第2 本願発明
本願の特許請求の範囲の請求項2に係る発明(以下「本願発明」という。)は、令和元年8月13日にされた手続補正により補正された特許請求の範囲の請求項2に記載された事項により特定されるとおりのものである。
なお、上記令和元年8月13日にされた手続補正は、本願特許請求の範囲の請求項3のみを補正するものであり、請求項2は実質的な補正はされていない。

「【請求項2】
作業員に装着される作業用スーツであって、
前記作業員の状態を感知する状態センサーと、
前記状態センサーから出力される状態データを、前記作業員に携帯される多機能携帯端末に無線送信する送信部と、を備え、
前記状態データが、前記多機能携帯端末を介して、管理サーバーに送信され、
前記状態センサーは、前記作業員の健康状態を感知するセンサーであり、
前記作業員の健康状態を示す前記状態データが、前記多機能携帯端末を介して、前記管理サーバーに送信され、
受信部、及び、報知部を備え、
前記管理サーバーが、前記作業員の健康状態を示す前記状態データに基づき、前記作業員に健康異常が発生していると判断し、健康異常の発生を示す異常データを前記多機能携帯端末に送信した場合、
前記異常データが前記多機能携帯端末から前記受信部に無線送信され、前記報知部が、健康異常の発生を報知すること、
を特徴とする作業用スーツ。」

2. 原査定の拒絶の理由
原査定の拒絶の理由の概要は、以下の(1)及び(2)に示したとおりのものである。
(1) 本願発明は、引用文献1に記載された発明であるから、特許法第29条第1項第3号の規定により、特許を受けることができない。
(2) 本願発明は、本願の出願日前に頒布された又は電気通信回線を通じて公衆に利用可能となった下記の引用文献1に記載された発明に基いて、その出願前にその発明の属する技術の分野における通常の知識を有する者(以下「当業者」という。)が容易に発明をすることができたものであるから、特許法第29条第2項の規定により特許を受けることができない。

A detected brainwave includes a Delta wave, a Theta wave, Alpha wave, a Beta wave, a Gamma wave, etc. The brainwave measuring sensor 110 provides the sensed brainwave signal to the controller 130. The brainwave measuring sensor 110 may extract the brain wave in a non-analgesic method or a non-bonding method by using a silver fiber electrode installed on the head of the user. The brainwave measuring sensor 110 removes a noise signal different from a blink signal from the brainwave signal and outputs the resulting signal. The controller 130 determines a concentration, a laxity, a consciousness or an unconsciousness, etc. of the user based on the resulting signal.

If it is determined that the user is in the dangerous state, the controller 220 generates a control signal to generate a warning message and a vibration signal and transmits the control signal to the wearable device through the communicator 210.

シ. 引用文献1に記載された「脳波」、「心電図」及び「筋電図」を測定するためのセンサは、いずれもユーザの状態を測定するものであるといえるから、「状態センサ」ということができ、「状態センサ」により測定されたデータを、「状態データ」ということができる。さらに、「脳波」、「心電図」及び「筋電図」のデータから、ユーザの健康状態を感知できることは明らかであるから、「状態データ」は、ユーザの健康状態を感知するセンサであるといえる。
ス. 上記摘記事項ケ.の[0103]には、「管理装置200」の「通信部210」が、「装着型装置」からの情報を無線にて受信する旨、記載されているから、「装着型装置」は、「管理装置200」に無線送信する「送信部」を備えたものであるといえる。
セ. 上記摘記事項サ.の「管理装置200は、通信部210と、制御部220と、記憶装置230とを備えている。」([0102])、及び、「ユーザが危険状態であると判定された場合、制御部220は、制御信号が警告メッセージと振動信号を生成し、通信部210を介して制御信号を装着型装置に送信する」([0105])という記載から、上記「警告メッセージ」は、ユーザの健康異常の発生を示す「異常データ」であるといえ、装着型装置は、「管理装置200」からの健康異常の発生を示す異常データを受信する受信部を備えたものであるといえる。

