理由 第1 事案の概要
1 手続の経緯
特願2014-209726号(以下「本件出願」という。)は,平成25年4月5日に出願された特願2013-80019号の一部を,特許法44条1項の規定に基づいて平成26年10月14日に新たな特許出願としたものである。また,上記特願2013-80019号は,平成21年10月7日に出願された特願2009-233938号(以下「もとの特許出願」という。)の一部を,同規定に基づいて平成25年4月5日に新たな特許出願としたものである。
本件出願は,同法同条2項の規定により,もとの特許出願の時にしたものとみなされるところ,その手続等の経緯は,概略,以下のとおりである。

2 本願発明
本件出願の請求項1-請求項4に係る発明は,本件補正により補正された特許請求の範囲の請求項1-請求項4に記載された事項により特定されるものと認められるところ,その請求項1に係る発明(以下「本願発明」という。)は,次のとおりのものである。
「透明プラスチックフィルム基材の少なくとも一方の面に,微粒子を含有する防眩性ハードコート層を有する防眩性ハードコートフィルムの製造方法であって,前記防眩性ハードコートフィルムの全ヘイズ値が0?5%の範囲内にあり,
前記防眩性ハードコート層が,ハードコート層形成材料中に前記微粒子を含むハードコート層であり,前記微粒子として,重量平均粒径が2?6μmの範囲である球状もしくは不定形の微粒子を1種類以上含み,前記ハードコート層形成材料100重量部に対して,前記微粒子が2?10重量部の範囲で含まれており,
前記防眩性ハードコートフィルムの製造方法において,
重量平均粒径が2?6μmの範囲である前記微粒子,前記ハードコート層形成材料およびアルコール系溶媒の比率が50重量%以上の溶媒である溶媒を含む防眩性ハードコート層形成材料を準備し,前記防眩性ハードコート層形成材料を前記透明プラスチックフィルム基材の前記少なくとも一方の面に塗工して塗膜を形成し,さらに,前記塗膜を乾燥させ,その後硬化させて厚みが5μm以上7.5μm未満の範囲である前記防眩性ハードコート層を形成することを特徴とする防眩性ハードコートフィルムの製造方法。」

3 原査定の理由
原査定の拒絶の理由のうち理由2は,概略,本願発明は,その出願前に日本国内又は外国において,頒布された刊行物に記載された発明又は電気通信回線を通じて公衆に利用可能となった発明に基づいて,その出願前にその発明の属する技術の分野における通常の知識を有する者が容易に発明をすることができたものであるから,特許法29条2項の規定により特許を受けることができない,というものである。

[0006] Recently, in order to improve image quality, the number of high definition image displays with small pixel sizes is increasing. In such high definition image displays, when a conventional hard-coated antiglare film is disposed, variations in brightness in pixels are emphasized further more to cause a visible failure (a failure due to glare) to result in considerably deteriorated image quality. Conventionally, in order to produce an antiglare laminate that allows high definition to be provided, a method has been employed in which the haze value of the antiglare layer is increased to eliminate glare. However, this method has a problem in that the contrast is decreased considerably because light is scattered intensively at the panel surface. Furthermore, in the case where the surface unevenness is increased to improve antiglare properties, there is a problem in so-called white blur in an oblique direction, that is, white blur is observed due to excessively intensive scattering of reflected light when the panel surface is viewed from the oblique direction. In the antiglare treatment, a method of producing an uneven shape of the film surface by adding, for example, inorganic or organic particles is used. Generally, although an improvement in antiglare properties and an improvement in contrast or white blur are considered to have a contradictory relationship, various proposals have been made to obtain both these properties. For example, it is being studied that aggregates with three-dimensional structures formed of the aforementioned particles are allowed to be present in an antiglare layer (see, for instance, JP 2005-316413 A). This, however, may cause scatter at the aggregates or may cause a fine pattern to appear in a hard-coated film. Furthermore, although a method that is effective in improving a part of properties has been proposed (see, for instance, JP 2003-4903 A and JP 4001320 B), a method that is effective in solving all the three problems described above has not been found.」

