1及び第2の光学層は,少なくとも1つの軸線に沿って,少なくとも0.04異なる屈折率を有し,前記第1及び第2の光学層のそれぞれは,少なくとも1000ppmの濃度のナトリウムイオンを有し,前記第1及び第2の光学層のそれぞれは,ナトリウムアセテートを含む,多層光学フィルム。」(以下,「本件発明」という。)


3 原査定の拒絶の理由の概要
本件発明に対する原査定の拒絶の理由(以下,「査定理由」という。)は,概略,次のとおりである。

本件発明は,引用文献1(国際公開第2006/044075号)に記載された発明及び周知技術に基づいて,当業者が容易に発明をすることができたものであるから,特許法29条2項の規定により特許を受けることができない。

The present invention relates to modified copolyesters and multilayered polymer films formed from the modified copolyesters for optical applications and the use of comonomer subunits to enhance the properties of the polymer films. The properties of a given polyester are typically determined by the monomer materials utilized in the preparation of the polyester. A polyester is often prepared by reactions of one or more different carboxylate monomers (e.g., compounds with two or more carboxylic acid or ester functional groups) with one or more different glycol monomers (e.g., compounds with two or more hydroxy functional groups). Each set of polyester layers in the stack typically has a different combination of monomers to generate the desired properties for each type of layer.

Figure 1 shows a multilayered polymer film 10 which may be used, for example, as an optical polarizer or mirror. Tertiary butyl isophthalate (tbia) has surprisingly been found useful for some exemplary embodiments of the present disclosure due to the inverse effect it has on the polymer properties of glass transition temperature and refractive index. Increasing the mol portion of tbia can increase the glass transition temperature of the copolymer while at the same time decrease its refractive index.
Suitable glycol monomer molecules for use in forming glycol subunits of the polyester layers include ethylene glycol; propylene glycol; 1,4-butanediol and isomers thereof; 1,6-hexanediol; neopentyl glycol; polyethylene glycol; diethylene glycol; tricyclodecanediol; 1,4-cyclohexanedimethanol and isomers thereof; 2-butyl-2-ethyl-l,3-propane diol; 2,2,4-triethyl-l,3-pentane diol; norbornanediol; bicyclo-octanediol; trimethylol propane; pentaerythritol; 1,4-benzenedimethanol and isomers thereof; bisphenol A; 1,8-dihydroxy biphenyl and isomers thereof; and l,3-bis(2- hydroxyethoxy)benzene.
1,4-cyclohexane dimethanol (chdm) also has been found useful for some exemplary embodiments of the present disclosure due to the inverse effect it has on the polymer properties of glass transition temperature and refractive index. Increasing the mol portion of chdm can increase the glass transition temperature of the copolymer while at the same time decrease its refractive index. (オ) 「The first optical layers 12 can be orientable polymer films, such as polyester films, which may be made birefringent by, for example, stretching the first optical layers 12 in a desired direction or directions. The term "birefringent" means that the indices of refraction in orthogonal x, y, and z directions are not all the same. For films or layers in a film, a convenient choice of x, y, and z axes is shown in Figure 1 in which the x and y axes correspond to the length and width of the film or layer and the z axis corresponds to the thickness of the layer or film. In the embodiment illustrated in Figure 1, the film 10 has several optical layers 12, 14 which are stacked one on top of the other in the z-direction.
The first optical layers 12 may be uniaxially-oriented, for example, by stretching in a single direction. Typically, stretching in one film in-plane direction causes drawdown in at least one other orthogonal direction, usually the thickness direction of the film, to preserve approximate volume conservation (as corrected by density changes, e.g. due to crystallization) upon stretching. In one embodiment, the direction of stretching substantially corresponds to either the x or y in-plane axis shown in Figure 1. However, other directions may be chosen. In one illustrative embodiment of a uniaxial stretch, the film is stretched in one direction and the film contracts in two orthogonal directions to this stretch direction, e.g. in the non-drawn (or non-stretched) in-plane direction and the thickness direction. When the relative amount of contraction is similar in these directions, the first optical layers 12 attain relatively similar refractive indices in these directions perpendicular to stretch. Likewise, the maximum birefringence of the first optical layers 12 measured in this plane normal to the stretch direction is small relative to the main in-plane birefringence of these same first optical layers 12. The first optical layers 12 are then truly or nearly truly uniaxially oriented.・・・(中略)・・・The degree of alteration in the index of refraction along the stretch direction will depend on factors such as the amount of stretching, the stretch rate, the temperature of the film during stretching, the thickness of the film, the variation in the film thickness, and the composition of the film. In some embodiments, the first optical layers 12 have a maximum in-plane birefringence (e.g., the absolute value of n_(x)-n_(y) in the absence of shearing rotation or bowing during stretching) after orientation of 0.04 or greater at 632.8 nm, or about 0.1 or greater, or about 0.2 or greater. In some embodiments of nearly truly uniaxially oriented films, the maximum birefringence in the plane normal to the stretch (the absolute value of n_(y)-n_(z) ) of the first optical layers 12 is 0.03 or less at 632.8 nm, 0.02 or less or even 0.01 or less. For a nearly truly uniaxial orientation, the ratio of the maximum birefringence in the plane normal to the stretch to the maximum in-plane birefringence is 0.2 or less, or 0.15 or less, although values of 0.1 or less, or even 0.05 or less, can be achieved. All birefringence and index of refraction values herein are reported for 632.8 nm light unless otherwise indicated.
The birefringence of a material can be increased by increasing the molecular orientation. Many birefringent materials are crystalline or semicrystalline. The term "crystalline" will be used herein to refer to both crystalline and semicrystalline materials. PEN and other crystalline polyesters, such as polybutylene naphthalate (PBN), polypropylene naphthalate (PPN), polyhexamethylene naphthalate (PHN), polyethylene terephthalate (PET), polybutylene terephthalate (PBT), polypropylene terephthalate (PPT), and polyhexamethylene terephthalate (PHT) are examples of crystalline materials useful in the construction of birefringent film layers, such as is often the case for the first optical layers 12. In addition, some copolymers of PEN, PPN, PBN, PHN, PET, PPT, PBT, and PHT are also crystalline or semicrystalline. The addition of a comonomer to PEN, PPN, PBN, PHN, PET, PPT, PBT, or PHT may enhance other properties of the material including, for example, adhesion to the second optical layers 14 or the non-optical layers 18 and/or the lowering of the working temperature (i.e., the temperature for extrusion and/or stretching the film), as desired.
In some embodiments, the first optical layers 12 are made from a semicrystalline, birefringent polyester or copolyester which, in some exemplary embodiments, can include 70 to 100 mol% of a first carboxylate subunit and 0 to 30 mol% of comonomer carboxylate subunits. The comonomer carboxylate subunits may be one or more of the subunits indicated hereinabove. In some embodiments, first carboxylate subunits include naphthalate and terephthalate.

