理由 第1 手続の経緯

本願は,2011年(平成23年)12月23日(優先権主張 2011年(平成23年)8月24日 米国)を国際出願日とする出願であって,平成26年2月18日付けで手続補正書が提出され,同年7月24日付けで手続補正書が提出され,同年11月14日付けで拒絶理由が通知され,平成27年2月9日付けで意見書とともに手続補正書が提出され,同月26日付けで拒絶査定され,同年7月2日に拒絶査定不服審判が請求されるのと同時に手続補正され,同年8月10日付けで前置報告書が作成され,平成28年7月13日付けで拒絶理由を当審から通知し,同年12月16日付けで意見書とともに手続補正書が提出されたものである。


第2 当審拒絶理由及び本願発明

1.当審拒絶理由について
(1) 当審拒絶理由の概要
平成28年7月13日付けで当審から通知した拒絶理由(以下「当審拒絶理由」)という。)の概要は次のとおりである。

理由
(明確性)この出願は、特許請求の範囲の記載が下記の点で、特許法第36条第6項第2号に規定する要件を満たしていない。

○ 請求項3,6,9,12,15及び18(平成27年7月2日付け手続補正書による)について

請求項3の記載では,「アンテナ」の接続構成が明確でない。

<補正等の示唆>
平成28年7月11日にファクシミリにより提出した案のように補正することによって,上記の拒絶の理由は解消する。

(2) 当審拒絶理由に関する検討及び判断
平成28年12月16日付けの手続補正により,特許請求の範囲は補正され,次のとおりとなった。(下線は請求人が付与。)

該手続補正により,本願の請求項3,6,9,12,15及び18における記載は明確となった。

2.本願発明
上記1.のとおりであるから,本願の請求項1から18に係る発明は,平成28年12月16日付け手続補正書の特許請求の範囲の請求項1から18に記載された事項により特定されるとおりのものである。(上記1.(2)参照。)

そして,以下において,請求項に係る発明を,請求項の番号に従って,「本願第1発明」などといい,「本願第1発明」から「本願第18発明」を併せて「本願発明」という。


第3 原査定の理由について

1.原査定の理由の概要
(1) 原査定の概要
この出願については、平成26年11月14日付け拒絶理由通知書に記載した理由1のうち特許法第36条第6項第2項違背,理由2によって、拒絶をすべきものです。

理由1のうち特許法第36条第6項第2項違背について:
平成27年2月9日付け手続補正された請求項1,4,7,10,13,16(及びこれらを引用する請求項2-3,5-6,8-9,11-12,14-15,17-18)においては、上記理由1において示した、
「動作中、前記無線通信は、1メガヘルツの帯域幅を有し、直交周波数分割多重を使用し、前記反復したショート・トレーニング・フィールド及び前記反復したロング・トレーニング・フィールドは前記1メガヘルツの帯域幅における検出を可能にする」ための技術事項が請求項においては不明である。
平成27年2月9日付け意見書の2.(理由1)における、
「補正後の請求項1、4、7、10、13、及び16の当該記載は、例えば、本願明細書段落0005、0014、0015、0030、0025、0035、及び0039等の記載に対応しています。」
という主張は、何ら上記理由の解消に寄与していない。

