事件の表示 特願2007-520444号「治療媒体送出装置およびその送出装置を用いて治療媒体を眼に送り出す方法」拒絶査定不服審判事件〔平成18年 2月 9日国際公開、WO2006/014434、平成20年 2月21日国内公表、特表2008-504938号〕について、次のとおり審決する。 
結論 本件審判の請求は、成り立たない。 
理由 1.手続の経緯
本願は、平成17年7月1日(パリ条約による優先権主張 2004年7月2日 アメリカ合衆国)を国際出願日とする出願であって、平成22年8月18日付けで拒絶の理由が通知され、その指定期間内である同年11月18日に意見書及び手続補正書が提出されたが、平成23年3月29日付けで最後の拒絶理由が通知され、その指定期間内である同年8月30日に意見書及び手続補正書が提出されたが、平成24年2月10日付けで、平成23年8月30日付け手続補正書による補正の却下の決定がなされるとともに、同日付けで最後の拒絶理由が通知され、その指定期間内である同年5月14日に意見書が提出されたが、同年10月29日付けで拒絶査定がなされた。これに対し、平成25年2月27日に拒絶査定不服審判の請求がなされたものである。

2.本願発明
本願の請求項1に係る発明(以下「本願発明」という。)は、平成22年11月18日付け手続補正書によって補正された特許請求の範囲の請求項1に記載された事項により特定される次のとおりのものである。
「哺乳動物の眼の涙点に挿入し、該眼の涙小管によって保持されるように構成された第1の部分と、
前記第1の部分に保持又は支持された第2の部分であって、少なくとも部分的な封入ジャケット又はコーティングを備え、治療媒体を搬送し、該治療媒体を前記眼に対して放出するように構成された前記第2の部分と、を備え、
前記第1の部分が前記涙小管によって保持されるときに、前記第2の部分の外周は前記涙点上又は前記涙点の外表面に位置するように形成されていることを特徴とする装置。」

3.引用刊行物
原査定の理由に引用された、本願優先権主張日前に頒布された刊行物である米国特許第3949750号明細書(以下「引用刊行物1」という。)には、図面とともに、以下の事項が記載されている。( 『』内の訳文は、当審における仮訳である。)