In some embodiments, a multilayered polymer film 10 may be formed using first optical layers 12 that are made from a coPEN which has the same in-plane birefringence for a given draw ratio (i.e., the ratio of the length of the film in the stretch direction after stretching and before stretching) as a similar multilayered polymer film formed using PEN for the first optical layers. The matching of birefringence values may be accomplished by the adjustment of processing parameters, such as the processing or stretch temperatures or the processing or stretch rates. Often coPEN optical layers have an index of refraction in the draw direction which is at least 0.02 units less than the index of refraction of the PEN optical layers in the draw direction. The birefringence is maintained because there is a decrease in the index of refraction in a non-draw direction.
In some embodiments, PEN often has an in-plane index of refraction that is 1.84 or higher and the difference between the in-plane indices of refraction is about 0.22 to 0.24 or more when measured using 632.8 nm light. The in-plane refractive index differences, or birefringence, of the first optical layers, whether they be PEN or coPEN, may be reduced to less than 0.2 to improve properties, such as interlayer adhesion. Similar comparisons between suitable coPBN and coPET polymers for the first layers can be made with PBN and PET.」(明細書8ページ8行ないし11ページ14行)

The coPEN polymers of the present disclosure have low in-plane indices of refraction (e.g., n_(x) or n_(y) or both) while maintaining relatively high glass transition temperatures. Some illustrative coPEN polymers have in-plane indices of refraction that are less than 1.59, for example, 1.58 or less, with a glass transition temperature of 90 degrees Celsius or greater, 100 degrees Celsius or greater, or 102 degrees Celsius or greater. Other illustrative coPEN polymers have in-plane indices of refraction of 1.57 or less with a glass transition temperature of 90 degrees Celsius or greater, or 1.56 or less with a glass transition temperature values of 80 degrees Celsius or greater.
In some embodiments, these coPEN copolymers include carboxylate subunits which are derived from 10 to 50 mol% naphthalate dicarboxylate and 30 to 90 mol% t-butyl-isophthalic acid (TBIA) or an ester thereof and terephthalate may optionally be present up to 50 mol% or 0 to 50 mol %. Higher refractive indices and higher glass transition temperature can be achieved by increasing the naphthalate dicarboxylate content.