(2) 引用発明
上記(1)の、摘記事項ア.?コ.、サ.の図示、及び、認定事項シ.?セ.を総合すると、引用文献1には、次の発明(以下「引用発明」という。)が記載されている。
「ユーザに装着されるオールインワンスーツであって、
ユーザの脳波、心電図あるいは筋電図を感知する状態センサと、
前記状態センサから出力される状態データを、前記ユーザに携帯される外部の管理装置200に無線送信する送信部と、を備え、
上記状態データが、前記外部の管理装置200に送信され、
前記状態センサは、前記ユーザの健康状態を感知するセンサであり、
前記ユーザの健康状態を示す上記状態データが、前記外部の管理装置200に送信され、
管理装置200は、前記状態データをWebサーバに送信し、
受信部、及び出力装置170を備え、
前記外部の管理装置200が、前記ユーザの健康状態を示す前記状態データに基づき、前記ユーザに健康異常が発生していると判断し
健康異常の発生を示す異常データを前記外部の管理装置200から前記受信部に無線送信され、前記出力装置170が、健康異常の発生を報知するオールインワンスーツ。」

4. 対比・検討
(1) 対比
本願発明と引用発明とを対比する。
上記摘記事項サ.の「管理装置200は、第3者あるいは管理者に個々の作業員についての情報を提供することができる」ものであるから、引用発明の「ユーザ」は、本願発明の「作業員」に相当し、したがって、本願発明の「ユーザに装着されるオールインワンスーツ」は、本願発明の「作業員に装着される作業用スーツ」に相当する。
引用発明の「状態センサ」及び「状態データ」は、本願発明の「状態センサー」及び「状態データ」に、それぞれ相当する。
引用発明の「前記ユーザに携帯される外部の管理装置200」は、本願発明の「多機能携帯端末」に相当する。
引用発明の「外部の管理装置200が、前記ユーザの健康状態を示す前記状態データに基づき、前記ユーザに健康異常が発生していると判断し」と、本願発明の「前記管理サーバーが、前記作業員の健康状態を示す前記状態データに基づき、前記作業員に健康異常が発生していると判断し、」とは、判断装置が、「前記従業員の健康状態を示す前記状態データに基づき、前記作業員に健康異常が発生していると判断し」を限度として一致する。
引用発明の「Webサーバ」と本願発明の「管理サーバー」とは、両者とも「状態データ」を受信するサーバである限りにおいて一致する。
引用発明の「受信部」及び「出力装置170」は、それぞれ本願発明の「受信部」及び「報知部」にそれぞれ相当する。

そうすると、本願発明と引用発明との間には、以下の点で一致し、かつ、相違する。

<一致点>
「作業員に装着される作業用スーツであって、
前記作業員の状態を感知する状態センサーと、
前記状態センサーから出力される状態データを、前記作業員に携帯される多機能携帯端末に無線送信する送信部と、を備え、
前記状態データが、前記多機能携帯端末に送信され、
前記状態センサーは、前記作業員の健康状態を感知するセンサーであり、
前記作業員の健康状態を示す前記状態データが、前記多機能携帯端末に送信され、
受信部、及び、報知部を備え、
状態データを受信するサーバを備え、
前記判断装置が、前記作業員の健康状態を示す前記状態データに基づき、前記作業員に健康異常が発生していると判断し、健康異常の発生を示す異常データを前記多機能携帯端末が得た場合、
前記異常データが前記多機能携帯端末から前記受信部に無線送信され、前記報知部が、健康異常の発生を報知する作業用スーツ。」

<相違点1>
本願発明は、「判断装置」が「管理サーバー」であって、「状態データ」を「多機能携帯端末」を介して、「管理サーバー」に送信し、「多機能携帯端末」は、「管理サーバー」が「異常データ」を「多機能携帯端末」に送信することにより、「異常データ」を得るものであるのに対し、
引用発明は、「判断装置」が「管理装置200」であって「多機能携帯端末」は、「管理装置200」が「健康異常が発生していると判断」したことにより「異常データ」を得るものであるが、Webサーバが、健康異常の発生を判断し、「異常データ」を「管理装置200」に送信しているか明らかではない点。