(ア)「This invention relates to a punctum plug for removably closing the punctal openings of the eye and a method for treating keratoconjunctivitis sicca and other ophthalmic ailments using the plug as a means for preventing drainage of the lacrimal fluid from the eye or as a carrier vehicle for storing and delivering medication to the eye.」『本発明は、眼の涙点開口部を着脱自在に閉鎖する涙点プラグ及び眼から涙液の排出を防止するための手段として、または眼に薬を蓄えたり搬送する搬送媒体としてプラグを用いて乾性角結膜炎及び他の眼科疾患を治療するための方法に関する。』(明細書第1欄第6行?11行)
(イ)「The present invention is directed to a plug for removably blocking the punctal opening and associated canaliculus for preventing the drainage of lacrimal fluid from the eye and/or for delivering topical ophthalmic medications thereto. The plug, which can be utilized to close the upper as well as the lower punctal opening although the latter is usually preferred, is comprised of three portions: (1) a projecting tip or barb portion which dilates and blockingly protrudes into the vertical portion of the canaliculus, (2) a middle body or waist portion of smaller diameter around which the punctal sphincter ring tightens, and (3) a larger smooth head portion that sits on top of the punctal opening. 」『本発明は、涙液の排出を防止するため及び/またはそれに局所点眼薬を送達するため涙点開口部と関連細管を着脱自在に遮断するプラグを対象とする。涙点プラグは、上部涙点開口部と下部涙点開口部とに使用できるが、後者への使用が通常好ましいが、プラグは3つの部分、(1)涙点開口部の垂直部分に挿入されて広げる突起先端部又は棘部(2)涙点括約筋リングがその周りで締め付ける小径の中間部や腰部分(3)涙点開口部の先端に取り付けられる拡大された円滑なヘッド部、から構成されている。』(明細書第1欄第62行?第2欄第6行)
(ウ)「Referring to FIG. 1, there is shown a representation of the human eye anatomy and the associated lacrimal excretory system. For purposes of the present discussion it will be sufficient to focus on the latter which consists of the upper and lower lacrimal ducts 10 and 12, better known as the canaliculae, and the tear or lacrimal sac 14. ・・・
As previously recited, in the treatment of keratoconjunctivitis sicca and other ophthalmic ailments where it is desired to prevent or decrease the drainage of lacrimal fluid and/or medication from the eye, the punctal aperture in either or both of the upper and lower lids are to be blocked by a removable plug member 20, two respective embodiments of which are shown in FIGS. 2A and 2B. Referring initially to the embodiment of FIG. 2A, the punctum plug 20 has an axial length of approximately 3.2 mm and consists of three portions; a projecting tip or barb portion 22, a middle neck or waist portion 24 of somewhat smaller diameter than the tip, and a smooth disc-like head portion 26 of relatively larger diameter. The plug embodiment 20' of FIG. 2B is of generally similar dimensions to the first-described embodiment with a somewhat blunted tip or barb portion 22', a cylindrical middle portion 24' of substantially the same dimension, and a dome-shaped head portion 26' of somewhat smaller diameter than its counterpart in the embodiment of FIG. 2A. The head portion 26, 26' of both embodiments may be provided, if desired as an alternative to grasping it with forceps, with a central bore opening 28, 28' adapted to receive the projecting tip of an inserter tool to provide a releasable grip on the plug as it is manipulated for insertion, as hereinafter described.」『図1には、人間の目の解剖学的構造および関連涙液排泄システムが示されている。本議論の目的のためには、後者に焦点が当てられ、涙小管として知られている上部及び下部涙小管10及び12と、涙液又は涙嚢14から構成される・・・。
先に列挙したように、乾性角結膜炎及び他の眼科疾患の治療において、その際、眼から涙液及び/または薬剤の排出を防止または減少させることが望まれるが、上部及び下部瞼のいずれか、または両方の涙点開口を遮断する、着脱自在なプラグ部材20による2つの各実施形態は、図2Aおよび図2Bに示されている。図2Aの実施形態を最初に参照する。涙点プラグ20は、約3.2ミリメートルの軸方向の長さを有し、突起先端部または棘部22と、先端よりやや小さい直径の中間部や腰部分24と、滑らかな円盤状の比較的大きな直径のヘッド部26の3つの部分で構成されている。図2Bの実施形態のプラグ20 'は、多少平滑化先端部又は棘部22 '、筒状中間部24'は、実質的に同じ寸法のが第一実施形態に概ね同様の寸法のものであり、図2Aの実施形態のものよりやや小さい直径のドーム状のヘッド部26 'で構成されている。両実施形態のヘッド部26,26 'は、解放可能なグリップを提供するためにインサータ工具の突起先端を受けいれるように、鉗子でそれを把持する代わりに、所望の場合は、中央開口部28,28 ' が設けられ、後述するようにそれは、挿入のために操作されるようになっている。』(明細書第3欄第41行?第4欄第23行)
(エ)「The projecting tip or barb portion 22, 22' of the respective embodiments of the punctum plug is designed with either a tapered 22a or semi-tapered tip 22a' for further dilation and ease of insertion into the punctal opening. The tip portion 22, 22' is flared back to a somewhat larger base 22b, 22b', typically 1.2-1.4 mm in diameter, and then narrows down to a waist or neck portion 24, 24' of a somewhat smaller diameter, typically 0.7-0.8 mm. The distended vertical canaliculus 12a and the punctal sphincter ring 13a (FIG. 3A) tightens upon the respective tip and waist portions of the plug to firmly secure it from accidental extrusion. The head portion 26, 26' of the respective plug embodiments is sufficiently large, approximately 1.5-2.0 mm in diameter, as it rests on the punctal opening so as to prevent the plug from passing down into the canaliculus. The plug head is very smooth and of disc or dome shape which allows it to rest in the lacrimal lake and against conjunctivae and cornea with very little resultant irritation.
In certain embodiments of the invention the plugs 20, 20', particularly the head portion 28, 28', may be of medication-impregnable porous material such as HEMA hydrophilic polymer, or may be otherwise adapted as with capillaries or the like, to store and slowly dispense ophthalmic drugs to the eye as they are leached out by the lacrimal fluids.」『涙点プラグの各実施の形態において突出した先端部又は棘部22,22 'は、涙点開口部をさらに拡張し、挿入を容易にするために、テーパー部22aまたは半先端テーパ部22a'のいずれかで設計されている。典型的には、先端部22,22 'は幾分大きいベース部22b、22b'で戻って広がっていって、直径は典型的には1.2-1.4mmで、次いでやや小さい0.7 -0.8mmの直径の腰部や首部24,24 'で絞り込まれている。膨張垂直細管12aと涙点括約筋リング13A(図3A)がしっかりと、偶発的な押し出しを防ぐために、プラグの先端部と腰部分をそれぞれ拘束する。プラグが小管を通過することを防止するためにプラグが涙点開口部上に載るように各プラグ実施形態のヘッド部26,26 'は、直径約1.5-2.0mmで十分に大きくなっている。プラグヘッドは非常に滑らかで、涙湖に置くことができ、結膜や角膜に対して刺激の少ないディスク又はドーム形である。