[Synthesis of polyethylene naphthalate (PEN)]
The polyethylene naphthalate (PEN) used to form the first optical layers was synthesized in a batch reactor with the following raw material charge: dimethyl naphthalene dicarboxylate (136 kg), ethylene glycol (73 kg), manganese (H) acetate (27g), cobalt (II) acetate (27g) and antimony (III) acetate (48g). Under a pressure of 2 atmospheres (1520 torr or 2x10^(5) N/m^(2)), this mixture was heated to 254℃ while removing methanol (a transesterification reaction by-product). After 35 kg of methanol was removed, 49 g of triethyl phosphonoacetate (49g) was charged to the reactor and the pressure was gradually reduced to 1 torr (131 N/m^(2)) while heating to 29O℃. The condensation reaction by-product, ethylene glycol, was continuously removed until a polymer with an intrinsic viscosity of 0.48 dL/g (as measured in 60/40 wt.% phenol/o-dichlorobenzene) was produced.
[Synthesis of ethylene naphthalate t-butyl isophthalate polymer (CoPEN-tbia)]
The synthesis of the CoPEN-tbia polymer was carried out in a batch reactor which was charged with the following materials: dimethyl 2,6-naphthalenedicarboxylate (47.3 kg), dimethyl terephthalate (18.6 kg), 1,4-cyclohexane dimethanol (40.5 kg), neopentyl glycol (15 kg), ethylene glycol (41.8 kg), trimethylol propane (2 kg), cobalt (H) acetate (36.3 g), zinc acetate (50g), and antimony (HI) acetate (65g). The mixture was heated to a temperature of 254℃ at a pressure of two atmospheres (2x10^(5) N/m^(2)) and the mixture allowed to react while removing the methanol reaction product.
After completing the reaction and removing all of the methanol (approximately 13.1 kg) the reaction vessel was charged with tertiary-butyl isophthalate (43.2 kg). The reaction was continued at 254℃ until approximately 7.4 kg of water was removed and the reaction was complete.
The reaction vessel was charged with triethyl phosphonoacetate (70g) and the pressure was reduced to one torr (263 N/m^(2)) while heating to 290℃. The condensation by-product, ethylene glycol, was continuously removed until a polymer with intrinsic viscosity 0.632 dl/g as measured in a 60/40 weight percent mixture of phenol and o-dichlorobenzene is produced. The CoPEN-tbia polymer produced by this method had a glass transition temperature (Tg) of 102℃ as measured by differential scanning calorimetry at a temperature ramp rate of 20℃ per minute. The CoPEN-tbia polymer had a refractive index of 1.567.
[Multilayer optical film - PEN/CoPEN-tbia reflective polarizer film]
The above described PEN and CoPEN-tbia were coextruded through a multilayer melt manifold to create a multilayer optical film with 275 alternating first and second optical layers. The PEN layers were the first optical layers and the CoPEN-tbia layers were the second optical layers. In addition to the first and second optical layers, a set of non-optical layers, also comprised of CoPEN-tbia were coextruded as PBL(protective boundary layers) on either side of the optical layer stack. Two sets of skin layers were also coextruded on the outer side of the PBL non-optical layers through additional melt ports. Poly(methyl methacrylate) was used to form the internal set of skin layers. The external skin layers were made from a blend of propylene polymers (80:20 by weight respectively of PP6671 and PP 1024) were used to form the external set of coextruded skin layers. Adhesion Strength: To test interlayer adhesion strength strips were cut from near the center of the sidewall of the blown bottle. Alternatively, multilayer sheets having the same structure and thickness were prepared by coextrusion to provide samples for adhesion testing. CPET resins include those such as Crystar ^(○R) 5005 from E. I. du Pont de Nemours and Company (DuPont). Of note is a bulk polyester comprising a PET homopolymer or copolymer with T_(m) in a range from about 245℃ to 258℃ and an IV from 0.67 and 1.1. Preferred is a PET homopolymer or copolymer with T_(m) in a range from about 245℃ to 258℃ and an IV from 0.75 and 0.95.
The copolymer of polyester and a sulfobenzenedicarboxylic acid used herein includes any polymer comprising (or derived from) terephthalic acid or a terephthalate diester such as dimethylterephthalate and ethylene glycol in amounts such that the copolymer comprises at least about 50 mole percent ethylene terephthalate, and the remainder of the polymer being derived from monomers comprising a sulfo (i.e. sulfonic acid) moiety, such as sulfoterephthalic acid or 5-sulfoisophthalic acid, their salts and/or ester forming equivalents thereof.
Sulfobenzenedicarboxylic acid can have the formula of (RO(O)C)_(2)ArS(O)_(2)OM in which each R can be the same or different and is hydrogen or an alkyl group containing 1 to about 6 carbon atoms. Ar is a phenylene group. M can be an alkali metal ion. An example is 5-sulfoisophthalic acid (5-SIPA); an example of an ester forming equivalent thereof is the sodium salt of 5-sulfo-1,3-dimethyl ester 1,3- benzenedicarboxylic acid (also known as 5-sodium sulfodimethylisophthalate; CAS Registry Number 3965-55-7).」(明細書8ページ5ないし末行)