[0006] 近年,画質を良くするために画素のサイズが小さい高精細の画像表示装置が増大している。このような高精細の画像表示装置に,従来の防眩性ハードコートフィルムを配置すると,画素中に存在する輝度のバラツキがより強調されて目に見える故障(ギラツキ故障)を引き起こし,著しく画質が悪化していた。従来,高精細に対応する防眩性積層体を作製するためには,防眩層のヘイズ値を高くすることでギラツキを解消する方法がなされていた。しかしながら,この方法では,パネル表面で光を強く散乱させるため,コントラストが大幅に低下する課題があった。また,防眩性を高めるために表面凹凸を大きく荒らすと,斜め方向から見た場合,反射光の散乱が強くなりすぎて白ぼけて見えるという,いわゆる斜め方向の白ボケの問題がある。前記防眩処理には,無機,有機粒子などを添加することでフィルム表面に凹凸形状を作製する方法が行われている。防眩性の向上とコントラスト改善や白ボケ改善は,一般的に相反関係にあるとされているが,これらの特性を両立させるための,種々の提案がなされている。例えば,防眩層中に前記粒子から形成される三次元立体構造の凝集部を存在させるという検討がなされている(例えば,特開2005-316413号公報を参照されたい。)。しかしながら,凝集部での散乱の発生や,ハードコートフィルムに微細模様が現れることがある。また,一部の特性の改善に有効な手段は提案されているが(例えば,特開2003-4903号公報及び特許第4001320号公報を参照されたい。),上記3つの課題すべてを解決する有効な手段は見出されていなかった。)

ウ 「SUMMARY OF THE INVENTION
[0007] The present invention is intended to provide a hard-coated antiglare film that increases visibility without deteriorating the properties of image displays such as LCDs with increased definition and contrast. That is, the present invention is intended to provide a hard-coated antiglare film that has excellent antiglare properties, allows high definition to be provided even in the case of a low haze value, and can prevent white blur in an oblique direction from occurring to improve in depth of black in black display, as well as a polarizing plate and an image display including the same.
[0008] In order to achieve the aforementioned object, a hard-coated antiglare film of the present invention includes a transparent plastic film substrate and a hard-coating antiglare layer containing fine particles on at least one surface of the transparent plastic film substrate, wherein an arithmetic average surface roughness Ra (μm) that is defined in JIS B 0601 (1994 version) is in the range of 0.05 to 0.15μm in an uneven shape of a surface of the hard-coating antiglare layer, and the hard-coated antiglare film includes at least 80 convexities that exceed a roughness mean line of a surface roughness profile in a 4-mm long portion at an arbitrary location of the surface of the hard-coating antiglare layer.」

[0057] The shape of the fine particles is not particularly limited. For instance, they can have a bead-like, substantially spherical shape or can have an indeterminate shape like powder. However, the fine particles preferably have a substantially spherical shape, more preferably a substantially spherical shape with an aspect ratio of 1.5 or lower, and most preferably a spherical shape.
[0058] The ratio of the fine particles to be added is preferably in the range of 3 to 10 parts by weight and more preferably in the range of 5 to 8 parts by weight, per 100 parts by weight of the material for forming a hard-coating layer.

The thickness in the predetermined range makes it easy to obtain the surface shape of the hard-coated antiglare film of the present invention, in which a large number of fine concavities and convexities are present independently, and sufficiently high hardness (for instance, a pencil hardness of at least 4H) of the hard-coating antiglare layer. Furthermore, the thickness exceeding the above-mentioned range causes problems in that the hard-coated antiglare film curls considerably to have deteriorated line traveling performance during the coating and further in that antiglare properties are deteriorated. On the other hand, when the thickness is less than the predetermined range described above, there is a problem in that glare cannot be prevented from occurring and thereby the sharpness deteriorates.

That is, for example, a material for forming a hard-coating antiglare layer is prepared that contains the fine particles, the material for forming a hard-coating layer, and a solvent, the material for forming a hard-coating antiglare layer is applied onto at least one surface of the transparent plastic film substrate to form a coating film, and the coating film is then cured to form the hard-coating antiglare layer. However, the present invention is neither limited nor restricted by this surmise. In the case of, for example, the materials for forming a hard-coating layer described later, concavities and convexities tend to be formed at the surface when the solvent is, for example, MEK, cyclopentanone, ethyl acetate, or acetone, while concavities and convexities tend not to be formed at the surface when the solvent is, for example, MIBK, toluene, butyl acetate, 2-propanol, or ethanol. Accordingly, in order to obtain a hard-coated antiglare film having the properties of the present invention, it also is preferable that the surface shape be controlled through selection of the type and ratio of the solvent.