(オ)「The plug itself is placed in the punctal opening with conventional forceps or with the aid of a special inserter tool 40 which, as shown in FIGS. 5 and 5A, is in the form of a pencil-like rod terminating in a blunted head 42 provided with a recessed central portion 44 of slightly larger diameter and deeper than the head portion 28, 28' of the respective punctum plugs 20, 20'. To temporarily engage the plug by its head portion, a thin finger member 45 projects outwardly from the center of the recess and is adapted to mate with a corresponding bore 28, 28' in the head of the plug. The friction fit is sufficiently tight between the projecting finger 45 and the mating bore hole 28, 28' that the plug is securely held by the inserter tool 40 as it is manipulated into the punctal aperture. As previously mentioned, the tip or barb portion 22, 22' of the plug is pointed, or at least partially so, to encourage some further dilation of the punctum and the canaliculus as the plug is inserted therein.
The plug is advanced into the depth of the canaliculus by manipulation of the inserter tool until the head portion 26, 26' is seated on the punctal opening.」『プラグ自体は、従来の鉗子、または図5及び5Aに示される、特殊インサータ工具40を用いて涙点開口部内に配置される。特殊インサータ工具40は、涙点プラグ20、20 ' のヘッド部28,28 'よりも深い凹部の中央部44が設けられている平滑化ヘッド42で終端する若干大径のペンシル状のロッドの形態である。一時的に凹部の中心から外側に突出しの頭部、薄い指状部材45によってプラグを係合するように、プラグの頭部の対応する孔28,28 'と嵌合するように構成されている。摩擦嵌合は、突出した指状部材45との間に十分にタイトで、それが涙点開口部で操作され、プラグにはしっかりインサータ工具40によって保持さる孔28、28 'を設けている。前述したように、プラグの先端部又は棘部22,22 'はプラグが挿入されると涙小管のいくらかさらなる拡張を促進することは、少なくとも部分的に指摘されている。
ヘッド部26,26 'が涙点開口部に着座するまで、プラグはインサータ工具の操作によって小管の深さに前進させる。』(明細書第5欄第32行?53行)
(カ)上記記載事項(ウ)、(エ)、FIG.1及びFig.3Aより、プラグは、人の眼の涙点に挿入し、眼の涙小管によって保持されるように構成された先端部又は棘部及び中間部と、先端部又は棘部及び中間部に支持されたヘッド部を備え、先端部又は棘部及び中間部が涙小管によって保持されるときに、ヘッド部の外周は涙点上又は前記涙点の外表面に位置するように形成されているものといえる。
(キ)上記記載事項(エ)の「・・・In certain embodiments of the invention the plugs 20, 20', particularly the head portion 28, 28', may be of medication-impregnable porous material such as HEMA hydrophilic polymer, or may be otherwise adapted as with capillaries or the like, to store and slowly dispense ophthalmic drugs to the eye as they are leached out by the lacrimal fluids.」『・・・本発明のプラグ20,20 'は、特にヘッド部28,28'の特定の実施形態において、親水性ポリマーとしてHEMAのような薬剤を含浸可能な多孔質材料であってもよいし、あるいは毛細管等で構成することができ、涙液が浸出すると蓄えられた点眼薬を眼に徐々に放出することができる。』の記載より、ヘッド部は、点眼薬を眼に対して放出するように構成されているといえる。