理由2について:
上記手続補正された請求項1,4,7,10,13,16(及びこれらを引用する請求項2-3,5-6,8-9,11-12,14-15,17-18)について、
本願における「1メガヘルツの帯域幅」は、本願が明細書段落0005,0019にあるように、IEEE 802.11ahに関連するものであり、「1ギガヘルツの帯域幅」の誤記であることを踏まえると、先願(特願2014-505407号(特表2014-511094号)ただし、該出願の優先権主張の基礎となる米国特許仮出願61/475814号(内容はhttp://mirror.patentscope.wipo.int/patentscope/docservicepdf_pct_mirror/id00000018920148.pdf)のものが、やはり802.11ahに関するものであることから、1ギガヘルツ帯におけるOFDMを用いることを踏まえると、
「動作中、無線通信は、1ギガヘルツの帯域幅を有し、直交周波数分割多重(OFDM)を使用し、前記反復したショート・トレーニング・フィールド及び前記反復したロング・トレーニング・フィールドは前記1ギガヘルツの帯域幅における検出を可能に」するものであり、
さらに、下記文献のスライド4のBPSK 1/2 rate codedにあるように、変調タイプとして
「プリアンブル及びデータ・フィールドは2値位相シフト・キーイングに応じて変調され、プリアンブル及びデータ・フィールドは1/2の符号化率で符号化」されることもIEEE 802.11ahの技術的前提にすぎないことを踏まえると、本願発明と上記先願発明は実質的に同一の発明である。

(2) 平成26年11月14日付け拒絶理由の概要
理 由
1.この出願は、特許請求の範囲の記載が下記の点で、特許法第36条第6項第1,2号に規定する要件を満たしていない。
2.この出願の下記の請求項に係る発明は、その出願の日前の外国語特許出願(特許法第184条の4第3項の規定により取り下げられたものとみなされたものを除く。)であって、その出願後に国際公開がされた下記の外国語特許出願の国際出願日における国際出願の明細書、請求の範囲又は図面に記載された発明と同一であり、しかも、この出願の発明者がその出願前の外国語特許出願に係る上記の発明をした者と同一ではなく、またこの出願の時において、その出願人が上記外国語特許出願の出願人と同一でもないので、特許法第29条の2の規定により、特許を受けることができない(同法第184条の13参照)。

平成26年7月24日付け手続補正された請求項(以下請求項)1,4,7,10,13,16について:
「動作中、前記無線通信は、1メガヘルツの帯域幅を有し、直交周波数分割多重を使用し、前記反復したショート・トレーニング・フィールド及び前記反復したロング・トレーニング・フィールドは前記1メガヘルツの帯域幅における検出を可能にする」(特に下線部)ための技術事項が請求項においては不明であるとともに、明細書の発明の詳細な説明中の裏付けを欠く。
上記請求項を引用する請求項2-3,5-6,8-9,11-12,14-15,17-18についても同様。

2.原査定の理由に関する当審の判断
(1) 原査定の理由1(36条6項2号)について
ア 原査定の理由1に対する請求人の主張
原査定の理由のうち,本願が特許法第36条第6項第2号に規定にする要件を満たしていないとされた点に対し,請求人は,審判請求書及び平成27年2月9日付け意見書(以下,単に「意見書」という。)において,本願明細書段落0005,0014,0015,0030,0025,0035,及び0039等の記載によって解消される旨主張していると解される。

そこで,本願明細書の【0005】,【0014】,【0015】,【0025】,【0030】,【0035】,及び【0039】における記載を確認する。(下線は当審が付与。)

【0005】
IEEE802.11ah作業グループは、1GHz以下の帯域で動作する直交周波数分割多重(OFDM)システムを提供するために最近、編成されている。IEEE802.11ah作業グループの目標の1つは、(例えば、長距離センサ用の)長距離、低データ速度サービスを含む、特定の基準を充足する新たな機能を有するIEEE802.11n/acシステムを再使用することである。したがって、約1乃至16MHzの帯域を有するシステムが、IEEE802.11ahに使用するために検討されている。前述の帯域は、IEEE802.11acシステムのダウンクロックを行うことによって提供し得る。しかし、IEEE802.11acPHY構造に対する更なる修正なしで、サービスを提供するための要件の全てを充足し得る訳でない。

