令和元年5月24日にされた手続補正(以下「本件補正」という。)を却下する。

[理由]
1 本件補正について(補正の内容)
(1)本件補正後の特許請求の範囲の記載
本件補正により、特許請求の範囲の請求項1の記載は、次のとおり補正された。(下線部は、補正箇所である。)

「 ユーザが利用する端末装置において、前記ユーザによる前記端末装置の操作に依らず、能動的に前記ユーザに通知されるプッシュ通知であるコンテンツとともに表示される複数の選択肢であって、前記コンテンツが不要であることのユーザの意思を示す選択肢を含み、ユーザの選択に応じて前記コンテンツに関する所定の処理が実行される複数の選択肢の前記ユーザの選択に関する選択情報を取得する取得部と、

2 補正の適否
本件補正は、本件補正前の請求項1に記載された発明を特定するために必要な事項である、「コンテンツとともに表示され」る「選択肢」の「ユーザの選択」に関する「選択情報」を「取得」する「取得部」について、「コンテンツとともに表示され」て「前記コンテンツが不要であることのユーザの意思を示す選択肢」を含む「選択肢」の「ユーザの選択」に関する「選択情報」を「取得」する旨の限定を付加するものであって、補正前の請求項1に記載された発明と補正後の請求項1に記載される発明の産業上の利用分野及び解決しようとする課題が同一であるから、特許法17条の2第5項第2号の特許請求の範囲の減縮を目的とするものに該当する。
そこで、本件補正後の請求項1に記載される発明(以下「本件補正発明」という。)が同条第6項において準用する同法126条第7項の規定に適合するか(特許出願の際独立して特許を受けることができるものであるか)について、以下、検討する。

[0049] For example, if the prediction module 206 is utilizing a logistic regression model (as described above), then the regression coefficients of the logistic regression model may be learned through a supervised learning technique from data collected in logs or calculated from log data. Accordingly, in one embodiment, the response prediction system 200 and configuration file may operate in an off-line training mode by assembling log data into assembled feature vectors. For example, whenever a member of a social network service performs a particular user action on a particular content item in a given context, various information describing aspects of this interaction (e.g., information describing the member, information describing the content item, information describing the particular context, etc.) may be stored as entries in an interaction log. Over time, the log data may include millions or even billions of entries, representing interactions between different members and different content items in different contexts. Accordingly, the response prediction system may access, for example, all the log entries in the past 30 days where various members performed various user actions (e.g., a click or a non-click) on various content items, and the response prediction system may convert each of these log entries into an assembled feature vector, based on the various embodiments described herein. For the purposes of training the system, the system generally needs both examples of where users performed an action (e.g., click), as well as examples of where users did not perform the action (e.g.,non-click). The assembled feature vectors may then be passed to the prediction module, in order to refine regression coefficients for the logistic regression model. For example, statistical learning based on the Alternating Direction Method of Multipliers technique may be utilized for this task.

For example, if the likelihood that the member will click on Ad1 and Ad3 is low, but the likelihood that the memberwill click on Ad2 is high, then content item Ad2 may be ranked higher than Ad1 and Ad3. Accordingly, the response prediction system 200 may determine that Ad2 should be displayed to the member instead of Ad1 or Ad3, since the prediction module 206 has determined that the member is more likely to click on Ad2 than Ad1 or Ad3. A similar operation may take place for choosing content to include in a content feed, based on predicting the content items that the user is most likely to like, share, follow, comment on, etc. Accordingly, this online inference process may be performed whenever the member is accessing a webpage and a determination is to be made as to what content should be displayed on the webpage.

(イ)上記記載から、引用文献3には、次の技術が記載されていると認めら
れる。

ソーシャルネットワーキングシステム100は、コンテンツアイテムソースから提供されたコンテンツアイテムを、ユーザインタフェース上でプッシュ通知として表示し、([0029]、[0031])
ユーザインタフェースは、ユーザデバイス上に提示されるユーザインタフェースであって、([0087])
コンテンツアイテムのプッシュ通知は、リンクが設定された複数のテキスト「Widget World announces new products」、「いいね」、「共有」、「コメント」を含む、(Fig. 4B)
技術。