以上の記載事項及び図示内容を総合すると、上記引用刊行物1には、以下の発明(「引用発明」という。)が記載されている。
「人の眼の涙点に挿入し、該眼の涙小管によって保持されるように構成された先端部又は棘部及び中間部と、
前記先端部又は棘部及び中間部に支持されたヘッド部であって、点眼薬を前記眼に対して放出するように構成された前記ヘッド部と、を備え、
前記先端部又は棘部及び中間部が前記涙小管によって保持されるときに、前記ヘッド部の外周は前記涙点上又は前記涙点の外表面に位置するように形成されている涙点プラグ。」

原査定の理由に引用された、本願優先権主張日前に頒布された刊行物である米国特許第5466233号明細書(以下「引用刊行物2」という。)には、図面とともに、以下の事項が記載されている。( 『』内の訳文は、当審における仮訳である。)
(ク)「The present invention relates to a tack for intraocular drug delivery and, more particularly, to a tack which may be anchored in at least one of the sclera, the retina and the choroid and which has a drug filled post to be inserted within the vitreous region of the eye. The present invention also relates to a method for insertion and removal of an intraocular device for sustained release of a drug into the vitreous region of the eye.」『本発明は、眼内薬物送達用のタック(鋲)に、より具体的には、強膜の少なくとも一方と、網膜と脈絡膜に固定された、薬剤が硝子体領域内に放出されるようにポストに充填したタックに関する。本発明はまた、眼の硝子体領域への薬物の徐放のための眼内装置を挿入及び除去するための方法に関する。』(明細書第1欄第5行?13行)
(ケ)「The present invention provides a tack for intraocular drug delivery which, in one embodiment, comprises a post, an anchoring region and a head. The post includes a drug to be administered and has a first and second end. The first end is positioned within the vitreous region of the eye. The anchoring region is attached to the second end of the post and includes a width measured perpendicularly to the longitudinal axis of the tack. The width varies to provide a configuration to the anchoring region which anchors the tack in at least one of the sclera, the retina and the choroid of the eye. (コ)「In one preferred embodiment as shown in FIGS. 1, 5, 8 and 12, the post 12 comprises a outer membrane 70 which may be permeable or semi-permeable. The membrane 70 forms a cavity 72. The cavity is filled with a drug in liquid or gel form to be administered. The water in the vitreous 42 swells the membrane 70 allowing the drug to pass through the membrane 70 by a mechanism such as, for example, osmosis or diffusion into the vitreous 42.
As shown in FIGS. 4 and 11, the membrane 70 may also surround a solid drug core 74. The solid drug core 74 would dissolve in the water absorbed from the vitreous 42 and then pass through the membrane 70 into the vitreous 42 by, for example, either diffusion or osmosis.
As shown in FIGS. 2 and 9, the post 12 may also comprise a solid, non-erodible polymeric matrix 76 having drug particles 78 dispersed within the matrix 76. The matrix 76 is preferably porous. The drug particles 78 diffuse through the matrix 76 into the vitreous 42.
The drug may also be dissolved in a solid, erodible polymer 79 as shown in FIGS. 3 and 10. In this embodiment, the drug is delivered to the vitreous 42 by dissolution or bio-erosion of the post 12 as shown by the phantom lines in FIGS. 3 and 10.」『図1、5、8と12で示す1つの好ましい実施形態において、ポスト12は、浸透性があるか半透性である外膜70を備える。膜70は、空洞72をつくる。空洞は、管理される液体またはジェルの形の薬で満たされる。硝子体42の水は、薬をメカニズム、例えば硝子体42への浸透または拡散機構で膜70を通過させ、膜70をふくらませる。

以上の記載事項及び図示内容を総合すると、上記引用刊行物2には、以下の発明が記載されている。
「眼の硝子体に挿入されるタックであって、ヘッドと、
ヘッドに支持されたポスト12であって、ポスト12は投与する薬物を含み、薬物を囲む膜70を備え、該薬物を該膜70を通過させることにより前記眼の硝子体に対して該薬物が送達されて徐放するように構成されたポスト12と、を備えるタック。」

