理由 第1 手続の経緯
本願は、2013年6月18日(パリ条約による優先権主張外国庁受理2012年6月21日、米国(US))を国際出願日とする出願であって、その手続の経緯は、概略以下のとおりである。

第2 本願発明
令和元年12月19日提出の手続補正書により補正された特許請求の範囲の請求項1に係る発明(以下、「本願発明」という。)は、以下のとおりである。

「対象治療領域上に当てられ得る第1の防水フレキシブル層と、
第2の防水フレキシブル層と、
前記第1の防水フレキシブル層と前記第2の防水フレキシブル層との間の保冷性又は保温性を有するジェルと、
前記第1の防水フレキシブル層と前記第2の防水フレキシブル層との間のフレキシブル回路と、
生物の対象治療領域に治療効果を提供するための少なくとも1つの光源であって、前記フレキシブル回路に結合される、少なくとも1つの光源と、
外部電源が接続可能であり、前記外部電源から前記フレキシブル回路に給電するための防水コネクタと、を含む光線療法アセンブリであって、
前記第1の防水フレキシブル層及び前記第2の防水フレキシブル層はシールされて前記フレキシブル回路を包含する防水ジェルパックを提供し、
前記少なくとも1つの光源は前記ジェル及び前記第1の防水フレキシブル層を介して対象治療領域を照射し、
前記光源に電気的に結合される1つ又は複数のサーミスタが、前記フレキシブル回路に設けられ、前記光源のオンオフ制御をする、光線療法アセンブリ。」

第3 拒絶の理由
当審が通知した令和元年10月3日付け拒絶理由通知の理由Bのうち、本願発明に対する理由は、概略次のとおりである。
本願発明は、その出願(優先日)前日本国内又は外国において頒布された下記引用文献1?3に記載された発明に基いて、その出願(優先日)前にその発明の属する技術の分野における通常の知識を有する者が容易に発明をすることができたものであるから、特許法第29条第2項の規定により特許を受けることができない。

In the illustrated embodiment, the light sources 108 and portions of the conductive leads 128 are surface mounted on (e.g., electronically welded onto, etc.) a flexible lightweight ribbon cable 132, although other conductive leads and mounting methods are also possible.」([0059])

(9)「In the illustrated embodiment, the switching device 136 is a push button switch for switchably connecting the light sources 108 to the power source 124. As shown, the switch 136 is positioned within the container 104. The switch 136 can be coupled to an externally flexible surface portion 116 of the container 104 such that application of external pressure upon the externally flexible surface portion 116 activates the switch 136 thereby causing operation of the light sources 108. The external pressure may, for example, be applied by the user squeezing the container 104 at the externally flexible surface portion 116. The switch 136 may also allow the user to cycle through the various display modes or select a particular type of light (e.g., therapeutic light, colored light,etc.) to be emitted by the light sources 108 by successively squeezing the container 104 at about the externally flexible surface portion 116. Additionally, the switch 136 may also allow the user to dim or brighten the intensity of the light, for example, by holding down the switch 136 with continuously applied pressure to the container 104 at about the externally flexible surface portion 116.
Alternatively, the switch 136 may include one or more other suitableswitching devices or means including electrical terminals for switchably connecting the light sources to the power source when the electrical terminals are placed in contact with the user's body, motion-responsive switches, light-sensitive switches, temperature-sensitive switches, compression switches, voice activated switches, etc. For example, the switch may be a light-sensitive switch such that the light sources are activated when the ambient light level falls below a predetermined threshold.」([0061]?[0062])

As shown, the light sources 508, 608 can be positioned to direct therapeutic light 512, 612 generally toward a user's body when the massager 576, 676 is applying massage therapy (as represented by arrows 580,680) to a portion of the user's body, for example, to relieve sore muscles, etc. Accordingly, the therapeutic devices 500 and 600 can apply massage therapy and/or therapeutic light to a user's body generally simultaneously or at different times.

B.上記1.の(4),(5)の特に下線部の記載事項及び(13)の図示内容からすれば、引用文1記載の治療装置は、可撓性の容器104の空洞内の熱間/冷間ゲルを有している。

上記A?Fの認定を総合すれば、引用文献1には次の発明(以下、「引用発明」という。)が記載されているものと認められる。

5.引用文献2及び3の記載から導き出せる周知技術
A.上記3.(1),(2)の下線部の記載事項及び(3),(4)の図示内容並びに4.(1),(2)の下線部の記載事項及び(4)の図示内容からすれば、「光源をジェルに対して対象領域の反対側に配置し、光源からの光をジェルを介して対象領域に照射すること」は本願出願(優先日)前に周知技術(以下、「周知技術A」という。)であったといえる。

B.上記4.(3)の下線部の記載事項及び(4)の図示内容からすれば、「再充電可能な電池に外部電源を接続し、外部電源から給電して充電すること」は本願出願(優先日)前に周知技術(以下、「周知技術B」という。)であったといえる。