【0014】
本発明の特定の実施例は、特定の無線通信プロトコルに関連付けられた受信及び検出のために、オープン・システム相互接続モデル(OSIモデル)内の新たな物理層実現(PHY)構造をイネーブルし得る。例示的な実施例により、例えば、インターネットに対する長距離センサの無線接続において使用するための、特定の増加距離の要件に対応し得る。例示的な実施例により、例えば、バッテリを電源とする装置との無線通信のための低減された電力の要件に対応し得る。例示的な実施例によれば、IEEE802.11ahに関連付けられた特定の要件の目標に対応し得る。例示的な実施例は、IEEE802.11ah技術仕様の長距離部分の新たなプリアンブル構造を含み得る。例示的な実施例は、特定のハードウェアの再使用又は再目的化を可能にし得る。
【0015】
例示的な実施例は、より低いクロック速度を供給するようIEEE802.11acPHYを修正し得る。しかし、IEEE802.11ac技術仕様によれば、PHY構造は、より長い距離における装置を検知するために十分長いプリアンブルを含まないことがあり得る。ペイロードのデータ部分を単純に繰り返しても、受信器が適切に機能することを可能にしないことがあり得る。プリアンブルが、高品質の獲得、タイミング、及びチャネル推定のために十分長くないことがあり得るからである。(符号分割多元アクセスなどの)スペクトラム拡散技術を使用することにより、より低いクロック速度において、獲得、タイミング、及びチャネル推定に対する特定の便益が提供され得るが、前述の技術は、異なるPHYを必要とし得、IEEE802.1ahの他のモードに要求され得るOFDMハードウェアの完全な再使用を可能にしないことがあり得る。

【0025】
例示的な実施例によれば、特定のレガシー・フィールドは、特定のシグナリングの場合に新たな低速度PHYにおいて保持される必要がある情報を含み得る。例えば、変調及び符号化手法(MCS)シグナリング及びデータ・レート・シグナリングは、新たなPHY構造において伝達する必要があり得る。例示的な実施例によれば、低速PHYは、2つのMCS(すなわち、BPSK及びQPSK。何れも符号化率1/2を使用)を伝達する必要があり得るに過ぎない。よって、例示的な実施例によれば、2つのモードのみを検出し、又は受信器に通知する必要があり得る。例示的な実施例によれば、現在のIEEE802.11acフィールドはできる限り再使用し得る。例示的な実施例によれば、LR-LTF及び/又はLR-STFの反復に、オーバレイ系列が必要であり得る。例えば、低速モードの距離要件が、4個の反復が必要なようなものである場合、例示的な実施例により、BPSKモードはL-LTFを反復し、4つのL-LTF系列を送出し得る。同様に、例示的な実施例によれば、BPSKモードは、L-STFを反復し、4つのL-LTF系列を反復し得る。本実施例の例を図4に表す。

もう一度、図4乃至図7を参照するに、かつ、例示的実施例によるに、L-STF及び/又はL-LTFフィールドは、単一のインスタンスを含むか、又は、距離要件を充足するために必要に応じて反復し得る。

In the time domain, transmission of data is separated into set time segments 804, which may be referred to as OFDM symbols. In a given time segment 804, transmission of data is separated into blocks of frequency ranges 802, which may be referred to as tones. Therefore, a time segment 804 may comprise a plurality of frequency ranges 802. In one aspect, repetition of portions of a packet in the frequency domain is performed as follows. In one aspect, repetition in the frequency-domain may be used for any field type of a packet. In another aspect, repetition in the frequency-domain may be limited to the SIG fields and/or payload.

Increasing the repetition of portions of a packet, while keeping transmission power constant, can increase the SNR of the received signal. Other techniques used to boost SNR include using different modulation techniques for modulating the packet to be sent. In one aspect, one parameter of such modulation that may be adjusted is a rate of modulation for a packet. In one aspect, a wireless device 202 may modify the number of times a portion of a packet is repeated based on at least one characteristic (e.g., SNR, carrier to interference (C/I) ratio, signal to interference-plus-noise ratio (SINR), etc.) of a communication channel over which the wireless device 202 transmits the packet. 普及しているワイヤレスネットワーク技術は、様々なタイプのワイヤレスローカルエリアネットワーク(WLAN)を含み得る。WLANは、広く使われるネットワークプロトコルを利用して、近くのデバイスを一緒に相互接続するのに使われ得る。本明細書に記載する様々な態様は、WiFiなど、どの通信規格、または、より全般的には、ワイヤレスプロトコルのIEEE802.11群のうちどのメンバーにも応用することができる。たとえば、本明細書に記載する様々な態様は、サブ1GHz帯域を使うIEEE802.11ahプロトコルの一部として使われ得る。(【0024】)