原査定の理由に引用された、本願優先権主張日前に頒布された刊行物である米国特許第3867519号明細書(以下「引用刊行物3」という。)には、図面とともに、以下の事項が記載されている。( 『』内の訳文は、当審における仮訳である。)
(サ)「1. Field of the Invention
This invention relates to a method and device for the controlled administration of drug to a patient. More particularly, this invention relates to a drug dispensing device which bioerodes in the biological environment of such patient. In preferred embodiments, the invention relates to a bioerodible device for the controlled and continuous administration of drug to a mammalian patient, especially to the eye of such patient, over a prolonged period of time. In aother aspect the invention relates to a method for preparing these devices.」『1.発明の分野
本発明は、患者への薬物の制御された投与のための方法および装置に関する。特に、本発明は、患者の生物学的環境で生体内分解の薬物分配装置に関するものである。好ましい実施形態において、本発明は、長期間にわたって、特に、患者の眼に、哺乳動物患者への薬物の制御された連続的な投与のための生体内分解性装置に関する。 他の態様において、本発明はこれらのデバイスを製造する方法に関する。』(明細書第1欄第9行?19行)
(シ)「Referring particularly to FIGS. 1 and 2, a human eye is shown in each figure, more or less diagrammatically, comprising an eyeball 1 and upper and lower eyelids 2 and 3, respectively, the eyeball 1 being covered for the greater parts of its area by the sclera 4 and at its central portion by the cornea 5.・・・
A bioerodible ocular insert 12 in accord with this invention is shown in operative position in the lower sac 11 of the eye. Other details of the eyeball 1 are not directly concerned with the structure of the instant invention and, therefore, details showing the description thereof are being omitted in the interest of brevity. To use the ocular insert of the invention, it is inserted in the eye, preferably within the upper sac 7 or lower sac 11, bounded by the surfaces of the sclera of the eyeball and the conjunctiva of the lid. Insertion of the insert 12 into the eye can be satisfactorily accomplished by mounting or grasping the device by means of a suitable holder, which optionally may include a minute suction cup for engaging the outer surface of the insert. The holder may be one of the several types commonly used to insert and remove corneal contact lenses, artificial eyes, and the like. Once in place, the ocular insert functions to administer a metered amount of drug from thr reservoir to the eye and surrounding tissues, in preferred embodiments, continuously over a prolonged period of time.」『図1及び図2に特に参照すると、人間の眼は、眼球1、上下瞼2、3からなり、眼球1は、強膜4によって大部分が覆われており、さらに角膜5によって、その中央部が覆われている。・・・この発明にあった生体内分解性眼用インサート12は、眼の下嚢11での作動位置で示されている。直接本発明の構造との関係で、眼球1の他の詳細は、簡略化のために省略されてる。本発明の眼のインサートを使用するためには、好ましくは、眼球の強膜及び蓋の結膜の表面で囲まれた上側嚢7か下嚢11内、眼内に挿入される。インサート12の眼ヘの挿入は、インサートの外表面に係合するための微細な吸盤を含み得る適切なホルダーを用いて実装またはデバイスを把持することによって良好に達成することができる。ホルダは、一般的に角膜コンタクトレンズ、人工眼などを挿入し、除去するために使用されるいくつかのタイプのいずれであってもよい。一度挿入されたら、眼用インサート機構が連続的に長期間にわたって、好ましい実施形態では、リザーバから眼および周囲組織への薬物の計量された量を投与する。』(明細書第11欄第19行?56行)
(ス)「FIG. 4 illustrates generally, by reference numeral 30, an embodiment of this invention which finds its most general application for the release of water insoluble drugs. The bioerodible ocular insert is comprised of an inner reservoir 31 which is formed of a biodegradable matrix material having drug 21 dispersed therethrough. Surrounding matrix 20 is bioerodible rate controlling membrane 22 constructed of the polyvalent metal ion cross-linked polyelectrolyte in accord with the invention. Both matrix 20 and membrane 22 are permeable to the passage of drug by diffusion, that is, molecules of the drug can dissolve in and diffuse through these materials; however, the permeability of membrane 22 to drug is lower than from the matrix 31 so that release of drug through membrane 22 is the drug release rate controlling step from the ocular insert. The inner matrix 31 serves as a depot or reservoir source for the drug and can be a porous, solid or gel material. (セ)「FIG. 5 illustrates generally, by reference numeral 40, another bioerodible ocular insert of this invention having a hollow interior reservoir 41 containing drug formulation 21 in the reservoir 41. Polyvalent metal ion cross-linked anionic polyelectrolyte rate controlling bioerodible membrane 22 surrounds the reservoir 40 and controls the flow of drug from the reservoir 41 to the eye. This embodiment differs from that illustrated in FIG. 4, mainly in that therein the reservoir 31 is formed of a matrix material with the drug dispersed therethrough, whereas in the embodiment of FIG. 5 the drug 21 is confined in the hollow reservoir container 41. The insert shown in FIG. 5 operates in a manner similar to the device illustrated in FIG. 4, as described above. It is imperative that the drug 21 be depleted from the reservoir 41 prior to the complete erosion of rate controlling membrane 22 in order to avoid a sudden and unwanted release of drug from the reservoir 41 to the eye.
When the drug being released to the eye is water soluble, it is often difficult to control its rate of release with the hydrophilic polyvalent metal ion cross-linked anionic polyelectrolytes of the present invention. In such cases the rate of drug release may be provided by simple rapid dissolution of the drug in tear fluids which is unsatisfactory for the reasons that the release of drug is both uncontrolled and usually exceeds the desired therapeutic dosage. It is therefore preferred in these cases when employing the embodiment of FIG. 4 that certain modifications be made to insolubilize or decrease the water solubility of the drug so as to effect the drug release by a Permeation Control mechanism, e.g., by controlled viscous fluid diffusive transfer as hereinbefore discussed.」『図5に、符号40で示されるものは、リザーバ41内に薬物製剤21を含む中空内部リザーバ41を有する本発明の別の生体内分解性眼用インサートを一般的に示している。生体内分解性膜22の分解率を制御する多価金属イオン架橋されたアニオン性高分子はリザーバ40を取り囲み、リザーバ41から眼への薬物の流れを制御する。この実施形態は、図4に例示されたものとは異なる。すなわち、図4に示す、主に内部リザーバ31は、薬物を有するマトリックス材料で形成されているが、図5の実施形態の、分散した薬物21は、中空の貯蔵容器41内に閉じ込められる。図5のインサートは、上述した図4に示した装置と同様に動作する。薬物21、リザーバ41から目にリザーバ41からの薬物の突然の、不要な放出を避けるために、膜22を制御された速度で完全に浸食することが不可欠である。
眼に放出される薬物が水溶性である場合には、本発明の親水性多価金属イオン架橋された陰イオン性高分子電解質でその放出速度を制御することはしばしば困難である。このような場合、涙液中の薬物の単純、迅速溶解による薬物放出速度は、薬物の放出が制御されていないのであり、通常、所望の治療用量を超えているとの理由で不十分である。このような場合、図4の実施形態を採用するのが好まれており、特定の変更が、例えば明細書で説明したような制御された粘性流体拡散のような浸透制御メカニズムによって、薬物放出を効果的に達成するように、薬物の水溶性を不溶化または減少させる。』(明細書第14欄第21行?53行)