[0064] 本発明の防眩性ハードコートフィルムは,以下のようにして製造することができる。すなわち,例えば,前記微粒子,前記ハードコート層形成材料及び溶媒を含む防眩性ハードコート層形成材料を準備し,前記防眩性ハードコート層形成材料を前記透明プラスチックフィルム基材の少なくとも一方の面に塗工して塗膜を形成し,前記塗膜を硬化させて前記防眩性ハードコート層を形成することにより,製造できる。本発明の防眩性ハードコートフィルムの製造においては,金型による転写方式や,サンドブラスト,エンボスロールなどの適宜な方式で凹凸形状を付与する方法などを,併せて用いることもできる。
[0065] 前記溶媒は,特に制限されず,種々の溶媒を使用可能である。しかしながら,ハードコート層形成材料組成や微粒子の種類,含有量等に応じて,本発明の防眩性ハードコートフィルムを得るために,最適な溶媒種類や溶媒比率が存在する。前記溶媒としては,例えば,ジブチルエーテル,ジメトキシメタン,ジメトキシエタン,ジエトキシエタン,プロピレンオキシド,1,4-ジオキサン,1,3-ジオキソラン,1,3,5-トリオキサン,テトラヒドロフラン,アセトン,メチルエチルケトン(MEK),ジエチルケトン,ジプロピルケトン,ジイソブチルケトン,シクロペンタノン,シクロヘキサノン,メチルシクロヘキサノン,蟻酸エチル,蟻酸プロピル,蟻酸n-ペンチル,酢酸メチル,酢酸エチル,プロピオン酸メチル,プロピオン酸エチル,酢酸n-ペンチル,アセチルアセトン,ジアセトンアルコール,アセト酢酸メチル,アセト酢酸エチル,メタノール,エタノール,1-プロパノール,2-プロパノール,1-ブタノール,2-ブタノール,1-ペンタノール,2-メチル-2-ブタノール,シクロヘキサノール,酢酸イソブチル,メチルイソブチルケトン(MIBK),2-オクタノン,2-ペンタノン,2-ヘキサノン,2-ヘプタノン,3-ヘプタノン,エチレングリコールモノエチルエーテルアセテート,エチレングリコールモノエチルエーテル,エチレングリコールモノブチルエーテル,エチレングリコールモノメチルエーテル,プロピレングリコールモノメチルエーテルアセテート,プロピレングリコールモノメチルエーテル等があげられる。これらは,一種類を単独で使用してもよいし,二種類以上を併用してもよい。

例えば,後述の実施例で使用したハードコート層形成材料につき,微粒子を5重量部添加し,固形分濃度を45重量%として,防眩性ハードコート層の厚みを約10μmとした場合には,MIBK/MEKの比率は,少なくとも1.5/1?2.0/1(重量比)の範囲で本発明の特性を有する防眩性ハードコートフィルムが得られる。酢酸ブチル/MEKの場合は,少なくとも1.5/1?3.0/1(重量比)の範囲で本発明の特性を有する防眩性ハードコートフィルムが得られる。後述の実施例で使用したハードコート層形成材料のように,前記(B)成分がナノ粒子である場合には,例えば,前記溶媒の種類や混合比率により,ナノ粒子及び前記微粒子の分散状態に変化が起きることで,防眩性ハードコート層表面の凹凸傾向が変化することが推察される。ただし,本発明は,この推察により,なんら制限ないし限定されない。例えば,後述の前記ハードコート層形成材料であると,溶媒がMEK,シクロペンタノン,酢酸エチル,アセトン等の場合には,表面に凹凸が形成されやすく,溶媒がMIBK,トルエン,酢酸ブチル,2-プロパノール,エタノール等の場合には,表面に凹凸が形成されにくい。そのため,本発明の特性を有する防眩性ハードコートフィルムを得るためには,溶媒の種類や溶媒の比率によって表面形状の制御をすることも好ましい。