第5 対比
1.引用発明の「治療装置」は、光源から光を照射することにより治療を行うものであるから、本願発明の「光線療法アセンブリ」に相当する。そして、引用発明において、光源から光を照射するために「ユーザの身体の一部の周りに配置される」ことは、本願発明の「対象治療領域上に当てられ得る」ことを意味する。
2.本願発明の「防水ジェルパック」は、第1の防水フレキシブル層及び第2の防水フレキシブル層をシールして構成されるものであるから、引用発明の「可撓性の容器」と、「可撓性の容器」である点で一致する。
3.引用発明の「熱間/冷間ゲル」及び「リボン・ケーブル」は、機能及び構成上、本願発明の「保冷性又は保湿性を有するジェル」及び「フレキシブル回路」にそれぞれ相当する。
4.引用発明の「治癒プロセスの間に細胞活性を増加させるために人体組織へ刺激を提供することができる光源」は、光源からの光により人体組織へ刺激を提供し生物の対象治療領域に治療効果を提供しているといえるから、本願発明の「生物の対象治療領域に治療効果を提供するための少なくとも1つの光源」に相当する。
5.引用発明の光源はリボン・ケーブルに「表面実装」されている以上、当該光源とリボン・ケーブルは、「結合され」ているといえる。
6.引用発明の「再充電可能な電池」と本願発明の「外部電源が接続可能であり、前記外部電源から前記フレキシブル回路に給電するための防水コネクタ」は、「光源に給電する手段」という点で一致している。
7.サーミスタは、温度スイッチの一種であり、また、引用発明の「光源を電源に切り換え自在に接続する」ことは、機能及び構成上、「光源をオンオフ制御」することを意味する。

上記1?7の認定からすると、本願発明と引用発明は、以下の一致点及び相違点を有する。

【一致点】
対象治療領域上に当てられ得る可撓性の容器と、
前記可撓性の容器内の保冷性又は保温性を有するジェルと、
前記可撓性の容器内のフレキシブル回路と、
生物の対象治療領域に治療効果を提供するための少なくとも1つの光源であって、前記フレキシブル回路に結合される、少なくとも1つの光源と、
光源に給電する手段と、を含む光線療法アセンブリであって、
前記光源に電気的に結合される1つ又は複数の温度スイッチが、前記光源のオンオフ制御をする、光線療法アセンブリ。

【相違点】
1.可撓性の容器について、本願発明では、第1防水フレキシブル層と第2防水フレキシブル層をシールして構成され、第1防水フレキシブル層が対象治療領域上に当てられ得るのに対して、引用発明では、どのように構成されているのか不明である点

2.光源に給電する手段について、本願発明では、外部電源が接続可能であり、前記外部電源から前記フレキシブル回路に給電するための防水コネクタであるのに対して、引用発明では、再充電可能な電池である点。

3.光源が対象領域を照射するにあたって、本願発明では、少なくとも1つの光源はジェル及び第1の防水フレキシブル層を介するのに対して、引用発明1では、何を介するのか不明である点。

4.温度スイッチについて、本願発明では、サーミスタであり、フレキシブル回路に設けられているのに対して、引用発明では、何ら特定がない点。

第6 判断
1.相違点1について
内部に空間を有する可撓性の容器を製作するにあたって、2枚のフレキシブルなシートの縁部をシールして製作することは慣用手段にすぎず、引用発明の可撓性の容器の製作にあたって、当該慣用手段を採用することに格別の困難性は認められない。
また、本願発明において、第1の防水フレキシブル層と第2の防水フレキシブル層に構成上の相違はないから、対象治療領域上に当てられ得る側の防水フレキシブル層を第1の防水フレキシブル層としたことは設計的事項にすぎない。

2.相違点2について
光源に給電する手段として、引用発明は再充電可能な電池を採用しているところ、再充電可能な電池を外部電源から充電することは、周知の技術(上記周知技術Bを参照。)にすぎず、外部電源から充電する以上、コネクタを備えることは自明のことである。
そして、引用文献1の記載(上記第4の1.(5)参照。)によれば、引用発明は可撓性の容器104の加熱に熱水を用いることを意図しているのであるから、当該コネクタに周知の防水コネクタを採用することは当業者であれば容易に想到できることである。

3.相違点3について
引用文献1の記載(特に、図1)からでは、光源108と可撓性の容器104の位置関係が不明であり、光源108からの光がジェル及び第1の防水フレキシブル層を介して対象治療領域に照射されているのか否か明らかではない。
しかし、対象治療領域に光と熱を共に適用するに際して、光源を防水ジェルパックに対して対象治療領域の反対側に配置し、光源からの光をジェルおよび防水ジェルパックを介して照射するようにすることについては、当該引用文献1の図5記載の実施例において示唆がある(上記第4の1.(12),(14)参照。)。
また、そのような配置を採用し、光源からの光をジェルを介して対象領域に照射する構成は周知の技術(上記周知技術Aを参照。)であり、その採用に困難性は認められない。

4.相違点4について
温度スイッチとしてサーミスタは、例示するまでもなく周知の技術にすぎず、その採用に困難性は認められない。また、サーミスタのような温度スイッチは、通常、電子素子として構成されるものであることからすれば、光源と同じリボン・ケーブル(フレキシブル回路)に設けるようにすることは当業者であれば容易になし得る設計的事項にすぎない。

そして、本願発明の作用効果も、引用発明及び上記の周知の技術から当業者が予測し得る程度のものであって、格別のものとはいえない。

第7 むすび
以上のとおり、本願発明は、引用発明及び上記の周知の技術に基いて、当業者が容易に発明をすることができたものであるから、特許法第29条第2項の規定により特許を受けることができない。
したがって、他の請求項に係る発明について検討するまでもなく、本願は拒絶されるべきものである。

よって、結論のとおり審決する。