以上の記載事項及び図示内容を総合すると、上記引用刊行物3には、以下の発明が記載されている。
「眼の下嚢に挿入される眼用インサートであって、薬剤を含んだマトリックスを覆う膜を設け、を備え、薬物を膜の外表面から連続的に長期にわたって放出させる眼用インサート。」

4.対比・判断
本願発明と引用発明とを対比すると、その構造または機能からみて、引用発明の「涙点プラグ」は、本願発明の「装置」に相当し、同様に、「人の眼」は「哺乳動物の眼」に、「先端部又は棘部及び中間部」は「第1の部分に」に、「ヘッド部」は「第2の部分」に、「点眼薬」は「治療媒体」に、相当する。

両者は、
「哺乳動物の眼の涙点に挿入し、該眼の涙小管によって保持されるように構成された第1の部分と、
前記第1の部分に保持又は支持された第2の部分であって、該治療媒体を前記眼に対して放出するように構成された前記第2の部分と、を備え、
前記第1の部分が前記涙小管によって保持されるときに、前記第2の部分の外周は前記涙点上又は前記涙点の外表面に位置するように形成されている装置。」の点で一致し、以下の点で相違している。

相違点:治療媒体の放出機構に関して、本願発明では、第2の部分が、少なくとも部分的な封入ジャケット又はコーティングを備え媒体を搬送するのに対し、引用発明では、ヘッド部(第2の部分)が点眼液(治療媒体)を蓄え放出するものではあるが、そのような封入ジャケット又はコーティングを有しない点。