[0112] A material for forming a hard-coating layer (“OPSTAR Z7540”(trade name), manufactured by JSR Corporation, solid content: 56% by weight, and solvent: butyl acetate/methyl ethyl ketone (MEK)=76/24 (weight ratio)) containing the component (A) was prepared in which silica nanoparticles (the aforementioned component (B)) formed by bonding inorganic oxide particles and an organic compound containing a polymerizable unsaturated group to each other were dispersed. The material for forming a hard-coating layer contained the components (A) and (B) in a weight ratio of the component (A) in total:component (B) of 2:3, where the component (A) was dipentaerythritol and isophorone diisocyanate polyurethane and the component (B) was silica fine particles (whose weight average particle size was 100 nm or smaller) whose surfaces had been modified with organic molecules. 2 対比及び判断
(1) 対比
本願発明と引用発明を対比すると,以下のとおりとなる。
ア 物の対応関係
引用発明の「トリアセチルセルロースフィルム」,「アクリルとスチレンの架橋粒子」,「ハードコート層形成材料の樹脂固形分」,「防眩性ハードコート層形成材料」,「塗膜」,「防眩性ハードコート層」及び「防眩性ハードコートフィルム」は,それが果たす役割等からみて,それぞれ,本願発明の「透明プラスチックフィルム基材」,「微粒子」,「ハードコート層形成材料」,「防眩性ハードコート層形成材料」,「塗膜」,「防眩性ハードコート層」及び「防眩性ハードコートフィルム」に相当する。
また,引用発明の「酢酸ブチル/メチルエチルケトン」と本願発明の「溶媒」は,その機能からみて,「溶媒」の点で共通する。
(当合議体注:本願発明でいう「ハードコート層形成材料」は,本件出願の発明の詳細な説明の実施例1(【0074】)等でいう「ハードコート層形成材料の樹脂固形分」のことなので,以上のとおり対比する。)

イ 防眩性ハードコートフィルムの製造方法
引用発明の「防眩性ハードコートフィルムの製造方法」は,その製造工程からみて,トリアセチルセルロースフィルムの片面,すなわち一方の面に,アクリルとスチレンの架橋粒子を含有する防眩性ハードコート層を有する防眩性ハードコートフィルムの製造方法といえる。
したがって,引用発明の「防眩性ハードコートフィルムの製造方法」は,本願発明の「防眩性ハードコートフィルムの製造方法」に相当する。また,引用発明の「防眩性ハードコートフィルム」は,本願発明の「防眩性ハードコートフィルム」の,「透明プラスチックフィルム基材の少なくとも一方の面に,微粒子を含有する防眩性ハードコート層を有する」という要件を満たす。

ウ 全ヘイズ値
引用発明の「防眩性ハードコートフィルム」は,「ヘイズが4%」であり,また,引用文献6の[0101]記載の測定条件等を勘案すると,引用発明でいう「ヘイズ」は,本願発明でいう「全ヘイズ」のことである。
そうしてみると,引用発明の「防眩性ハードコートフィルム」は,本願発明の「前記防眩性ハードコートフィルムの全ヘイズ値が0?5%の範囲内にあり」という要件を満たす。

エ 微粒子の重量平均粒径及び分量
引用発明の「防眩性ハードコート層」は,その製造工程からみて,「ハードコート層形成材料の樹脂固形分」の中に,「アクリルとスチレンの架橋粒子」を含む層である。また,引用発明の「アクリルとスチレンの架橋粒子」は,「重量平均粒径:5.0μm」であり,その分量は,「ハードコート層形成材料の樹脂固形分100重量部あたり」「4重量部」である。
したがって,引用発明の「防眩性ハードコート層」と本願発明の「防眩性ハードコート層」は,「前記防眩性ハードコート層が,ハードコート層形成材料中に前記微粒子を含むハードコート層であり,前記微粒子として,重量平均粒径が2?6μmの範囲である」「微粒子を1種類以上含み,前記ハードコート層形成材料100重量部に対して,前記微粒子が2?10重量部の範囲で含まれており」という点で共通する。
なお,引用発明は,「ハードコート層形成材料」に「(B)成分:表面を有機分子により修飾したシリカ微粒子(重量平均粒径100nm以下)」を含むものである。ただし,この「シリカ微粒子」は,その粒径も含め,本願発明でいう「微粒子」すなわち,「形成される防眩性ハードコート層表面を凹凸形状にして防眩性を付与し,また,前記防眩性ハードコート層のヘイズ値を制御することを主な機能とする」(【0024】)ものに該当しない。