周知例2に記載された実施例1ないし11で用いている「スルホジメチルイソフタル酸5-ナトリウム」とは,周知例1に記載された実施例1ないし10で用いている「5-スルホイソフタル酸ジメチルナトリウム」の別名であるから,前記ア及びイで摘記した周知例1及び2の記載からみて,次の技術事項が本件優先日より前に周知であったと認められる。

「樹脂からなる多層構造体において,層を形成する材料として,酸成分に対して1.7ないし2モル%程度の5-スルホイソフタル酸ジメチルナトリウム由来の構造単位を有するコポリエステルを用いることによって,他の層との接着性を向上させること。」(以下,「第1周知技術」という。)

エ 特開2000-143789号公報の記載
査定理由で周知例として例示された特開2000-143789号公報(以下,「周知例3」という。)は,本件優先日より前に頒布された刊行物であるところ,当該周知例3には次の記載がある。(下線は,後述する「第2周知技術」の認定に特に関係する箇所を示す。)
(ア) 「【請求項1】芳香族ジカルボン酸またはそのエステル形成性誘導体と,脂肪族ジオールまたはそのエステル形成性誘導体とエステル化し,重縮合触媒の存在下に重縮合させてポリエステルを製造するに際して,
重縮合触媒として
(i)チタン化合物と,

(ア) 「【0053】[実施例1]
重合:ナフタレン-2,6-ジカルボン酸ジメチル99重量部とエチレングリコール67重量部とを,エステル交換触媒として酢酸マンガン四水塩0.03重量部,酢酸ナトリウム0.0057重量部を使用して,常法に従ってエステル交換反応させた後,トリメチルホスフェート0.023重量部を添加し実質的にエステル交換反応を終了させた。
【0054】ついで,三酸化アンチモン0.024重量部,イソフタル酸0.68重量部を添加し,引き続き高温高真空下で常法にて重縮合反応を行い,固有粘度0.62,DEG共重合量1.3モル%の共重合ポリエチレンナフタレートポリマーを得た。」

特開平8-203062号公報(以下,「周知例5」という。)は,本件優先日より前に頒布された刊行物であるところ,当該周知例5には次の記載がある。(下線は,後述する「第2周知技術」の認定に特に関係する箇所を示す。)
(ア) 「【0050】〔実施例1〕イソフタル酸ジメチル50モル,テレフタル酸ジメチル30モル,5-ナトリウムスルホイソフタル酸ジメチル15モル,エチレングリコール100モル及びネオペンチルグリコール50モルを部分還流式冷却器を具備した反応容器に加え,更にこの反応容器に触媒として酢酸亜鉛0.2モル,酢酸ナトリウム0.02モル及び三酸化アンチモン0.2モルを加え,150?210℃で3時間エステル交換反応を行った。次いで,アジピン酸5モルを加え,190?240℃で1時間反応させた後,60分間かけて1?50mmHgまで減圧し,OH.Vが20になる迄重縮合反応を行いポリエステル(A)を得た。」

キ 周知例3ないし5の記載から把握される周知の技術事項
前記エないしカで摘記した周知例3ないし5の記載からみて,次の技術事項が,本件優先日より前に周知であったと認められる。

「ポリエステルを合成する際の触媒として,酢酸ナトリウムを用いること。」(以下,「第2周知技術」という。)


5 判断
(1)対比
ア 引用発明の「反射偏光子フィルム」は,外部スキン層,内部スキン層,第1及び第2光学層の275の交互層,内部スキン層,及び外部スキン層という順序の層構成の多層押出しフィルムを一軸延伸することによって製造されており,引用発明自身も外部スキン層,内部スキン層,第1及び第2光学層の275の交互層,内部スキン層,及び外部スキン層という順序の層構成を有していることは自明であるから,「多層光学フィルム」であるといえる。
また,引用発明の「反射偏光子フィルム」は,第1及び第2光学層の275の交互層を有しているところ,当該「第1光学層」及び「第2光学層」が,それぞれ本件発明の「第1の光学層」及び「第2の光学層」に対応する。したがって,引用発明は,「第1及び第2の光学層の交互層を含む」という本件発明の発明特定事項に相当する構成を具備している。
したがって,引用発明は,本件発明と,「第1及び第2の光学層の交互層を含む多層光学フィルム」である点で一致する。