いくつかの態様において、サブギガヘルツ帯域内のワイヤレス信号は、直交周波数分割多重化(OFDM)を使う802.11ahプロトコルに従って送信することができる。802.11ahプロトコルの実装形態は、センサ、計測、およびスマートグリッドネットワーク用に使われ得る。有利には、802.11ahプロトコルを実装するいくつかのデバイスの態様は、他のワイヤレスプロトコルに対して、バッテリー寿命の増加を受ける場合があり、かつ比較的長いレンジ、たとえば、約1キロメートル以上にわたってワイヤレス信号を送信するのに使われ得る。(【0025】)

図6は、パケット600の例を示す。パケット600は、ワイヤレスデバイス202とともに使用するための物理(PHY)レイヤパケットまたはフレームを含んでよく、パケット600のいくつかのフィールドは、ロングレンジ通信において使うために反復される。パケット500と同様に、パケット600は、プリアンブル610およびペイロード620を含み得る。プリアンブル610は、トレーニングフィールドおよび信号(SIG)フィールド616を含み得る。さらに、パケット500のように、トレーニングフィールドは、ショートトレーニングフィールド(STF)612と、それに続くロングトレーニングフィールド(LTF)614を含み得る。(【0064】)

パケット600中のフィールドの反復は、ワイヤレスデバイス202によって送られるべきデータの処理におけるいくつかの段階のうちのどの1つにおいても実施することができる。たとえば、図3を参照して上述したように、ワイヤレスデバイス202によって送信されるべきビットは、変調器302によって変調されて、シンボルまたは場合によっては変調ビットが形成される。シンボルまたは場合によっては変調ビットは次いで、たとえば変換モジュール304によって、時間領域、たとえばOFDMシンボルに変換される。したがって、一態様では、フィールドの反復はビットレベルで実施することができ、このことは、所与のフィールドを構成するビットが、変調器302を通る前に反復されてよいことを意味する。別の態様では、所与のフィールドを構成するビットが変調器302によって最初に変調されてシンボルを形成してよく、シンボル自体が反復され得る。さらに別の態様では、所与のフィールドを構成するビットは、シンボルを形成するように変調されてよく、シンボルは時間領域に変換されてよく、変換された出力が次いで、反復されてよい。同様の態様において、OFDMシンボルなどの変換された出力が反復されてよいが、正確なコピーを反復するのではなく、各コピーは循環OFDMシンボルでよく、または信号中のトーンの順序は各コピーに対して変えてよい。したがって、パケット600中のフィールドの反復は、パケットの処理におけるどの適切な段階で起こってもよいことが認識されよう。(【0066】)

一態様では、STFフィールド612および/またはLTFフィールド614が反復される。一態様では、STFフィールド612とLTFフィールド614のいずれかまたは両方を反復するとき、同じデータが、パケット600中で複数回コピーされる。したがって、各々がそれぞれのフィールドタイプコピーとして同じデータを有する複数のSTFフィールド612および/またはLTFフィールド614が存在し得る。別の態様では、STFフィールド612とLTFフィールド614のいずれかまたは両方の各コピー中で、異なるシーケンスが使われる。異なるシーケンスを使うこれらのコピーが組み合わされると、処理利得が増大した長いシーケンスを形成することができ、その結果、SNRが本質的に高められる。たとえば、STFフィールド612が、異なるシーケンスでK回反復される場合、結果として得られる長いシーケンスは、処理利得がK倍になり、したがって、単一のSTFフィールド612としてはSNRがK倍になり得る。(【0067】)