(3)引用発明との対比
ア 本件補正発明と引用発明とを対比する。
(ア)「取得部」について
引用発明の「ユーザ」、「クライアントコンピューティングデバイス」は、それぞれ、本件補正発明の「ユーザ」、「端末装置」に相当する。
引用発明の「コンテンツアイテム」は、「前記ユーザによる前記端末装置の操作に依らず、能動的に前記ユーザに通知されるプッシュ通知であるコンテンツ」でないものの、ユーザが利用する端末装置に表示されるコンテンツであるから、本件補正発明の「ユーザが利用する端末装置において」表示される「コンテンツ」に対応する。
また、引用発明の「いいね」、「コメント」、「フォロー」、「評価」は、「前記コンテンツが不要であることのユーザの意思を示す選択肢を含」むものでないものの、ユーザが利用する端末装置においてコンテンツとともに表示される複数の選択肢であるから、「ユーザが利用する端末装置においてコンテンツとともに表示され」、かつ、「ユーザの選択に応じて前記コンテンツに関する所定の処理が実行される」ものである「複数の選択肢」である点で、本件補正発明の「複数の選択肢」に対応する。
さらに、引用発明の「いいね」等の応答を含む「インプレッションデータ」は、ユーザが利用する端末装置においてコンテンツとともに表示される複数の選択肢であってユーザの選択に応じて前記コンテンツに関する所定の処理が実行される複数の選択肢の前記ユーザの選択に関する選択情報である点で、本件補正発明の「ユーザの選択に関する選択情報」に対応する。
してみると、引用発明の「ソースモジュール202」は、コンテンツが「前記ユーザによる前記端末装置の操作に依らず、能動的に前記ユーザに通知されるプッシュ通知であるコンテンツ」でなく、複数の選択肢が「前記コンテンツが不要であることのユーザの意思を示す選択肢を含」むものでないものの、ユーザが利用する端末装置においてコンテンツとともに表示される複数の選択肢であって、ユーザの選択に応じて前記コンテンツに関する所定の処理が実行される複数の選択肢の前記ユーザの選択に関する選択情報を取得する取得部である点で、本件補正発明の「ユーザが利用する端末装置において、コンテンツとともに表示される複数の選択肢であって、ユーザの選択に応じて前記コンテンツに関する所定の処理が実行される複数の選択肢の前記ユーザの選択に関する選択情報を取得する取得部」と、共通する。

(イ)「生成部」について
引用発明における「予測モジュール206」は、オフライントレーニングにおいて、前記取得部により取得されたユーザの選択に関する選択情報が符号化され、組み立てられた、組立特徴ベクトルに基づいて、前記端末装置にコンテンツが表示された場合に、ユーザが前記コンテンツに対する所定の行動を行うかを予測する予測モデルを生成するものであるから、本件補正発明における「前記取得部により取得された前記選択情報に基づいて、前記端末装置に前記コンテンツが表示された場合にユーザが前記コンテンツに対する所定の行動を行うかを予測するモデルを生成する生成部」に相当する。

(ウ)「生成装置」について
引用発明における「応答予測システム200」は、後述する相違点1及び2は別にして、本件補正発明における「生成装置」に相当する。

イ 以上のことから、本件補正発明と引用発明との一致点及び相違点は、次のとおりである。

(一致点)
「 ユーザが利用する端末装置において、コンテンツとともに表示される複数の選択肢であって、ユーザの選択に応じて前記コンテンツに関する所定の処理が実行される複数の選択肢の前記ユーザの選択に関する選択情報を取得する取得部と、
前記取得部により取得された前記選択情報に基づいて、前記端末装置に前記コンテンツが表示された場合にユーザが前記コンテンツに対する所定の行動を行うかを予測するモデルを生成する生成部と、
を備えることを特徴とする生成装置。」

(相違点1)
ユーザが利用する端末装置に表示されるコンテンツが、本件補正発明では「前記ユーザによる前記端末装置の操作に依らず、能動的に前記ユーザに通知されるプッシュ通知であるコンテンツ」であるのに対し、引用発明では「広告、記事、ブログ投稿など」のコンテンツであって、ユーザによる端末装置の操作に依らずに能動的にユーザに通知されるプッシュ通知であるコンテンツでない点。

(相違点2)
コンテンツとともに表示される複数の選択肢が、本件補正発明では、「前記コンテンツが不要であることのユーザの意思を示す選択肢を含」むのに対し、引用発明では、「いいね」、「コメント」、「フォロー」、「評価」等であって、コンテンツが不要であることのユーザの意思を示す選択肢を含まない点。