イ 引用発明の「第1光学層」(本件発明の「第1の光学層」に対応する。以下,「(1)対比」欄において,「」で囲まれた引用発明の構成に付した()中の文言は,当該引用発明の構成に対応する本件発明の発明特定事項を指す。)を構成する「ポリエチレンナフタレート」の原料である「ジメチルナフタレンジカルボキシレート」及び「エチレングリコール」は,それぞれ「ジカルボキシレートモノマー」及び「ジオールモノマー」に該当する。また,引用発明の「第1光学層」を構成する「ポリエチレンナフタレート」は,「ポリエステル」に属するポリマーである。
したがって,引用発明の「第1光学層」は,本件発明の「第1の光学層」と,「第1のポリエステルを含み,前記第1のポリエステルは,第1のジカルボキシレートモノマー及び第1のジオールモノマーを含」む点で共通する。

ウ 引用発明の「第2光学層」(第2の光学層)を構成する「エチレンナフタレートt-ブチルイソフタレートポリマー」は,「ポリエステル」に属するポリマーであるから,引用発明の「第2光学層」は,「第2のポリエステルを含」むという本件発明の「第2の光学層」に係る発明特定事項に相当する構成を具備している。

エ 前記アないしウに照らせば,本件発明と引用発明は,
「第1及び第2の光学層の交互層を含む多層光学フィルムであって,
前記第1の光学層は,第1のポリエステルを含み,前記第1のポリエステルは,第1のジカルボキシレートモノマー及び第1のジオールモノマーを含み,
前記第2の光学層は,第2のポリエステルを含む,多層光学フィルム。」
である点で一致し,次の点で相違する,又は一応相違する。

相違点1:
本件発明の「第1の光学層」が含む「第1のポリエステル」は,第1のジカルボキシレートモノマーの0.25モル%以上10モル%未満が,ペンダントイオン基を有するのに対して,
引用発明の「第1光学層」の材質である「ポリエチレンナフタレート」は,ペンダントイオン基を有するカルボキシレートモノマーに由来する構造単位を有していない点。

相違点2:
本件発明では,「第1の光学層」及び「第2の光学層」が,少なくとも1つの軸線に沿って,少なくとも0.04異なる屈折率を有しているのに対して,
引用発明では,「第1光学層」の材料である「ポリエチレンナフタレート」及び「第2光学層」の材料である「エチレンナフタレートt-ブチルイソフタレートポリマー」の屈折率がそれぞれ1.64及び1.567であるものの,「第1光学層」及び「第2光学層」の各方向の屈折率,すなわち一軸延伸後の各材料の各方向の屈折率は定かでない点。

相違点3:
本件発明では,「第1の光学層」及び「第2の光学層」のそれぞれが,少なくとも1000ppmの濃度のナトリウムイオンを有しているのに対して,
引用発明では,「第2光学層14」及び「第1光学層」のいずれについても,ナトリウムイオンを有していない点。

相違点4:
本件発明では,「第1の光学層」及び「第2の光学層」のそれぞれが,ナトリウムアセテートを含むのに対して,
引用発明では,「第2光学層14」及び「第1光学層」のいずれについても,ナトリウムアセテートを含んでいない点。

(2)相違点1の容易想到性について
ア(ア) 引用文献1の明細書7ページ7ないし13行(前記4(1)ア(エ)の日本語訳中第2段落第1文を参照。)には,引用発明の第1光学層12及び第2光学層14のポリエステルの製造に使用するのに適したカルボキシレートモノマーとして,「ナトリウムスルホン化イソフタル酸」及びその「低級アルキルエステル」が例示されている。

(イ) 引用文献1の明細書4ページ5ないし14行(前記4(1)ア(ウ)の日本語訳中第1段落を参照。)には,ポリエステルの特性が,製造に使用されるモノマー材料によって決定されること,及びポリエステル層に望ましい特性が得られるように,モノマーの組合せを選択することが説明されている。
また,引用文献1の明細書10ページ5ないし9行(前記4(1)ア(オ)の日本語訳中第3段落末文を参照。)には,コモノマーを添加することで得られる特性の例として,隣接層への粘着性が挙げられている。