図7は、時間領域におけるパケット700のフィールドの反復を示す。時間領域における反復には、異なる時間に、同じ周波数レンジまたは複数のレンジにわたってフィールドを送信することが必要である。パケット700は、パケット600と同様であってよい。図示するように、パケット700の部分は、同じ周波数レンジを占有しながら、時間的に反復される。一態様では、時間領域における反復は、パケット700のどのフィールドタイプに対しても使うことができる。(【0070】)

図8は、周波数領域内のパケットのフィールドの反復を示す。図示するように、データパケットは、時間と、異なる周波数の両方にわたって送信することができる。時間領域において、データの送信は、OFDMシンボルと呼ばれ得るセット時間セグメント804に分離される。所与の時間セグメント804において、データの送信は、トーンと呼ばれ得る周波数レンジ802のブロックに分離される。したがって、時間セグメント804は、複数の周波数レンジ802を含むことができる。一態様では、周波数領域におけるパケットの部分の反復は、次のように実施される。所与の時間セグメント804における利用可能な周波数レンジ802は、K個のグループに分割され、Kは、パケットのある部分が反復されるべき回数を表す。周波数レンジ802のグループは連続してもよく、グループは互いとインターリーブされてもよい。さらに、反復されるべきパケットの部分のコピーは次いで、K個のグループの各々の中に置かれる。受信機は次いで、パケットの1つまたは複数の反復部分のK個のコピーを受信し、SNRを高めるように建設的に組み合わせることができる。いくつかの態様において、同じデータを送信するのに、複数の周波数レンジ802が使われるので、パケット中で送られるべき固有のデータの量のほぼ1/Kに等しい部分のみが、所与の時間セグメント804中で送信される。反復されない場合、パケット全体が、単一の時間セグメント804中で送られ得る。したがって、データパケット全体を送信するのに、K個の時間セグメント804を必要とし得る。一態様では、周波数領域における反復は、パケットのどのフィールドタイプに対しても使うことができる。別の態様では、周波数領域における反復は、SIGフィールドおよび/またはペイロードに限定してよい。(【0071】)

送信電力を一定に保ちながら、パケットの部分の反復を増やすと、受信信号のSNRを高めることができる。SNRを高めるのに使われる他の技法は、送られるべきパケットを変調するための異なる変調技法の使用を含む。一態様では、調整することができる、そのような変調の1つのパラメータは、パケット用の変調レートである。たとえば、QAM変調では、64QAM、32QAM、QPSK、およびBPSKなど、異なるレートを使うことができる。64QAM変調方式は、32QAM変調方式よりも高いレートをもち、これは、シンボルごとにより多くのビットが送信されることを意味する。異なるレートのシンボルが同じ電力レベルで送信される場合、変調レートが高い程、シンボル中で送られるビットの間で電力が分割されるので、受信されるパケットの部分に対してSNRが低くなる。したがって、送信電力を一定に保ちながら変調レートを低下させると、受信信号のSNRを高めることができる。(【0072】)