(4)判断
ア 相違点1について
ソーシャルネットワークシステムのユーザが利用する端末装置に広告のようなコンテンツを表示するにあたって、ユーザによる端末装置の操作に依らずに能動的にユーザに通知されるプッシュ通知であるコンテンツを表示する技術は、(2)イ及び(2)ウにおいて上記した引用文献2記載の技術や引用文献3記載の技術の例に示されているように、周知技術である。
そして、引用発明は、ソーシャルネットワークシステムのユーザが利用する端末装置に広告のようなコンテンツを表示するものである(この点で引用文献2に記載の技術と共通する。)。
してみると、引用発明において、上記周知技術を採用して、ユーザが利用する端末装置に表示されるコンテンツを前記ユーザによる前記端末装置の操作に依らず、能動的に前記ユーザに通知されるプッシュ通知であるコンテンツとすることは、当業者が容易になし得たことである。

イ 相違点2について
(2)イに上記したとおり、引用文献2には、ユーザは、広告に埋め込まれたリンクをたどることで、またはボタンなどの選択可能なユーザインタフェース要素をクリックすることで、広告に対する関心があること又は関心が無いことを示すことによって、広告と相互作用する技術であって、ユーザは、広告130上またはその近傍に位置する“x”をクリックすることにより、広告に対する明示的な否定的フィードバックを提供する技術、が記載されている。
そして引用発明は、ソーシャルネットワークシステムのユーザが利用する端末装置に広告のようなコンテンツを表示する技術であって、ユーザに提示したコンテンツに対するユーザの応答を取得する技術である(この点で周知技術と共通する。)。
してみると、引用発明において引用文献2に記載された技術を採用して、コンテンツとともに表示される複数の選択肢をコンテンツが不要であることのユーザの意思を示す選択肢を含むものとすることは、当業者が容易になし得たことである。

ウ そして、上記相違点1及び2を総合的に勘案しても、本件補正発明の奏する作用効果は、引用発明、引用文献2に記載の技術、及び周知技術の奏する作用効果から予測される範囲内のものにすぎず、顕著なものでない。

エ したがって、本件補正発明は、引用発明及び上記周知技術に基づいて、当業者が容易に発明をすることができたものであり、特許法29条第2項の規定により、特許出願の際独立して特許を受けることができないものであり、本件補正は、特許法17条の2第6項において準用する同法126条第7項の規定に違反するものである。

3 本件補正についての小括
以上のとおり、本件補正は、特許法17条の2第6項において準用する同法126条第7項の規定に違反するので、同法159条第1項の規定において読み替えて準用する同法53条第1項の規定により却下すべきものである。
よって、上記補正の却下の決定の結論のとおり決定する。

第3 本願発明について
1 本願発明
令和元年5月24日にされた手続補正は、上記のとおり却下されたので、本願の請求項に係る発明は、平成30年9月11日にされた手続補正により補正された特許請求の範囲の請求項1ないし13に記載された事項により特定されるものであるところ、その請求項1に係る発明(以下「本願発明」という。)は、その請求項1に記載された事項により特定される、前記第2[理由]1(2)に記載のとおりのものである。

2 原査定の拒絶の理由
原査定の拒絶の理由は、この出願の請求項1-13に係る発明は、本願の出願前に頒布された又は電気通信回線を通じて公衆に利用可能となった下記の引用文献1に記載された発明及び引用文献2に記載された周知技術に基づいて、その出願前にその発明の属する技術の分野における通常の知識を有する者が容易に発明をすることができたものであるから、特許法29条第2項の規定により特許を受けることができない、というものである。

3 引用文献
原査定の拒絶の理由で引用された引用文献1の記載事項は、前記第2[理由]2(2)に記載したとおりである。

4 対比・判断
本願発明は、前記第2[理由]2で検討した本件補正発明から、「コンテンツとともに表示され」る「選択肢」の「ユーザの選択」に関する「選択情報」を「取得」する「取得部」について、「コンテンツとともに表示され」て「前記コンテンツが不要であることのユーザの意思を示す選択肢」を含む「選択肢」の「ユーザの選択」に関する「選択情報」を「取得」する旨の限定事項を削除したものである。
そうすると、本願発明と引用発明とは、上記相違点1で相違するから、本願発明も上記第2[理由]2(4)アで示した理由と同様の理由により、引用発明及び周知技術に基づいて、当業者が容易に発明をすることができたものであり、本願発明の奏する作用効果は、引用発明及び上記周知技術の奏する効果から予測される範囲のものにすぎず、顕著なものでない。

第4 むすび
してみると、本願発明は、特許法29条第2項の規定により特許を受けることができないから、他の請求項に係る発明について検討するまでもなく、本願は拒絶されるべきものである。

よって、結論のとおり審決する。