オ 準備
引用発明の「防眩性ハードコート層形成材料」は,「アクリルとスチレンの架橋粒子(重量平均粒径:5.0μm,屈折率:1.505)」,「ハードコート層形成材料」,「酢酸ブチル/メチルエチルケトン」を含むものである。また,引用発明は,「防眩性ハードコート層形成材料を準備し」ている。
そうしてみると,引用発明の「ハードコート層形成材料の樹脂固形分100重量部あたり,微粒子として,アクリルとスチレンの架橋粒子(重量平均粒径:5.0μm,屈折率:1.505)を4重量部,レベリング剤を0.1重量部,光重合開始剤を0.5重量部混合し」,「この混合物を,固形分濃度が45重量%,酢酸ブチル/メチルエチルケトン比率が2/1(重量比)となるように希釈して,防眩性ハードコート層形成材料を準備し」という工程と,本願発明の「重量平均粒径が2?6μmの範囲である前記微粒子,前記ハードコート層形成材料およびアルコール系溶媒の比率が50重量%以上の溶媒である溶媒を含む防眩性ハードコート層形成材料を準備し」という工程は,「重量平均粒径が2?6μmの範囲である前記微粒子,前記ハードコート層形成材料および」「溶媒を含む防眩性ハードコート層形成材料を準備し」という点で共通する。

カ 形成
引用発明は,「透明プラスチックフィルム基材の片面に防眩性ハードコート層形成材料を,コンマコータを用いて塗布して塗膜を形成し」という工程を具備する。
したがって,引用発明は,本願発明の「前記防眩性ハードコート層形成材料を前記透明プラスチックフィルム基材の前記少なくとも一方の面に塗工して塗膜を形成し」という工程を具備する。

キ 乾燥
引用発明は,「ついで,100℃で1分間加熱することにより塗膜を乾燥させ」という工程を具備する。
したがって,引用発明は,本願発明の「さらに,前記塗膜を乾燥させ」という工程を具備する。

ク 硬化
引用発明は,「その後,高圧水銀ランプにて紫外線を照射し,塗膜を硬化処理して厚み9μmの防眩性ハードコート層を形成し」という工程を具備する。
そうしてみると,引用発明のこの工程と,本願発明の「その後硬化させて厚みが5μm以上7.5μm未満の範囲である前記防眩性ハードコート層を形成する」工程は,「その後硬化させて」「前記防眩性ハードコート層を形成する」という点で共通する。

(2) 一致点及び相違点
ア 一致点
本願発明と引用発明は,次の構成で一致する。
「透明プラスチックフィルム基材の少なくとも一方の面に,微粒子を含有する防眩性ハードコート層を有する防眩性ハードコートフィルムの製造方法であって,前記防眩性ハードコートフィルムの全ヘイズ値が0?5%の範囲内にあり,
前記防眩性ハードコート層が,ハードコート層形成材料中に前記微粒子を含むハードコート層であり,前記微粒子として,重量平均粒径が2?6μmの範囲である微粒子を1種類以上含み,前記ハードコート層形成材料100重量部に対して,前記微粒子が2?10重量部の範囲で含まれており,
前記防眩性ハードコートフィルムの製造方法において,
重量平均粒径が2?6μmの範囲である前記微粒子,前記ハードコート層形成材料および溶媒を含む防眩性ハードコート層形成材料を準備し,前記防眩性ハードコート層形成材料を前記透明プラスチックフィルム基材の前記少なくとも一方の面に塗工して塗膜を形成し,さらに,前記塗膜を乾燥させ,その後硬化させて前記防眩性ハードコート層を形成する防眩性ハードコートフィルムの製造方法。」

イ 相違点
本願発明と引用発明は,以下の点で相違する,又は一応相違する。
(相違点1)
「溶媒」について,本願発明は,「アルコール系溶媒の比率が50重量%以上の溶媒である」のに対して,引用発明は,「酢酸ブチル/メチルエチルケトン比率が2/1(重量比)」である点。

(相違点2)
「防眩性ハードコート層」について,本願発明は,「厚みが5μm以上7.5μm未満の範囲である」のに対して,引用発明は,「厚み9μm」である点。

(相違点3)
「微粒子」について,本願発明は,「球状もしくは不定形の」微粒子であるのに対して,引用発明の「アクリルとスチレンの架橋粒子」は,一応,これが明らかではない点。

(3) 判断
ア 相違点1について
引用文献6の[0066]には,溶媒がMIBK,トルエン,酢酸ブチル,2-プロパノール,エタノール等の場合には,表面に凹凸が形成されにくいことが記載されている。
そうしてみると,引用発明の「酢酸ブチル」を,これと同様の傾向を示すものとされている「2-プロパノール」や「エタノール」に替えることは,引用文献6が示唆する範囲内の,単なる置き換えにすぎない。また,そのようにしてなる引用発明は,相違点1に係る本願発明の構成,すなわち「アルコール系溶媒の比率が50重量%以上の溶媒である」という構成を具備する。