そこで上記相違点について検討する。
(相違点について)
本願発明の「部分的な封入ジャケット又はコーティング」に関して、本願発明の明細書には、「・・・上記別の部分は、送出装置の第1の部分の端部に塗布されたコーティングを含み、このコーティングは、そこから治療媒体が制御可能に放出されるように構成または配置される。・・・」(段落【0011】)、「・・・記載されるような皮膜拡散薬物送出システムと同様に機能するように構成および配置することが可能である。例えば、外周部124は、異なる透過性を有する2つのコーティングを含むことにより、治療媒体がこれらのコーティングのうちの1つの小さな開口部を介して拡散し、近い次数での放出過程を達成する。」(段落【0039】)、「・・・(b)外周部124は、生体適合性を有し、治療媒体(例えば、タンパク質、細胞または小分子薬等の薬物、製剤、薬剤)を眼組織に拡散させる皮膜を含む外周ジャケットに対応する。・・・」(段落【0040】)と記載されている。以上の明細書の記載を参考にすると、「部分的な封入ジャケット又はコーティング」には、「治療媒体が制御可能に放出されるように構成または配置される被膜」が含まれる。
引用刊行物2に記載された発明は、「眼の硝子体に挿入されるタックであって、ヘッドと、
ヘッドに支持されたポスト12であって、ポスト12は投与する薬物を含み、薬物を囲む膜70を備え、該薬物を該膜70を通過させることにより前記眼の硝子体に対して該薬物が送達されて徐放するように構成されたポスト12と、を備えるタック。」である。引用刊行物3に記載された発明は、「眼の下嚢に挿入される眼用インサートであって、薬剤を含んだマトリックスを覆う膜を設け、を備え、連続的に長期間にわたって薬物を膜の外表面から放出させる眼用インサート。」である。よって、引用刊行物2に記載された発明の「膜70」は「薬物を該膜70を通過させることにより前記眼の硝子体に対して該薬物が送達されて徐放する」ための「膜70」であり、引用刊行物3に記載された発明の「膜」は「連続的に長期間にわたって薬物を膜の外表面から放出させる」ための「膜」であるから、引用刊行物2に記載された発明の「膜70」あるいは、引用刊行物3に記載された発明の「膜」は「治療媒体が制御可能に放出されるように構成または配置される被膜」といえる。そうすると引用刊行物2に記載された発明の「膜70」あるいは、引用刊行物3に記載された発明の「膜」は「部分的な封入ジャケット又はコーティング」に相当する。そして引用刊行物2に記載された発明と、引用刊行物3に記載された発明と引用発明とは、眼に薬剤を放出する技術で共通し、かつ、引用刊行物1の上記記載事項(エ)の『・・・本発明のプラグ20,20 'は、特にヘッド部28,28'の特定の実施形態において、親水性ポリマーとしてHEMAのような薬剤を含浸可能な多孔質材料であってもよいし、あるいは毛細管等で構成することができ、涙液が浸出すると蓄えられた点眼薬を眼に徐々に放出することができる。』の記載から、引用発明においても「点眼薬を眼に徐々に放出する」という課題を解決するものであり、課題においても引用刊行物2に記載された発明と、引用刊行物3に記載された発明と引用発明とは共通するものであるから、引用発明の、点眼薬を眼に対して放出するための構成として、引用刊行物2に記載された膜70あるいは引用刊行物3に記載された膜を用いた構成を採用して、相違点に係る発明特定事項とすることは当業者が容易に想到し得たことである。なお、適用に際して膜(部分的な封入ジャケット又はコーティング)を設ける部分としてヘッド部(第2の部分)とすることは、ヘッド部(第2の部分)が薬剤の放出部であるから、当業者なら容易に想到する事項である。

そして、本願発明による効果も、引用発明、引用刊行物2に記載された発明及び引用刊行物3に記載された発明から当業者が予測し得る範囲のものである。

5.むすび
したがって、本願発明は、引用発明、引用刊行物2に記載された発明及び引用刊行物3に記載された発明に基いて当業者が容易に発明をすることができたものであるので、特許法第29条第2項の規定により特許を受けることができない。
よって、結論のとおり審決する。