イ 前記4(2)ウで認定したように,「樹脂からなる多層構造体において,層を形成する材料として,酸成分に対して1.7ないし2モル%程度の5-スルホイソフタル酸ジメチルナトリウム由来の構造単位を有するコポリエステルを用いることによって,他の層との接着性を向上させること。」(第1周知技術)が,本件優先日より前に周知であったと認められるところ,当該第1周知技術における「5-スルホイソフタル酸ジメチルナトリウム」は,前記ア(ア)で述べた引用文献1に記載された「ナトリウムスルホン化イソフタル酸」の「低級アルキルエステル」に該当する。

ウ 引用発明は,第1及び第2光学層の275の交互層を有しており,いわゆる共押出し成形により作製した多層押出しフィルムを一軸延伸することによって製造されたものであるところ,前記ア及びイで述べた事項に照らせば,第1光学層と第2光学層の層間接着性を向上し,両層の間で剥離が生じないようにするために,第1光学層12を形成するポリエチレンナフタレート及び第2光学層を形成するエチレンナフタレートt-ブチルイソフタレートポリマーについて,それぞれ,第1周知技術を適用すること,すなわち,酸成分として,酸成分全体に対して1.7ないし2モル%程度の5-スルホイソフタル酸ジメチルナトリウム(あるいは5-スルホイソフタル酸ナトリウム)を用いることは,引用文献1自体の記載及び第1周知技術に基づいて,当業者が容易に想到し得たことである。
しかるに,5-スルホイソフタル酸ジメチルナトリウム(あるいは5-スルホイソフタル酸ナトリウム)は,本件明細書に記載された実施例で用いているモノマーを参酌すると,「ペンダントイオン基を有するカルボキシレートモノマー」に該当するから,前記構成の変更を行った引用発明は,相違点1に係る本件発明の発明特定事項に相当する構成を具備することとなる。

エ 以上のとおりであるから,引用発明を,相違点1に係る本件発明の発明特定事項に相当する構成を具備するものとすることは,引用文献1自体の記載及び第1周知技術に基づいて,当業者が容易に想到し得たことである。

(3)相違点2について
ア 引用文献1の前記4(1)ア(ク)で摘記した引用文献1の記載によれば,延伸してもほぼ光学的に配向しない等方性の材料で第2光学層が形成されている場合は,偏光子は,第1光学層の2つの面内屈折率(直交する方向の面内屈折率であることは技術常識から自明である。)の一方と第2光学層の等方性屈折率とがほぼ一致し,第1光学層の2つの面内屈折率の他方と第2光学層の等方性屈折率とが実質的に異なるよう構成され,複屈折性の材料で第2光学層が形成されている場合は,偏光子は,第1光学層及び第2光学層の2つの面内屈折率の一方がほぼ等しく,他方が実質的に異なるよう構成されており,当該構成によって,面内屈折率がほぼ等しい方向の偏光を透過し,面内屈折率が実質的に異なる方向の偏光を反射するよう機能するものと理解される。そして,当該記載中では,ほぼ等しい屈折率について,その差が632.8nmにて約0.05以下であると説明しているのであるから,「第1光学層の2つの面内屈折率の他方と第2光学層の等方性屈折率とが実質的に異なる」,又は「第1光学層及び第2光学層の2つの面内屈折率の他方が実質的に異なる」とは,それらの屈折率の差が632.8nmにて少なくとも0.05より大きいことを意味していると解される。

イ 引用発明の第2光学層を構成するエチレンナフタレートt-ブチルイソフタレートポリマーが,等方性の材料であるのか,複屈折性の材料であるのかは定かでないが,引用発明は,反射偏光子フィルム,すなわち,所定の偏光を反射する偏光子であるのだから,前記アで述べた事項に照らせば,その一軸延伸後の第1光学層及び第2光学層の面内屈折率は,ある方向においてほぼ等しい値,すなわち,その差が632.8nmにて約0.05以下であり,これと直交する方向において実質的に異なる値,すなわち,その差が少なくとも632.8nmにて0.05より大きいと解するのが相当される。
すなわち,引用発明において,第1光学層及び第2の光学層は,「少なくとも1つの軸線に沿って,少なくとも0.04異なる屈折率を有している」から,相違点2は,実質的な相違点ではない。(なお,引用発明に前記(2)ウで述べた構成の変更を行っても,5-スルホイソフタル酸ジメチルナトリウムの配合量はごく少量であるから,各面内屈折率の値の変化はごくわずかであって,無視できる。)