一態様では、ワイヤレスデバイス202は、ワイヤレスデバイス202がパケットを送信するための通信チャネルの少なくとも1つの特性(たとえば、SNR、キャリア対干渉(C/I)比、信号対干渉雑音比(SINR)など)に基づいて、パケットの部分が反復される回数を修正することができる。たとえば、ワイヤレスデバイス202は、ワイヤレスデバイス202からデータを受信する別のデバイスにおけるチャネル特性に関する情報を判断することができる。一態様では、そのチャネル特性についての情報が、受信機において信号が正しくデコードされ得ない(たとえば、SNRが低すぎる)ことを示す場合、送信機は、パケットの部分が反復される回数を増やし、かつ/またはパケットの部分が変調されるレートを低くすればよい。別の態様では、そのチャネル特性についての情報が、受信機において信号が正しくデコードされ得る(たとえば、SNRが十分に高い)ことを示すが、信号が、デコードするのに必要とされるよりも強いことも示す場合、送信機は、同じ量の通信リソース(たとえば、時間セグメント、周波数レンジなど)を使ってより多くのデータを転送することができるように、パケットの部分が反復される回数を減らし、かつ/またはパケットの部分が変調されるレートを上げればよい。一態様では、ワイヤレスデバイス202は、パケット中でデータが反復される回数を調整する前に、データパケットの変調レートを調整することができる。たとえば、ワイヤレスデバイス202は、レートを、必要に応じて、最も低いサポートレート(たとえば、BPSK)に調整することができ、信号が依然として正しくデコードされ得ない場合にのみ、ワイヤレスデバイス202は、パケット中でデータが反復される回数を調整することができる。同様に、信号品質が向上すると、レートが増大する前にデータの反復を減少させることができる。(【0073】)
[0085]<0086>
一態様では、ワイヤレスデバイス202は、データパケットが送信されているデバイスからチャネル特性についての情報を受信することによって、チャネル特性についての情報を判断することができる。あるいは、ワイヤレスデバイス202は、そのような情報を、データパケットが送信されているワイヤレスデバイス202および/またはデバイスが通信するネットワーク構成要素など、別のソースから受信することができる。(【0074】)

キ 原査定の理由2に関する当審の判断
上記優先基礎出願記載事項1及び2から導き得る発明(以下「先願発明」という。)と本願第1発明とを比較すると,本願第1発明においては,「動作中,無線通信は,1メガヘルツの帯域幅を有し」との発明特定事項を備えるのに対して,先願発明においては,そのような帯域幅についての特定がない点で,少なくとも相違する。

したがって,本願第1発明が,優先基礎出願の明細書に記載された発明と同一であるということはできない。

また,本願第4発明,本願第7発明,本願第10発明,本願第13発明,及び本願第16発明についても,同様に,優先基礎出願の明細書に記載された発明と同一であるということはできない。
そして,本願第2発明及び本願第3発明は本願第1発明を直接的若しくは間接的に引用する発明であり,本願第5発明及び本願第6発明は本願第4発明を直接的若しくは間接的に引用する発明であり,本願第8発明及び本願第9発明は本願第7発明を直接的若しくは間接的に引用する発明であり,本願第11発明及び本願第12発明は本願第10発明を直接的若しくは間接的に引用する発明であり,本願第14発明及び本願第15発明は本願第13発明を直接的若しくは間接的に引用する発明であり,本願第17発明及び本願第18発明は本願第16発明を直接的若しくは間接的に引用する発明であるから,同様に,優先基礎出願の明細書に記載された発明と同一であるということはできない。

ク 原査定の理由に関するまとめ
以上のとおりであるから,上記優先基礎出願を特許法第41条にいう「先の出願」とし,同条第3項の規定により同法第29条の2本文を適用し,本願発明を,特許法第184条の13による同法第29条の2の規定により特許を受けることができないものであるということはできない。

(3) 前置報告書記載事項について
ア 前置報告の概要
平成27年8月10日付け前置報告書(以下「前置報告書」という。)においては,次の事項が報告(以下「前置報告」という。)された。

この審判請求に係る出願については、下記のとおり報告します。

補正後の請求項1には、「前記プリアンブルは信号フィールドも含み、
前記無線通信の前記1メガヘルツの帯域幅において、前記信号フィールドは、送信されるときに、第1の期間を有し、かつ、
前記1メガヘルツの帯域幅より大きい前記無線通信の他の帯域幅において、前記信号フィールドは、前記第1の期間に比べて減少した第2の期間を有する」という記載があるが、当該記載は新規事項の追加に該当する。
出願人は審判請求書にて、当該補正の根拠として本願出願当初明細書[0016]?[0019]、[0028]?[0029]を挙げている。
しかしながら、当該補正の根拠を検討しても、1メガヘルツの帯域幅を基準として、信号フィールドの期間を変更することは記載されていない。また、本願出願当初明細書及び図面(以下、当初明細書等とする。)の他の記載を参照しても1メガヘルツの帯域幅を基準として信号フィールドの期間を変更することは記載されておらず、このことが当初明細書等の記載から当業者に自明のことともいえない。
したがって、この補正は、願書に最初に添付した明細書、特許請求の範囲又は図面に記載した事項の範囲内においてしたものでなく、特許法第17条の2第3項の規定に違反するものであるから、同法第159条第1項において読み替えて準用する同法第53条第1項の規定により却下されるべきものである。
そして、この出願は原査定の理由に示したとおり拒絶されるべきものである。