イ 相違点2について
引用発明の「トリアセチルセルロースフィルム」は,「厚さ:80μm」であるが,引用文献6の[0044]には,透明プラスチックフィルム基材の厚みは,強度,取り扱い性などの作業性および薄層性などの点を考慮すると,最適には,30?200μmの範囲であると記載されている。
そうしてみると,引用発明の「トリアセチルセルロースフィルム」の厚さを,本件出願の出願時の市販品の中で最も薄い40μmのもの(例:コニカミノルタオプト(株)の「KC4UY」,富士フイルム(株)のTD40UZ)に替えてみることは,薄層性を重視する当業者ならば,当然,試みたことと考えられる。
ただし,「トリアセチルセルロースフィルム」の厚さを薄くすると,カールにより取り扱い性などの作業性が低下することが懸念され,例えば,引用文献6の[0059]においても示唆されている。そうしてみると,薄層性を重視して「トリアセチルセルロースフィルム」の厚さを半分にした当業者が,引用発明の「防眩性ハードコート層」の厚さも併せて薄く設計すること,例えば,引用発明の9μmよりも薄い,6μm等にすることは,当業者における製造条件の最適化の範囲内の事項といえる。
(当合議体注:引用文献6の[0059]には,防眩性ハードコート層の厚みの下限値として8μmが開示されている。しかしながら,引用文献6には,微粒子の重量平均粒径のさらに好ましい範囲として3-6μmが開示され([0056]),微粒子の重量平均粒径に対する防眩性ハードコート層の厚みのより好ましい範囲として1.2-2倍が開示されている([0059])から,「6μm」という防眩性ハードコート層の厚みは,引用文献6の記載から,より好ましいものとして導き出される値(例:3μm×2倍)に該当する。また,引用発明において,防眩性ハードコート層の厚みを薄くした場合には,アクリルとスチレンの架橋粒子の重量平均粒径も併せて小さくすると考えるのが自然ではあるが,仮に,重量平均粒径を5μmから変えないとしても,6μmは5μmの1.2倍であり,[0059]記載の範囲内にある。)

ウ 相違点3について
引用発明の「アクリルとスチレンの架橋粒子」を商品名でいえば,積水化成品工業(株)製「テクポリマーXX79AA」である([0117])から,その形状は,球状と考えられる。仮に球状でないとしても,引用発明の「アクリルとスチレンの架橋粒子」を球状の微粒子とすることは,引用文献6の[0057]の記載が示唆する事項にすぎない。

(4) 本願発明の効果に関する請求人の主張について
請求人は,審判請求書(平成29年5月2日付け手続補正書により補正後のもの)において,概略,「蛍光灯の防眩性」,「顔の防眩性」,「白ボケを防止」という3つの効果を同時に奏し,表示特性が優れた画像表示装置を得ることができる,という有利な効果を奏することは,引用文献6に記載も示唆もないと主張する。
また,本件出願の発明の詳細な説明の【0011】には,発明の効果として,「本発明の防眩性ハードコートフィルムによれば,例えば,テレビやモニター(特に画素数が140ppi以下のもの)などの液晶パネル等において,特徴ある凹凸形状を実現することにより蛍光灯の防眩性と顔の防眩性とを両立し,かつ,白ボケを防止することができる。また,低ヘイズ化により,暗室環境下での画像表示装置の黒表示時における黒の濃さの向上をすることができる。したがって,本発明の防眩性ハードコートフィルムまたは偏光板を用いた画像表示装置は,表示特性が優れたものになる。」と記載されている。
しかしながら,本件出願においては,平成28年7月29日付け手続補正書において,特許請求の範囲から,凸断面に関する発明特定事項が除かれたという事情がある。その結果,本願発明の範囲には,「白ボケ」の評価が「B」の比較例2,「防眩性 顔」及び「防眩性 蛍光灯」の評価が「B」の比較例5,並びに,「防眩性 顔」の評価が「B」の比較例8が含まれることとなった。
請求人の主張は特許請求の範囲の記載に基づくものではないから,採用できない。

第3 まとめ
以上のとおり,本願発明は引用文献6に記載された発明に基づいて,その出願前にその発明の属する技術の分野における通常の知識を有する者が容易に発明をすることができたものであるから,特許法29条2項の規定により特許を受けることができない。
したがって,他の請求項に係る発明について検討するまでもなく,本件出願は拒絶すべきものである。
よって,結論のとおり審決する。