ウ また,仮に,引用発明において,第1光学層及び第2光学層が,「少なくとも1つの軸線に沿って,少なくとも0.04異なる屈折率を有している」とまで断定できないとしても,以下の理由から,引用発明を,相違点2に係る本件発明の発明特定事項に相当する構成を具備するものとすることは,当業者が容易になし得たことである。
前記4(1)ア(ク)で摘記した引用文献1の記載中には,第1光学層と第2光学層の屈折率の差を増加することによって,反射率を高めることができることが説明されている。
そうすると,引用発明において,面内屈折率が実質的に異なる方向の偏光の反射率を高めるために,第1光学層を形成するポリエチレンナフタレート又は第2光学層を形成するエチレンナフタレートt-ブチルイソフタレートポリマーの原料となる各モノマーの含有比率を調整したり,他の種類のモノマーを用いる等によって,実質的に異なる方向の第1光学層及び第2光学層の面内屈折率の差を0.04以上とすることは,引用文献1自体の記載に基づいて,当業者が適宜なし得たことである。

(4)相違点4の容易想到性について
事案に鑑みて,相違点3の容易想到性の判断の前に,相違点4の容易想到性について判断する。
ア 前記4(2)キで認定したように,「ポリエステルを合成する際の触媒として,酢酸ナトリウムを用いること。」(第2周知技術)が,本件優先日より前に周知であったと認められる。
引用発明において,第1光学層を形成するポリエチレンナフタレート及び第2光学層を形成するエチレンナフタレートt-ブチルイソフタレートポリマーのいずれについても,合成をする際の触媒として,酢酸ナトリウムを用いていないものの,それぞれについて,触媒として第2周知技術の酢酸ナトリウムを用いて,合成することは,単なる設計変更にすぎない。

イ 合成時に用いた触媒が,ごく微量とはいえ合成後のポリマー中に残存することは,当業者における技術常識である(例えば,特開2003-292592号公報の請求項2,3,7及び8,【0027】,【0038】の記載等を参照。)。
そうすると,前記アで述べた設計変更を行った引用発明においては,第1光学層及び第2光学層中に酢酸ナトリウムが残存するものと認められる。
ここで,酢酸ナトリウムは,ナトリウムアセテートの別名であるから,前記アで述べた設計変更を行った引用発明は,相違点4に係る本件発明の発明特定事項に相当する構成を具備することとなる。

ウ 以上のとおりであるから,引用発明を,相違点4に係る本件発明の発明特定事項に相当する構成を具備したものとすることは,単なる設計変更にすぎない。

(5)相違点3について
ア 前記(2)ウ及び前記(4)アで述べた構成の変更を行った引用発明における第1光学層は,概ね,98ないし98.3モル%程度のジメチルナフタレンジカルボキシレート由来の構造単位と,1.7ないし2モル%程度の5-スルホイソフタル酸ジメチルナトリウム由来の構造単位と,100モル%のエチレングリコール由来の構造単位とから構成された共重合体により形成されている。
ジメチルナフタレンジカルボキシレート由来の構造単位を構成する各原子の原子量の総和(以下,便宜上「構造単位量」という。)は約214,5-スルホイソフタル酸ジメチルナトリウム由来の構造単位の構造単位量は約266,エチレングリコール由来の構造単位の構造単位量は約28,ナトリウムの原子量は約23であるから,前記(2)ウ及び前記(4)アで述べた構成の変更を行った引用発明における,第1光学層中に存在するナトリウムイオンのうち,5-スルホイソフタル酸ジメチルナトリウム由来のナトリウムイオンの量は,約1610(≒23×1.7/(214×98.3+266×1.7+28×100)×10^(6))ないし約1893(≒23×2/(214×98+266×2+28×100)×10^(6))ppm程度となる。
そして,前記(2)ウ及び前記(4)アで述べた構成の変更を行った引用発明における第1光学層中に存在するナトリウムイオンの総量は,前記5-スルホイソフタル酸ジメチルナトリウム由来のナトリウムイオンの量(約1610ないし約1893ppm程度)に,共重合体中に残存する触媒として用いた酢酸ナトリウム由来のナトリウムイオンの量を加えたものとなるから,相違点3に係る本件発明の「少なくとも1000ppmの濃度」という要件を満足する。