なお、原査定で示される先願(特願2014-505407号(PCT/US2012/033834、WO2012/142612、特表2014-511094号(必要に応じて米国特許仮出願61/475814号参照))には、ah規格の一部として使用する際に、SIGを反復することについても言及(米国特許仮出願61/475814号の FIG.6, [0072]-[0081]、国際公開第2012/142612号の FIG.6, [0073]-[0082] 参照)があることから、先願においても、IEEE802.11ah規格に沿って通信を行う際には、信号フィールドを反復することで、ah規格に沿って通信を行わない場合と比べて信号フィールドが長くなるものといえる。

イ 前置報告に関する当審の判断
本願の明細書【0019】には「単純にダウンクロッキングされたIEEE802.11acシステムと比較して、オーバヘッドにおけるかなりの削減を本発明の例示的な実施例によって達成し得る。更に、L-SIG106後にフィールドを除外するようIEEE802.11acシステムが修正された場合、本発明の例示的な実施例において4*8*4=128sの削減という更なる効果を実現し得る。」との事項が記載されている(以下「本願明細書記載事項[あ]」という。)。

本願明細書記載事項[あ]を,審判請求書における記載及び請求項1の記載で照らすと,上記本願明細書記載事項[あ]における「128sの削減」が請求項1に記載された「前記第1の期間に比べて減少した第2の期間」に相当すると解することができる。
ここで,該「第1の期間」は,前記無線通信の前記1メガヘルツの帯域幅において,前記信号フィールドが送信されるときに有する期間であることは,請求項1における記載から明白である。
このことから,本願の明細書における記載全体からみて,上記「第1の期間」がIEEE802.11ahシステムにおいて,信号フィールドが送信されるときに有する期間を意味していると解することができる。

そして,本願明細書【0005】における「約1乃至16MHzの帯域を有するシステムが、IEEE802.11ahに使用するために検討されている。前述の帯域は、IEEE802.11acシステムのダウンクロックを行うことによって提供し得る。」との記載等があり,さらに「IEEE802.11acシステム」における「帯域幅」が「約1乃至16MHz」よりも「大きい帯域幅」を使用することが,本願の優先権主張日より前において,例を示すまでもなく周知であった。

以上のことを総合すると,本願明細書には,「IEEE802.11ahの1メガヘルツの帯域幅において,信号フィールドは,送信されるときに,第1の期間を有し,かつ,前記1メガヘルツの帯域幅より大きいIEEE802.11acの帯域幅において,前記信号フィールドは,第1の期間に比べて(128s)減少した第2の期間を有する」との事項が記載されている,若しくは記載されているに等しいということができる。

ウ 前置報告書記載事項についてのまとめ
したがって,「前記プリアンブルは信号フィールドも含み、
前記無線通信の前記1メガヘルツの帯域幅において、前記信号フィールドは、送信されるときに、第1の期間を有し、かつ、
前記1メガヘルツの帯域幅より大きい前記無線通信の他の帯域幅において、前記信号フィールドは、前記第1の期間に比べて減少した第2の期間を有する」との事項は,新たな技術的事項には当たらない。

(4) 原査定の理由1及び2に関するまとめ
上記(1)から(3)に述べたとおりであるから,原査定の理由によって,本願を拒絶することはできない。

以上のとおりであるから,原査定の理由によって,本願を拒絶することはできない。
また,ほかに,本願を拒絶すべき理由を発見しない。