(2) 検討
上記(1)に示した<相違点1>について検討する。
ア. 特許法第29条第1項第3号(新規性)の拒絶理由について
上記<相違点1>に係る本願発明の「管理サーバ」及び「多機能携帯端末」は、本願発明の「作業用スーツ」が備える「センサー」、「受信部」及び「報知部」とは異なり、いずれも本願発明の「作業用スーツ」自体を構成するものではないから、上記<相違点1>に係る本願発明の特定事項は、本願発明の「作業用スーツ」という物の発明の構成を特定するものではない。
そして、引用発明の「オールインワンスーツ」が備える「受信部」は、本願発明の「作業用スーツ」の、「多機能携帯端末」からの「異常データ」を受信可能な「受信部」と、その機能作用が相違しないものであるから、<相違点1>は実質的な相違点であるとはいえない
したがって、本願発明は引用発明であるから、特許法第29条第1項第3号に規定された発明に該当するので、特許を受けることができない。

イ. 特許法第29条第2項(進歩性)の拒絶理由について
上記ア.に示したように上記<相違点1>は、実質的な相違点ではないが、仮に、実質的な相違点であるとして、以下のとおり検討する。
引用発明の「管理装置200」が、「状態データ」を「Webサーバ」へ送信するのは、「第3者あるいは管理者に個々の情報を提供する」ためである(上記摘記事項ケ.の[0106])。そして、当該「個々の情報」に接した「第3者あるいは管理者」は、「個々の情報」から、「ユーザ」の「異常」を迅速に察知し、現場に通報して、「ユーザ」に対して何らかの適切な対応をしたいと思うことは、明らかである。
そして、引用文献1の上記摘記事項カ.の、
「[0055]通信部160は、各種外部装置400と通信する。具体的には、通信部160は、脳波の測定センサ110と環境情報センサ120の検出値を外部装置400に送信し、外部装置400からの各種信号を受信する。・・・
[0056]・・・ユーザが危険な状態にあるか否かは、制御部130によって、または外部装置400によって決定されてもよい。すなわち、制御部130は、脳波計測用センサ110の検出値と、環境情報センサ120の検出値、外部装置400から送信された制御信号等に基いて、振動子140および表示装置150の動作を制御する。・・・」という記載から、引用文献1には、検出した測定値を受信し、当該測定値に基いてユーザが危険な状態にあるか否か決定し、かつ、制御信号等を返信する「外部装置400」が記載されている。さらに、上記「外部装置400」のようにデータを受信し、当該データに基いて判断し、かつ、判断結果や制御信号を返信するというサービスが、外部装置400のコンピュータによって実行されていること、そして、「サーバ」とは、「ネットワーク上で他のコンピュータやソフト、すなわちクライアントにサービスを提供するコンピュータ-。」(「広辞苑 第六版」。)であることに鑑みれば、上記のような作用を奏する「外部装置400」はサーバであるといえる。
そうすると、引用発明において上記<相違点1>に係る本願発明の構成を備えたものとすることは、「ユーザ」の「異常」を「状態データ」から迅速に察知し、現場に通報しようとして、「Webサーバ」の機能を奏するコンンピュータを、「前記ユーザの健康状態を示す前記状態データに基づき、前記ユーザに健康異常が発生していると判断し健康異常の発生を示す異常データを前記外部管理装置200から前記受信部に無線送信する、」とのサービスを行うコンピュータである引用文献1に記載された「外部装置400」としたものであるに過ぎず、当業者が容易になし得た事項である。
また、本願発明が奏する作用及び効果も、当業者が予測し得る以上の格別なものであるとはいえない。
よって、本願発明は、引用発明に基づいて、当業者が容易に発明をすることができたものであるから、特許法第29条第2項の規定により特許を受けることができない。

第4 むすび
以上のとおり、本願発明は、特許法第29条第1項第3号の規定により、特許を受けることができない。
また、本願発明は、特許法第29条第2項の規定により特許を受けことができない。
したがって、他の請求項に係る発明について検討するまでもなく、本願は拒絶されるべきものである。

よって、結論のとおり審決する。