イ また,ジメチル2,6-ナフタレンジカルボキシレート47.3kg,ジメチルテレフタレート18.6kg,t-ブチルイソフタレート43.2kg,1,4-シクロヘキサンジメタノール40.5kg,ネオペンチルグリコール15kg,エチレングリコール41.8kg及びトリメチロールプロパン2kgをそれぞれモル数に換算すると,約194(≒47.3×10^(3)/244)モル,約96(≒18.6×10^(3)/194)モル,約195(≒43.2×10^(3)/222)モル,約281(≒40.5×10^(3)/144)モル,約144(≒15×10^(3)/104)モル,約674(≒41.8×10^(3)/62)モル及び約15(≒2×10^(3)/134)モルとなるから,引用発明の第2光学層は,概ね,約40.0(≒194/(194+96+195)×100)モル%のジメチル2,6-ナフタレンジカルボキシレート由来の構造単位と,約19.8(≒96/(194+96+195)×100)モル%のジメチルテレフタレート由来の構造単位と,約40.2(≒195/(194+96+195)×100)モル%のt-ブチルイソフタレート由来の構造単位と,約25.2(≒281/(281+144+674+15)×100)モル%の1,4-シクロヘキサンジメタノール由来の構造単位と,約12.9(≒144/(281+144+674+15)×100)モル%のネオペンチルグリコール由来の構造単位と,約60.5(≒674/(281+144+674+15)×100)モル%のエチレングリコール由来の構造単位と,約1.3(≒15/(281+144+674+15)×100)モル%のトリメチロールプロパン由来の構造単位とから構成された共重合体により形成されている。
したがって,前記(2)ウ及び前記(4)アで述べた構成の変更を行った引用発明における第2光学層は,概ね,約39.2(≒40.0/102×100≒40.0/101.7×100)モル%程度のジメチル2,6-ナフタレンジカルボキシレート由来の構造単位と,約19.5(≒19.8/102×100≒19.8/101.7×100)モル%程度のジメチルテレフタレート由来の構造単位と,約39.4(≒40.2/102×100)ないし約39.5(≒40.2/101.7×100)モル%程度のt-ブチルイソフタレート由来の構造単位と,1.7ないし2モル%程度の5-スルホイソフタル酸ジメチルナトリウム由来の構造単位と,約25.2モル%の1,4-シクロヘキサンジメタノール由来の構造単位と,約12.9モル%のネオペンチルグリコール由来の構造単位と,約60.5モル%のエチレングリコール由来の構造単位と,約1.3モル%のトリメチロールプロパン由来の構造単位とから構成された共重合体により形成されることとなる。
ジメチル2,6-ナフタレンジカルボキシレート由来の構造単位の構造単位量は約214,ジメチルテレフタレート由来の構造単位の構造単位量は約164,t-ブチルイソフタレート由来の構造単位の構造単位量は約220,5-スルホイソフタル酸ジメチルナトリウム由来の構造単位の構造単位量は約266,1,4-シクロヘキサンジメタノール由来の構造単位の構造単位量は約110,ネオペンチルグリコール由来の構造単位の構造単位量は約70,エチレングリコール由来の構造単位の構造単位量は約28,トリメチロールプロパン由来の構造単位の構造単位量は約83,ナトリウムの原子量は約23であるから,前記(2)ウ及び前記(4)アで述べた構成の変更を行った引用発明における第1光学層中に存在するナトリウムイオンのうち,5-スルホイソフタル酸ジメチルナトリウム由来のナトリウムイオンの量は,約1492(≒23×1.7/(214×39.2+164×19.5+220×39.5+266×1.7+110×25.2+70×12.9+28×60.5+83×1.3)×10^(6))ないし約1751(≒23×2/(214×39.2+164×19.5+220×39.4+266×2+110×25.2+70×12.9+28×60.5+83×1.3)×10^(6))ppm程度となる。
そして,前記(2)ウ及び前記(4)アで述べた構成の変更を行った引用発明における第2光学層中に存在するナトリウムイオンの総量は,前記5-スルホイソフタル酸ジメチルナトリウム由来のナトリウムイオンの量(約1492ないし約1751ppm程度)に,共重合体中に残存する触媒として用いた酢酸ナトリウム由来のナトリウムイオンの量を加えたものとなるから,相違点3に係る本件発明の「少なくとも1000ppmの濃度」という要件を満足する。

ウ 以上によれば,前記(2)ウ及び前記(4)アで述べた構成の変更を行った引用発明は,必然的に相違点3に係る本件発明の発明特定事項に相当する構成を具備したものとなる。

(6)効果について
本件発明の効果は,引用文献1の記載,第1周知技術及び第2周知技術に基づいて,当業者が予測できた程度のものである。

(7)まとめ
以上のとおりであるから,本件発明は,引用発明,第1周知技術及び第2周知技術に基づいて,当業者が容易に発明をすることができたものである。


6 むすび
本件発明は,引用発明,第1周知技術及び第2周知技術に基づいて,当業者が容易に発明をすることができたものであるから,他の請求項に係る発明について検討するまでもなく,本件出願は,特許法29条2項の規定により特許を受けることができない。
よって,結論のとおり審決する。
